If they actually knew the law then they'd be lawyers. Even lawyers/attorneys do not know all the laws. That's why there's different types of lawyers that specialize in what they do. It's like a doctor will not know all medical practices that's why it takes a team of medical professions to make it happen. A general practice dentist generally isn't going to be a oral surgeon and a oral surgeon isn't going to be a orthodontist.
@Mxxx-ii9bu10 ай бұрын
Actually the law allows the state to enact and enforce reasonable time, place, and manner restrictions on expressive behaviors when these behaviors occur on limited or nonpublic forums. The state office building is a limited public forum and the security guard was well within his authority to coerce Asselmo into leaving. If being wrong about the law was a professional sport Asselmo would be in the Hall of Fame.
@tim4pele10 ай бұрын
At some point in your schooling you should have learned the difference between Traditional Public Forums, Designated Public Forums, Limited Public Forums, and Nonpublic Forums. If so, then you'd know that a government office building is either going to be Limited Public Forum or a Nonpublic Forum, depending on its purpose. This has been upheld many times by the courts. A courtroom is a limited public forum, not the entire courthouse; and only when court is in session.
@andysmith199610 ай бұрын
@@jonahzablow2132 No. For example, look up Sefick v Gardner 164 F3d 37, 372 (7th Cir, 1998): "The lobby of the courthouse is not a traditional public forum or a designated public forum, not a place open to the public for the presentation of views. No one can hold a political rally in the lobby of a federal courthouse. It is a 'nonpublic forum,' which government 'may reserve . . . for its intended purposes'." Or, to put it more simply, Berner v Delahanty 129 F3d 20, 26 (1st Cir 1997): "A courthouse and, especially, a courtroom is a nonpublic forum." Note it says "courthouse", not just courtroom, and it says nothing about only when in session. This may come as surprise to you, but "first amendment auditors" routinely lie to their followers. They pretend that there are no or very few legal restrictions allowed on the first amendment in government buildings, when that is not the case, and they invent nonsense like "you can't be trespassed unless you've committed a crime first" and "you can't solicit a trespass". With how often this guy claims to be harassed, and whines to the police about it when they show up, isn't it a bit hypocritical to be saying something like this about anyone else? People just want him to go away and leave them in peace and he doubles down to focus all the attention on them. That IS harassment. Especially when he knows it's causing someone distress. Doesn't matter why it is, he does have the choice to be a good person and not cause other people distress. He chooses to cause as much stress as he can. This is the kind of person you lick lenses for.

Elmo-boy had his feelings hurt when the guard got close to him. Elmo threatens to be a Karen simply because his feelings got hurt.

Can he sue the sergeant just for threatening arrest? I know it's probably a pain in the ass, but that guy wanted to take his freedom.

Oh no 🤦♀️ Did the SGT just say that? How embarrassing to be that sgt and not know the difference between private and public, trespassing for recording in public.

Wow. 🐖 alert! 🚔 👮♂️ Disgusting. Tyrant is not too harsh of a word, fits that clown to a T. That security guard is a damn joke. How someone like that, has an ego that big is beyond me. 🙄 🐖 😂

Wannabe cop. What’s sad is, people like that security guard have become cops and they’re typically the tyrants. Probably had no friends in school, never could get a single girl and uses that badge to fill a void.

Horrible excuse for a Sgt. Gifford’s distain for a citizen exercising his rights that he swore an oath to protect is hypocritical to say the least. He had just admitted on camera that they did not necessarily know the laws per se and then turns around and incorrectly tries to trespass the man from the building based on employees “feelings”. You always hear the question being asked “are you the feelings, police or law enforcement“?

Cops walking away and frauditors screaming after them isn't shameful. What IS shameful is how AssElmo thinks he's "dismissing" anyone.

@@randybenefiel8900 Nope. I think it's funny how frauditards believe they are clever when they "dismiss" cops who are already walking away. It's childish.

I hope a complaint on this sergeant was filed. He obviously has no working knowledge of the 1st amendment and desperately needs training! He tried with his all to solicit a "trespass" which is definitely dereliction of duty!
