If you are a criminal defendant, it is far better to be a woman than a man. For the same crime, and with a similar criminal history, men in the U.S. are imprisoned much more frequently and for much longer sentences. This is one gender gap that we hear very little about. Coming up next on the Factual Feminist. We incarcerate people in the U.S. on a scale unheard of in most parts of the world. If you brought together all those now in prison and on probation or parole, it would constitute the second largest city in the nation. And it would be close to 90 percent male. Now the fact that more men than women go to jail is not itself a sign of discrimination. Men are far more likely to be rule breakers, risk-takers, and perpetrators of crime. But what happens when men and women are arrested for the same crime? To answer this question, Professor Sonja Starr of the University of Michigan Law School examined a huge dataset of federal criminal cases. Unlike other studies that looked only at the sentencing stage, she followed the fate of defendants from arrest through sentencing. Her findings were shocking. After controlling for the arrest offense, criminal history, and other prior characteristics-and looking at the process from beginning to end-she found that women are significantly more likely than men to avoid charges and convictions altogether and “twice as likely to avoid incarceration if convicted.” On average, men received 63% longer sentences than women arrested for the same crime. Professor Starr estimates that the gender gap in sentencing is about six times as large as the sentencing gap between black and white defendants. Starr offers a few possible explanations for the gender disparity: Women are often viewed as “followers” of their male romantic partners,” so judges and prosecutors might perceive them to be less responsible. Second, women are more likely to be the primary caretakers of their children, and prosecutors or judges might worry about the effect of jailing mothers. It’s also possible prosecutors and judges are more easily persuaded that women who commit crimes have mental health problems. What is the solution? Harsher sentences for women is not the way to go. The U.S. is already known as Incarceration Nation-more prisoners is not the answer. But if the courts are indeed making exceptions for women for their special circumstances, they should consider doing the same for men. As Starr points out: “About one in every fifty American men is currently behind bars, and we could think about gender disparity as perhaps being a key dimension of that problem." So here we have a pressing gender equity issue-with huge social consequences. But If you look at the major women’s websites, you find mainly complaints about how women are treated in the criminal justice system. On the ACLU website you learn that, “Women receive harsher sentences for killing their male partners than men receive for killing their female partners.” The source is a 1980s fact sheet from a women’s advocacy group. But a newer and more serious study from the Bureau of Justice Statistics found that even if you exclude all the cases where women killed a husband out of fear or self-defense, Wives received shorter prison sentences than husbands (a 10-year difference, on average.)

There was a case recently in the UK of a female teacher who seduced, slept with and did other things with students. She'd already been in trouble for similar things but she was spared jail. A male teacher in the same situation would have been jailed and put on a sex offenders' register. Seems like double standards to me.

@@7svn. ​ I was in an International Women's Literature course a few years ago in University. And, we were all asked what feminism is -- as there is no one general definition behind feminism. The young woman sitting directly infront me, the only male in the class, said it was about putting men down, and taking from them to get equality. It's unfortunate, but these days misandry is mistaken for feminism commonly.

That's not a long-term solution as it would exacerbate the over crowding problems in prison, but as a short-term solution to get the ball rolling on equalizing the sentencing gender gap and make sentences for men more fair, yea, it's about the only thing that will get these liberals to wake up to reality.

+1400deadwood This is why I feel that feminism, at least certain branches of it, is indeed sexist. We are all part of the human race. If one gender of the human race fails, we are ALL affected by it. Dismissing something solely because they are the "wrong" gender does not make it okay. I agree with you, these issues do need to be addressed. If we, as a society, keep giving women, or any demographic, an easy pass in the court system then we could quite possibly see the rise in crimes from these demographics because they will not fear the consequences as much if they were treated the same. As for your last point about it also being a women's issue, I completely agree with you. It IS a women's issue. I do not care if the person killed was a male/female/trans/gay/lesbian (or whatever gender the progressives come up with next), it still affects people other than them.

Not always. If the woman confesses, and the man denies involvement, it is a logical reason why the woman would receive a greater sentence. Same thing is true if the sexes were reversed.

