Cops treat pocket knives as "weapons." Once when I went into a courthouse and had a pocket knife (the blade was less than 2 inches), the cops took it and I laughed, saying "Trying to kill somebody with that knife would require me to stab them repeatedly and I don't think they'd stand there for that." All I got was sour faces. They did give me the knife back when I left the courthouse, however.

There are so many problems with your pension idea. For one, its completely illegal. No court can take a person's pension, unless it's a divorce court. Even OJ got to keep 100% of his retirement funds. Also, what would that do to the hiring numbers? Who would take a job where they could be completely perfect for their entire career, then on the last day of their working life, they screw up and lose all of their retirement? Who would take that job? Also, pension funds are shared so you would be punishing others as well, who had nothing to do with it.

Anyone with any brains knows the pig was going to arrest the victim no matter what. Being more vocal would have simply landed the kid a false obstruction and/or resisting charge in addition to the false DUI charge. Seems LEOs often do these type of bogus arrests banking that once tox reports come back there will be something in them. Lets say this kid had smoked weed a week before, it probably would still show on a blood or urine test, and the charge would have stood. "Guilty beyond reasonable doubt", so if a drug test can't tell if I smoked a week before or a few hours before, how can a tox report be used to "prove" one was high when driving? There is an old video regarding this subject where a chief of police or a sheriff said labs are the ones that are not as reliable as their DUI expertly trained LEOs.

I dislike the method, but I admire the outcome, assuming that the cop knew that the DUI charges wouldn't stick. I think the cop wanted to teach this kid a lesson without hurting his driving or criminal record. He was clocked at 62 mph in a 35 zone, 27 mph over the speed limit. That is reckless driving. That alone can be up to a felony. Instead of simply arresting him or ticking him for that, he gave this kid a chance to spend time in a cell, spend some money, and make him think hard the next time he wishes to travel almost twice the speed limit.

Sobriety tests are not even recognised in my country- it’s embarrassing for your American citizens that this is considered legal. All police cars here carry alcohol and drug test kits in their vehicles. One blow in the tube and we are either cleared or arrested. If we blow a positive we are further tested at the police station and the cops have the results in minutes. American police forces are so backward in coming forward.

The pigs -can- will use your refusal to take the field test(s) as probable cause to arrest you and temporarily suspend your license (pending the outcome of the official chemical tests). Also, if you refuse to take the official chemical tests, they will get a warrant to force you to submit to the test. At that point, the suspension is no longer temporary pending the tests; it's a minimum of 1 year.

It bears importance to distinguish something here. A completely sober person refusing testing is different than someone who had a couple glasses of wine at dinner. I don't have the energy to type everything out, but needless to say, cooperating with any and all testing does not, will not, shall not, cannot HELP the suspect. These tests ONLY serve to help the accuser. If you agree with that, cool. If you don't, also cool. 😁😁
