These threats that were supposedly made were so traumatic and terrifying he can't remember what exactly was said, who said it, or when it was said. He seems like a guy trying his best to conjure up an excuse for self defense after the fact.

It’s not a crime to offend someone with vile words, It’s not a crime to dislike someone bc of their sexual preference, race, gender, or ideology. It’s when you end someone’s life bc of your dislike for them, is when it becomes a crime. Murder is murder.

Just to piggy back off your comment, you’re correct in that it isn’t criminal to be a bigot. In fact, the First Amendment unfortunately protects hate speech. However, hate speech is criminal when it “directly incites imminent criminal activity or consists of specific threats of violence targeted against a person or group.” To sum, hate (e,g., racism, sexism, xenophobia, homophobia, etc) isn’t illegal, “traditional” offenses with an element of bias/hate is illegal. Therefore, the perpetrator’s motive/intent is a key factor. The use of hate speech in the commission of the act can indicate a hate crime, although the key factor is whether the perpetrator targeted the victim based on their characteristics (e.g., race, religion, sexual orientation, sex/identified gender, etc.) Moreover, in terms of the law, m*rder is not “m*urder” as there are many degrees of it and defenses depending on the jurisdiction in the US . To be fair, you may very well be speaking generally about the act itself with “m*urder is m*rder” and not in terms of the applicable laws. I just wanted to offer additional context to your comment.

@CourtTvSee I disagree he started getting emotional when he spoke about the confrontation, then his attorney stated “OK, let’s talk about that day” and he starts getting more emotional. Then they get on the topic about the dogs where he remains emotional. As they continue about what the dogs were doing his emotion starts to diminish. If we’re going to call balls and strikes, then let’s be honest and not allow our bias to set in.

I do love how youre asking your "experts" whether the defendant has produced enough evidence of self-defense when the state has the burden to prove, by clear and convincing evidence, that they werent acting in self-defense
@josealaniz140225 күн бұрын
That's the problem with "stand your ground" laws, the burden of proof has a lot to do with objective opinion i.e. what action constitutes a reasonable person to fear for their life. For some people it might just be them getting called names or threatened without action. For others it might be when they're being physically assaulted or shot at. Since so much of it depends on the defendant's state of mind it's important to get their perspective and opinion on the events so that they can be weighed against physical evidence and judged credible or not. In this guys case he apparently can't say whether or not the deceased actually threatened him, since he does say "THEY said we would come to blows" and not "the DECEASED said we would come to blows" and if evidence shows that neither he nor the deceased had evidence of being in a fight such as defensive wounds or scraped knuckles he's gonna be cooked.
@Remmysage25 күн бұрын
Wrong. When you use a self defense you basically have to prove you were acting in self defense. Otherwise you could literally just murder people and say it was self defense.