I witnessed it first hand.. about 10 years ago, was in court for traffic. A Young boy came up.. 16yo, 1st offense, disregarding traffic device(ran stop sign)-- 6 months supervision $150 fine + court costs... next person was a young woman.. 17yo.. 1st offense, disregarding traffic device(ran stop sign) no supervision, $50 fine and costs... Everyone in the courtroom collectively said wtf...

Law emanates from social backgrounds. In the end, gender is key as many legal systems have different sentences for men and women.For instance, an expectant woman cannot be sentenced to death.That said, blind trial would be ideal to solve the disparity but unfortunately not practical.

My brother was just arrested and lost his job bc he argued with his girlfriend. He didn't touch her. Didn't even come close to her. I was there. Saw the entire exchange. She called police he went to jail now he lost his job and she's stressing how they are going make ends. I said you did this to yourself. You called the cops deal with it.

The root of the issue is the American perception of incarceration. People in America view prisoners as animals and treat prison as some kind of punishment. Of course, we should know by know that a glorified "time out" isn't going to teach a prisoner any lesson besides "I should have cut your fucking tongue out so you couldn't testify against me". America needs to take steps to rectify its penal system. First step is stop jailing people who use drugs and lead them to programs to sober up if they find themselves getting out of hand. Second is to reduce isolation from society. People who leave prison are entering a world that's totally foreign and alien to them. Without proper integration and rehabilitation programs, many ex-convicts are likely to become a repeat offender. Lastly, a good, hard look has to be turned towards the root causes *of* offences. If something is causing a high rate in crime, throwing people in jail is going to do more hard than good.

If you're from 'murica' then that is the first time i've seen someone talk sense about these kinds of things. Usually it's just the idea that guns will solve crime. After implementing efforts to the causes, you'll have a country like the Netherlands, where the focus is on weeding out the root causes of the bad behavior. For the harsher crimes there is too light sentencing in my opinion but i like the idea that it's set up to fix problems rather than create more.

Unfortunately, a growing segment of American prisons are for-profit, which completely dis-incentivizes any move toward rehabilitation. In fact, the private prison lobby actively works to stiffen penalties in order to get more prisoners. Arizona's SB1070 was developed by people with direct connections to private prison firms. Prison in America is no longer about punishment. It's about making a buck. The consequences for the inmates are irrelevant.

In America most drug users are offered rehab at the expense of the state along with welfare and medical insurance. The only way you will go to prison over drugs is if you are found with a large amount and are found guilty of intent to sell. Also you obviously haven't worked with criminals or drug users if you think anyone besides them can change their minds. No matter what reforms you suggest they will all go in vain because criminals(huge surprise!) don't cooperate with you the way you want them too. No amount of social programs will help these people. The only way these kind of people change is through their own decision to change their lives around and for many people this change happens in prison, so prison isn't completely useless as you try to make it seem.

Instead of putting your (tax) dollars into combatting the problem, you just hide those who are afflicted behind bars. Yeah, usefull allright for those who already have a good life and don't want to share it or help those before they fall from grace. Much easier to keep living the good life without having to bother as a society, better hide the problem away in the biggest prison population on earth....

I'm a law student and I was studying family law one day and found out something fairly shocking. It's law in my country that an unmarried father has absolutely no custody rights over his children nor even rights to be in contact them if the mother doesn't wish it. I was reading a judgement over a judicial reveiw case where an unwed father was challenging the law after he had been denied access to his children by their mother. He was unsuccessful and the exact wording from the judgement of the case was that "fathers of illegitimate children are more likely to be rapists, seducers and prostitute users". So basically if a child is born out of wed lock it is entirely because of the father. Women are considered to be gentle and mild and would never engage in pre-marital sex out of their own free will. Men however were sex hungry and in fact forced the women to have sex before marriage. It is currently law in my country that fathers of illegitimate children are considered to be inherently bad people and should not be allowed access to their children if their mother doesn't allow it. Yes, sexism exists, but it swings both ways.

