Sir rule 10B me agar Appelate court ko lage ki order galat h to phir wo usi court me suit continue krne ka order dga kya jha phle suit file ki gyi thi?

If the appellant court set aside the order of the lower court then obviously the lower court will try the suit.

Hello sir, I have a doubt in O7 R10A. Sirrr under rule 10A sub rule 2 Is plaintiff asking court to specify the proper court where plaint is to be filed after its return or Plaintiff himself specifying the court where he proposes to present the plaint after its return. Sirr please reply.

Thanks sir very good explanation Sir , R.7 m alternative claim ka yhi meaning h Like when there is contract b/w A&B related to sale of car in 5 lac. A make advance of 3 lac and B refuse to deliver the car .then B can claim specific performace of contract or in alternative restore the money and compensation. Am i right ??? sir pls reply😊😊😊

sir please reply to one query summons issued, plaintiff & defendant, both appear in court, plaint returned, the court intimate its decision to plaintiff, but what about defendant who has appeared in wrong court, in pursuance of summons served, will the error in summons be corrected? because it can be taken as a ground of defense by defendant that 1. court does not have jurisdiction, 2. the summons have been wrongly served to warrant dismissal of suit 3. the plaintiff tried to convert suit into exparte hearing 4. that he is not the person in whose name summons have been served please reply

Where the court has fixed time for certain act, so only in that situation court has a power to extend the time
