The defense is foolish for not turning it on before he messed with anything. He knows he broke it if he installed these regularly then he will know you barely even have to put pressure for these TVs to crack. I have seen one crack by somebody handling it and pushing their thumb too hard into the screen. Maybe it was lucky that this happened so they don’t end up with a fire hazard and extension cord as their wiring lol

The person who hung the TV likely used screws for the mount that were too long. It's actually laid out in manuals for TV mounts that you need to get the length right to prevent cracking the panel from the INSIDE of the TV. That's also why they always provide spacers because often the screws with the proper thread pitch can be too long, so you add a spacer and it's all good.

judge didnt explain how she was qualified to say what the installer did to damage the tv . judge didnt call any tv manufacturers or tv repair shops to quality her decision . the installer did get info from a tv dealer and they explained that the type of damage happens if it is dropped , but not placed on a couch with cushions on it .

I disagree. In the moment someone can say anything. Defendant had already said that stuff, but the plaintiff wanted to have it recorded. Defendant thought that was silly because "just trust me" should have been enough. In order to keep it light and airy, and not cause an issue, you play it cool as if it doesn't bother you. I know this because I had movers destroy my brand new mattress and literally the second the guy saw that I noticed, he started screaming in my face, as if I did something wrong. In order to calm the situation I stepped away, and when his boss came in I had to play it cool like I wasn't upset their company just destroyed my bed. I had to play along to keep the guy from getting violent (and trust me, 4 big dudes in your house, mad because they think they're gonna get sued, you want to play cool.) It's part of fight, flight or fawn. They were fawning.

WHAT? A TV that is only 6 months old does not depreciate by $700, normally the calculation is based on 10% per year, so the judge should have awarded him $2160. If I hired a professional to install my TV on a wall, I wouldn't expect it to have an extension cord hanging from it, nor would I expect him to drill out a screw, nor would I let him do anything to my TV without me hovering over his shoulder. It was definitely a Humpty Dumpty job ha ha ha...

This is a win for the plaintiff. The damage on that TV could not have resulted from unscrewing those legs if you've dealt with flat screens. He scammed the defendant and got away with it. Defendant should have had him turn the TV on before beginning work. The plaintiff also testified he was asleep during the defendant doing this work, yet there he was in the security footage on the phone watching him do it, weird.

We can use an extension cord to connect a t.v. If the cord is reputable. Regular house extension cords are not recommended, but they can be used. Very low electricity used.

I know the TV was relatively new, but people do scam so it makes me wonder if the screws were stripped out before the defendant started working on it and it is possible that the plaintiff stripped them out and broke the TV himself and then decided to call in a professional and blame everything on him 🤔 But that’s the difference in criminal and civil. I believe the defendant on this. That kind of damage requires a drop or a lot of physical pressure. He didn’t do that drilling on the back of it. He was scammed, but he didn’t do his part in having proper evidence or checking that it worked before he started. Also, it would be more of a fire hazard to run a drop cord behind drywall than it would be some faux rocks. I wouldn’t personally do it, but it’s not that big of a deal especially if it’s a surge protector cord anyways.

actually that damage can happen with screwing and not that much damage. if they use the wrong screw it would do that.

@@bobberry1463 They were removing the manufacturer screw from the legs which were installed by the plaintiff so no, the defendant could not have caused this damage unscrewing those legs in this case.

I had a service man break my oven door on my new gas stove and refused to order the parts unless I gave him $350. I asked to take a video of him admitting he did it. He said that's hostile behaviour, I'm leaving.

The plaintiff looks like a KZbinr "the armed fisherman." Here in Florida we can open carry while fishing, camping and hiking. So he goes all around Florida fishing while armed to see if our civil rights are upheld. Which they, the police, often go to far. But this dude looks like a darker skinned version of him.

@Marilyn Willett depends on where I'm going and what I'm fishing out of. Usually something smaller like my 9mm hellcat. But if I'm on my center console I have a 300 blk out pistol I'll carry because there's no much risk of tipping like in my kayak. But what's that matter?

I think what the $1,700 is for is if you bought a used tv it would depreciate significantly the minute you took it out of the box. So, if he sold it after six months he'd get $1,700

Since the installer failed to verify the tv was fully functional, we can not know if it was broken beforehand. But, the weight of the evidence suggests the crack was initiated from a pressure point.

The defendant could possibly punch through a wall stud, which I feel should have been considered in the judgment.