I went to law school in the UK. If you want to get real mad, I went to one of those fancy law schools where they just do law and the teaching is very hands on - every week we did some kind of moot/mock trial During my tort class we were having a mock trial on a serious assault case and part of the class was to decide how much compensation to give the victim for the injuries sustained. We have real government guidance on that; I ended up looking at compensation for disfigurements. For some reason, the amounts were split into gender - you can imagine which gender got the most as per the guidelines. The biggest gap in compensation amounts was for serious disfigurements to the face. Where, if I remember correctly, women get awarded something like three times more than men. Hope you managed to stick law school through.

That's terribly unfair. Thanks for sharing this information. Equal crime committed should be punished for with same amount of time, whatever the correct agreed on time is. Also it is differences like this that I think make women look bad and get less respect overall, because woman are given better treatment in many regards.

I have noticed this as well on a few occasions. We do have far to go with equality. I have always worked under a few female CEO's or the owner of the business itself. I have never thought that was an issue. I have been approached sexual advances that were insane by those same CEO's and owners of the company, but took it as a compliment (only stating due to how the other direction is condemened - I never was scarred mentally from it). It is a wild generational situation that I felt great about the "grey race". Never looking at skin color, sexual orientation or religion - only looking at the person that I deal with. I truly believe people should get the exact same treatment/sentences, no matter what gender you are or identify as. That would be TRUE equality and would hopefully lessen criminal behaviour. One thing that is sometimes scarier than the crime, is when the perp knows they can get away with it.

I've always felt that laws should set exact punishments, rather than this "between 5 and 10 years" sort of laws we have now. The judge should just preside and keep order. The jury just decides guilt or innocence.

Former feminist (equity) Warren Farrell wrote about the male/female sentencing discrepancy TWENTY years ago in his book: "The Myth of Male Power". He updated his book recently, and sadly, NOTHING has changed in twenty years. Women still get a sentencing discount, and men are still treated as disposable to their kids and families for the crime of having the wrong kind of plant in their pockets. Men have ZERO shelters for domestic violence and get ZERO help from the state, so men tend to self-medicate or lash-out in despair.. and many men end up in jail. Jail is a state industry, with a powerful lobby group, and men are the products they trade in. Women simply don't care what happens to men, so long as they survive men can keep dying at work at twenty one times the rate of women and keep killing themselves at eight times the rate of women. This is an OLD issue, dating back centuries, where it was suggested that it was a waste of time even attempting to jail women because of the massive gynocentric view of society. Men are always held responsible, women are not to anywhere close the same degree. Boys find this out really quick... who asks who for the date... who pays for the date... who gets in trouble more if they have sex? Boys... as disposable as ever.

I was arrested in 2008 for dv, my exwife was beating up on me while I was driving, and I held her by the arm to stop her from hitting me, I left my fingers marked in her arm, and she left me a bunch of marks on my face and shoulder, she called the cops, I was arrested, for dv, never convicted I took it to court. When asked by the cops why I had those marks, I told them that I did them when I was fixing my car. I protected her even though she screwed me.

Thank you for bringing awareness to gender inequality that involves men. Many other feminists would look at that statistic and call it "benevolent sexism" against women and completely ignore the damage being done to men. I think part of the reason it's ignored is because men are told to "suck it up" and "be a man" so we simply suffer in silence. In contrast, women are told quite the opposite. I'm not sure whether these attitudes are brought about by environment or something inherit to males and females but something needs to be done to keep both sides issues fair and balanced. As a man, I really wish a lot more women could understand or acknowledge the myriad of problems that men suffer simply because they are male. This is just the tip of the iceberg.

While i greatly appreciate Christina's wisdom in some area's, her last comment "why dont more people seem to care?" is enough to tell about the nature of modern attitudes and feminist affects after decades. why would people care about men when they are constantly portrayed as bad and not worthy of sympathy? feminism has been doing this for decades, some factions of feminism may back peddle a little bit but as soon as the door opens for feminists to take advantage for womens unfair gains and money, it will all happen again. history always repeats itself, feminism is no different. Humanism is the only hope for real equality. feminism is the most successful hate movement in history.

