A "lien", is a judgement applied against a piece of TITLED property that states it cant be sold until the lien holder is reimbured the judgement amount. Meaning, no lien existed on the property during the purchase. No writ should have been legally issued once the property changed owners. (If he is telling the truth about the shed, and it's value was subtracted from the house purchase price/contract...) "BTW, the shed doesn't come with the house, as indicated in your contract..."

@@brentfarvors192 Dang, you really believe the homeowner! You believe the title company has made some rookie errors and that the seller has lied. The writ was issued for the paperwork presented. Given that the sheriffs were present indicates the homeowner been fighting (and losing) the repossession. There is zero chance that if the title company was guaranteeing clear shed title that they wouldn't have verified it. My guess is the title company only verified title to the house and the land - not to any chattel.

IF he didn't know it was not paid for, but it came with the house, that's not these guys' fault or issue to deal with. You either pay the balance or they take it. YOUR issue is with the sellers, their agent and the title company.

Not the way it works. When buying a house, any structures on/around the house come with the house. He definitely has a case against someone...Imagine you buy a house with.a sunroom; Then, a contractor shows up demanding payment. You already payed for the sunroom when you bought the house...Contractors claim is with the previous owner...Thankfully, mortgage/title insurance exists for this very reason...He has a legitimate claim.

For all the kind hearted soft people in the comments: this has already gone through the courts, the question of ownership has been decided. The police were there because the shed company or lender’s dealings with the homeowner antics had already forced this to go through the courts as opposed to being a simple repossession. A court sanctioned repossession is no small affair. By the time the sheriff’s are there this homeowner has had the benefit of time and legal process. Let’s give his story that the shed came with the house some logic: this would be the same as someone who unknowingly buys a stolen car - the car (this shed) will be returned to its legal owner and would then become the basis of a lawsuit by the homebuyer against the seller. If he presented this defense that it came with the house in his court appearance the judge would have informed him of this.

Typically (unless specifically stated otherwise), Everything on tje property belongs to him, when signing the contract on the house...At the very least, the repo man is responsible for returning the fence to it's original condition. I would expect some court documents of his own in the near future...

@@brentfarvors192 there is a very good chance the shed company had a proper lien filed on the shed and that is why they won the court case and that lien would have been present at the time of the home purchase......just because it is on the property at the time of sale that does not mean you own it....if it had been a rental car the previous owner had not turned in the rental company could claim it no problem

The legal questions have already been answered - they knew they weren't making payments, and the contract spells out that it will be repossessed. Of course on the day of the repossession the person might make all sorts of claims thinking that if they say the magic words that it will give them super powers over the sheriffs and the repo man.

depends on how far behind the payments are. My neighbor had something like this happen. Court papers where servered before he moved in, in the other owners name. Court date was like 5 months after that. No one showed, default judgment. Few months later the law came knocking. Didnt matter who lived there as there was a court order. Sucks for the new home owner. Repro man comes there usually isnt thing you can do.

A judge who has looked at all the paperwork decided in favor of the shed company. Guaranteed the shed company would have offered to transfer the payment plan - and then the homeowner could sue the seller if he thought he had a case. The sheriffs and the repo man are there because he lost in court.

In 2007 during the housing market crash I couldn't pay for my car anymore, I called the dealer, explained the situation and scheduled a time to take the car back to forfeit the vehicle. Those were bad financial times and it took me 10 years to fully recover but i wasn't going to drive around like the car was mine.

@@junedimond1693 There are laws regarding disclosure of oddments about a property being sold - like in Breaking Bad when Saul negotiated a low price on Jesse's parent's home because they failed to reveal the crimes committed there. If he wasn't such a dunce the black guy could easily sue the Realtor, or real estate agency, the former home owner, and get the money to put the fence back up, and possibly buy him a new outbuilding if the seller/agent acted like it came with the home and was included in the purchase price. But if the seller/agent disclosed the building's situation in the sale documents, at most he might be able to collect for fence damages.

If it really was bought by the provious owner of the house, and went into default, the new owner of the house missed a great chance to buy the shed. The co. probably would have cut him a deal to not have to mess with doing the repo.

The new homeowner should sue the previous homeowner for false advertising if the shed caame with the house if in fact he got the house and was told that the shed came with it. What a beautiful mini house. Great job with removal!

I’m guilty of this as well but make sure you read contracts before signing people. I guarantee it was stated in the contract that they have permission to remove whatever gets in the way of removing the shed upon repo.

The cost of the home should have included the shed. I pray the new owner has his buyers sheet that shows the shed goes with the property. Or the real estate broker should have known the shed wasnt paid for. And the new owners should have been told. This breaks my heart

He didnt think it could be removed. He probably bragged to others how he wasn't going to pay for it and that it couldn't be moved. Probably

There’s no way he didn’t have a key to that gate. Like that would stop them from repoing the shed (tiny home 😂). Dude is lucky the guy was nice enough to take his time and remove the panel with no damage. Now the post couldn’t be helped. He tried to get it up but couldn’t. At the end of the day, the shed wasn’t his. The other thing to point out. As they were out at the road the dude asked if there was anything in the shed. The guy said yes, and the dude said something to the effects of “I want my 💩”. Dude was salty about not getting away with it. Also, wouldn’t the lien have been discovered by the listing agent, real estate company, or during the title work?

I find it hard to believe the homeowner wasn't warned about the repo way ahead of time. At the beginning of the video it sounds like he knew this was coming and didn’t understand why he couldn't jus pay it off. If he was a victim in the middle of the previous parties, he could have gone to an attorney to fight this. If it did happen the way he said, I would have worked with the repo company to pick it up and then gone after the title company and previous owner. But to just act surprised and innocent doesnt add up here. Priase for the repo guys, they tried working with the homeowner and didn’t rub his nose in the poop like I believe was meritted.

Whoever sold him the property with that shed on it did not disclose that money was still owned on it. I feel bad for the buyer. He should contact a real-estate attorney and get some money back from the sale

Haven't read all the comments, so if I'm repeating one I apologize. Seen a lot of comments about the homeowner not having a key, like that would change things. No way that shed was going to fit thru that gate, that fence was coming down, gate key or not. Great job by the repo guy.
