I owned a shop for years. We had a few customer's cars damaged in that time including once when I personally backed one customer's car into another customer's car!!! Every time we immediately told the customer. I had insurance. All of my employees that had accidents let me know and I'm grateful for that. Had any of them ever lied and tried to do a crap repair like this I would have fired them. I always told my employees that accidents suck but they happen, coming up with a solution afterwards that keeps the customer happy is the important part.

When receiving car they were to embarrass to show me the paint job I have pic they sent it back after 3 weeks the hood not on properly and noise when driving took it back they said need a diagnostic takes 48hr now a week no loner . Can I sue what’s your suggestion anyone

I once accidentally put the wrong fluid in a brand new $80,000 truck's brake fluid reservoir. Stopped everyone working on it immediately and grabbed the boss. Instead of replacing an entire engine, we just had to clean a few parts.

@@latentgamer5762 Yeah I used to work in banking and it was super easy to accidentally deposit a check into the wrong account, cash a check for the wrong amount, etc. Mistype one number incorrectly and you can make a huge mistake but it can easily be corrected if you ask for help immediately.

(Just my thoughts) JM was explaining the power of word-of-mouth advertising… and how important it is to make sure the customer leaves with a good feeling about dealing with a company. I guess that ‘good feeling’-part is why she chose that example. Besides the obvious DISHONESTY, this is a very BAD idea ɪɴ ɪᴛs ᴇɴᴛɪʀᴇᴛʏ!! Claiming you have fired someone, when you have NOT, is 𝙗𝙤𝙪𝙣𝙙 to be discovered as being a blatant 𝗟𝗜𝗘!! Think about it: An employee does something wrong AND (𝙢𝙤𝙨𝙩 𝙞𝙢𝙥𝙤𝙧𝙩𝙖𝙣𝙩!) they 𝙇𝙄𝙀 about it. The customer finds out about this and knows about the LIE. The company’s owner fires the BAD APPLE 𝙖𝙣𝙙 gives the customer a good solution to fix the problem/damage/issue. EFFECT: Customer is satisfied AND SHARES THIS WITH OTHER POTENTIAL CUSTOMERS. 𝔾𝕆𝕆𝔻! But now this JM-suggestion: An employee does something wrong AND (most important!) they 𝙇𝙄𝙀 about it. The customer finds out about this and knows about the LIE. The 𝙘𝙤𝙢𝙥𝙖𝙣𝙮’𝙨 𝙤𝙬𝙣𝙚𝙧 𝙎𝘼𝙔𝙎 he’ll fire the BAD APPLE 𝙖𝙣𝙙 still gives the customer a good solution to fix the problem/damage/issue. HOWEVER: (especially in a company like in this case: a garage) 𝗧𝗵𝗲 𝗼𝘄𝗻𝗲𝗿 𝗱𝗼𝗲𝘀 𝗡𝗢𝗧 𝗳𝗶𝗿𝗲 the employee and that employee will stay working in the same workplace. It is simply 𝙞𝙣𝙚𝙫𝙞𝙩𝙖𝙗𝙡𝙚 the employee will been SEEN still working there (by either the customer OR someone the customer knows) 𝗡𝗢𝗪 𝘁𝗵𝗲 𝗢𝗪𝗡𝗘𝗥 𝗶𝘀 𝘁𝗵𝗲 𝗟𝗜𝗔𝗥, instead of ‘𝙟𝙪𝙨𝙩’ the employee….. I think the defendants didn’t tell the plaintiff the full story because they were worried that their reputation was going to get damaged. That was a bad decision because I believe if they had been honest and told the plaintiff that they suspended the employee with no pay and another mechanic would fix the issue, I think she would have agreed.

I kinda understand what JM is saying about firing the employee who damaged the car. Here’s the thing, he shouldn’t be fired for the mistake, it’s the LIE that deserves the punishment. Mistakes happen, firing someone for a simple mistake just means you’ll need to hire someone else who will inevitably make another mistake. That’s life. It’s the lie that’s the problem, not the mistake.

The Judge is right, the way in which they handled this, makes them look dishonest. For one, not communicating the full events that took place to the plaintiff, especially not stating who exactly was responsible and how they rectified the situation with that employee, makes it look like they are covering for their employee and prioritizing that, over trying to repair the trust with their customer. Then, to make your customer have to take you to Court because you were trying to be cheap, when you are fully in the wrong and should be going above and beyond to make it right and trying to keep your customer happy. It's a bad look all around, even tho they technically tried to do the right thing because ultimately they chose to prioritize themselves and their wallets, over actually making it right. And at that point, your intentions don't matter.