Ivanna Nukya Feminism does mean equality between men and women, but I won't leave my response with that only. I've just seen Christina's videos, and I have to say that she actually addresses both sides. She's not one of those feminist who would just say "men are discriminated too" and move on to something else like it doesn't matter, she actually speaks out for it. The point is feminism is equality between men and women, and most feminist do live up to that definition (except the radical feminist that do advocate for superiority), but they rarely talk about the men's side of thing and explaining it in depth, which is literally what she's doing right now. She's also someone speaking for men that don't blame feminist like most MRA works do.

Keep this in mind just because feminism by definition means equality between sexes doesn't mean I don't pay attention to bigotry. It's just that most feminist have done actions on certain topics that it's rare to see a feminist to talk about equality, especially one who actually puts emphasis on men's issues rather than just "men also has issues too". It's like the exaggerated statistics saying 99% happened compared to 1%. That 1% still exists. It's just like with the MRA group. Most of their works blame feminist for everything without any concern for how to approach it from other angles that it foreshadows a few good ones who do mean well.

Prime examples I notice: (not just about criminal sentencing but sexism against males in general) * If a man is accused of rape, regardless if he is innocent or not, he is treated as guilty until proven innocent. And even if he is proven innocent, the damage is done, he will probably never find a job, nor make a living. And the woman who accused him just gets a slap on the wrist and just gets a year or two when she ruined his life. * If a girl wants to act more "masculine" and "boyish", she is more likely to be praised and told how wonderful she is. If a boy wants to act more "feminine" or "girlish" he is more likely to be insulted and told that he is a disgusting waste of oxygen. * If a boy and girl are arguing, even if the girl is in the wrong, nearly everyone will see the boy as an abusive person, while the girl is comforted. These are just prime examples that I notice.

My neighbor used the beat the crap out of her husband all the time, and he would NEVER fight back or defend himself. He was frequently covered in bruises and she looked normal. Every time the police came they would take HIM to jail, despite the WOMAN being the one that was doing all the abuse. And the police told him it didn't matter who it who, they would ALWAYS take the MAN to jail ! The police said that is what they were told by the prosecutor to take the MEN to jail since it looks bad to take women to jail and men are easier to prosecute ! So the police COMPLETELY IGNORE THE TRUTH ! And the women aren't even charged. I'm betting that would greatly change the statistics that rely on police data !

a very important point is that the men in prison are largely poor. I think the real privilege that is under-considered is economic privilege. If economic inequities were addressed, I believe sexism and racism would diminish and perhaps evaporate. Unfortunately many feminists, ones who create rather than solve problems, have to create problems in order to create jobs for themselves. Misogyny will never end as long as the children of the 1% need to create an interesting profession for themselves more sensational than the truth.

My wife has had a mental illness with episodes for years and hospitalisation etc. Not the light stuff. Long story short I have raised my kids while taking care of her, working, doing sports, playing with them, all the shores yadayada. Kids have super good grades, very sociable, no problem whatsoever.....BUT if you are a single dad or taking care of the kids alone never EVER mention it to the teacher/director of the school. If you kids falls or get harmed in any kind of way they won't care the slighest bit and you will be held responsible, even if your kid tell them exactly how it happened and that you weren't at fault. Also as soon as you mention it the teacher will become extra suspicious of everything your kid does. Seeing this in this day and age and the bias is disgusting.

Also when a women commits a crime she will get away for doing that much more often than a man. When a female jacks a bike some people even help her and men (especially black) are getting the cops called on them much quicker. There was a social experiment about it if you didn't saw that one you should see it.

I just raised this thesis in discussion an edX course on prison writing, the idea that there is pervasive direct sentencing bias against men. I did get some nasty blowback. Unfortunate, but predictable. I was aware of the Michigan study, but I was not aware about the numbers on intimate parter homicide, I actually got fooled by that one and did not immediately challenge the number even though it looked wrong, so thanks for pointing that out. Somehow, I doubt posting it will suddenly convince any self-described feminists that this issue is real, but at least I'm on solid ground, and I can talk about this issue with confidence in other places in the future. I do wish the citation had been more easily available; I was able to look it up but it would have been nice if it was in the description for this video or somewhere immediately accessible. This was a very timely video for me though; thank you.

