My childhood home was an old Victorian where on one side of the house there was an old deteriorating wooden fence that was causing some issues for our neighbours since it was falling apart. You want to know what the neighbours did? They told my mother about the fence and it was removed before a new fence was put back up. They didn't take it upon themselves to remove the old fence or be passive aggressive about it. However, the neighbours had a few huskies that made a game out of running as fast as they could at the broken fence just to see whether they could break out onto the other side. Those huskies were lovely. They had a begrudging respect for one of our cats who was more than happy to chase them back onto their side of the fence. They attempted to do the same game once the new fence was built and were confused as to why they just hit the wooden boards and couldn't get through.

This is so odd because just Judy just had a case within the last few years where she told someone the exact opposite. Someone was encroaching on the other neighbors property, they gave the neighbor warning multiple times and the neighbor did nothing so the other neighbor took down the neighbors fence and Judge Judy said they had every right to do so. Makes me grateful for our neighbors. We lived in our house a yr before we found out the fence was ours. It's old and leans some. We let our elderly neighbors grow vines on it. We've apologized but they've always been so kind and it's never bothered them. Some people are just angry at everything but most people are considerate if you approach issues in a kind and respectful manner.

JJ was determined to be against them taking down the fence in the first minute. If her fence was on their property line and they had in surveyed then they absolutely can take it down. In fact she could have been taken to court and been ordered to pay for it to be taken out. At least in the state of TN that’s how it works. Went through something similar

If the fence had been inadvertently installed on a portion of their property 28+ yrs ago, depending on what jurisdiction of county in each state then after a set period of time the land became the neighbor because of possession