@@valariehunter5389 I'm not sure how that would change anything and that scenario is actually more common than you would think. Employees of Auto shops take customer's cars for joy rides all of the time and sometimes they get caught, by getting into an accident or from customers having dash cams, GPS trackers, or they record their mileage. Obviously, there's also legitimate reasons for a mechanic to drive the car off of the lot too, like for diagnosing a problem or test driving after a repair. Either way, it really doesn't matter exactly WHY the mechanic was driving the car, it matters that it was damaged in the shop's care. And by your theory, that would actually make it worse! It's one thing to cover for an employee that had a little accident, while actually doing his job. It's a WHOLE other thing if they were covering for him, if he were up to no good when he took the car. Then it makes it seem like they were potentially complicit in whatever their employee was up to and are covering for themselves as well. But if it happened exactly how they said and this is truly just a case of a good business with an employee that went rogue, there would be absolutely no excuse to not tell the customer what happened. Especially if you want to reestablish trust with your customer and reassure them that you are doing the right thing for them but also to make sure it doesn't happen again in the future to them or anyone else. Otherwise, it just looks sketchy, or at the very least selfish. It's also a good idea to tell them what happened, who did it, and how it was handled before you send the employee, who she thought was responsible for this, to go deal with the customer to fix it.

I have to disagree with you here, for exactly all the reasons the Judge gave too. People can almost always get a second chance with me. And I fully appreciate that anyone can make a mistake. Things happen and we can work from there to fix it. But…. second chances are 100% gone when people are DISHONEST. If I can’t trust someone, I don’t have space for them in my life, whether personal or business wise.

I had this happen at an Acura dealer in Canada. Even with having a reverse camera. The worker backed my car into another when he was doing a 3-point turn inside the garage (while I was watching from the waiting room above the garage and looking at it happen through the window!) and the jerk GM refused to do anything about it! Left a big depression/dent in the bumper. This Defendant was a nice guy. NEVER BUYING AN ACURA AGAIN!

The mechanic was hoping that no one would've noticed. I believe that the boss didn't know, otherwise he would've told the mechanic to do a better repair job. The boss probably really likes the mechanic and didn't want to fire him for 1 mistake, even if it was a big mistake. This case does hurt the stereotype that mechanics are dishonest people but the shop owner was trying his best to make the plaintiff whole and I give credit to him.

That type of dishonesty wasn't just a little lie, it showed just how dumb he was, and that he thought everyone else was as dumb as he ...he worked there for over 4 year's and never figured out that there were survalance cameras at the place he worked...he messed up first by damaging a customer's vehicle, then he fd up by attempting to hide that fact, then he still lied about it even when it was discovered...wow!! I just would have to let him go and wish him the best in his life,and hope he learns not to do that at his next job... Whether they fire or don't fire the employee really isn't the issue here - the issue is about making the plaintiff whole and on her terms since they violated her trust, which they did. THAT said, I get wanting to be empathetic towards employees, but one thing you can't really overlook as a people manager is dishonesty and lack of integrity. Making a mistake and screwing up is one thing; we all do it. Lying and trying to cover it up is another. That kind of stuff can destroy a business, especially a small or family business. Sometimes you just have to cut your losses on things like this, and someone who does something willfully and intentionally dishonest just needs to go, and it's really not somehting that should require debate. If he does it once, he'll do it again. I wouldn't want unethical and integrity-less people working for me, anyway.

It's her court,,,,was her court. And it was only a 10 /15 minute 20 tops case she needed to get the ball rolling, and there are always these people in the comments that never understand this...plus she read everything ahead of court ,she didn't need anyone to say boo and could have just ruled with no one saying a thing... she gave people an allotted time to speak their case ,not repeat and not answering what she asked instead trying to go back to things that have no bearing on the actual case. Anyway it was her courtroom she could do whatever she damb well of pleased,with in the law of course. I love the old peoples court, with jm, but her knew show sucks big time.

I'm sorry but didn't I just hear the judge that she would have FIRED the worker Juan for being DISHONEST about the cover-up paint job BUT under the same breath she was telling the Plaintiff the company should at least fire the worker OR say that worker was fired when he wasn't. Now how is that practicing HONESTY Judge, you can't have it both ways?

I’m trying to understand if they thought it was so fair why did a judge have to order them to do it. The car was at the body shop and they had parts ordered. Min she said no I rather the body shop do it that’s what should have happened and they could have saved face.

Am I the only one who agrees with the judge’s concept of scales of honesty? Lol Like she’s ok with a little white lie, but she’s not ok with outright coverups. I feel like that’s how most people live their lives whether they realize it or not. If my employee was late because the line at Starbucks was long and they claimed, “sorry, traffic” it’s whatever, but if I asked why the till was short and they shrugged like they didn’t know when they stole it that’s a WAY bigger deal, even if they took the money with good intentions.