My uncle was given 6 years in prison for having less than a gram of marijuana on him. While inside he became institutionalized and committed a much worse crime when he got out. Now he's in prison for life and marijuana's legal in his state.

Quite sickening when you think about how this plays out when you have a male versus female scenario in court, which according to this data would likely favour women, especially when it comes to e.g. getting property and children after divorce. But hey, it's just the expendable males who are treated harshly, so we can just keep pointing out how bad women have it everywhere... including courts and prosecution of course.

I watched the Ryan Poston murder on 48 hours about how a young college student killed her boyfriend over being rejected. She was a stalker, liar and manipulator to everyone around. She killed her boyfriend in cold-blood, and although she did get a 40 year sentence, you could tell that prosecutors, and even the judge, wanted to give her leniency, If not for the fact that she was too batshit crazy and unremorseful! It seems the only way a Woman in the US court system could get equal punishment is if she admits to the murder on video, reenacts it, by making egregious statements to interrogators, displaying no remorse and plainly yelling out, yes, I killed him! That's the only way a Woman would get equal punishment relative to a Man of the same sentence, because the same sentence towards a Men would mean life in prison! - Oh, and she got parole in 20yrs. you know what that means....

This is scary stuff but not surprising. I feel that women are aware of this and will use it to their advantage. I don't think the solution is an all or nothing approach. We should have a prison equality act, where women will be set to a higher standard and men won't be set to such an extreme standard. Men and women will be set to the same standard, and women will know that they can't simply get away with crime... such as a female rapist of a male child not going to jail. If a man would serve a jail sentence, a woman serves a jail sentence. If the jail sentence is too much for a woman to serve, then it is too much for a man to serve. Justice would be gender blind.

The female sex is actually the default sex. In monosexual species, most of which have gone extinct, the anatomy and reproductive practices matches sexually reproducing females a lot more than it matches sexually reproducing males. It takes the extra genetic ingredient, the SRY gene on the Y-chromosome, to make a male. When the second chromosome is absent, the individual ends up being female.

@carultch You seem oblivious to the fact that in reptiles (including birds) the "default" sex is male; excluding those those who's sex is temperature dependent. An XX pairing of chomosomes in reptiles results in reproducing males, while an XY will result in reproducing females. A missing or malfunctional Y chomosome in these species will result in the animal "defaulting" to male. This is why peahens on rare occasions are known to spontaneously transform into peacocks. This is one trait that allows female komodo dragons to reproduce asexually (parthenogenesis), and why when they lay their clutch the offspring may be male or female. Think "Jurassic Park"; all the dinosaurs in the park were female, which is an issue as certain reptiles are capable of parthenogenesis and they ended up with more dinosaurs than they meant to have! The "default" of female is far from universal. Even in humans "default" is not reproducing female; without a functioning sex hormone cycle a human female's reproductive system will remain small and underdeveloped. The uterus will not be able to carry a child even if eggs are implanted, the vagina will be shallow, and the gonads, if present, will be small. They will also fail to develop secondary sex characteristics typical of reproducing females; i.e. greater body fat percentage, pronounced breasts, etc. I would hesitate to classify such an individual (only on the biological level) as a "female". This is what a gender neutral body would be. Therefor the default for humans would more accurately be described as gender neutrality with underdeveloped female-like reproductive organs.

Do not get me wrong anyone, I am a pro feminism pro communism and social and pro liberal on almost every issue but what I CANNOT ignore is THIS inconsistency on women get less time than men for crimes that are the same. This is very true. I was in jail in Sioux Falls SD in 2015. I am a 24 y.o. male and Hispanic. I was denied bond for possession of 2 grams of marijuana, while a women who was 26, and white was released on bond even though she was in jail for THEFT OF A MOTOR VEHICLE. This is a countless repeated issue in Sioux Falls SD where women are being released FREE for meth possessions and other violent crime. Dont get me wrong I am pro choice pro marijuana pro social medicine but THIS is wrong, and unfair.

Thank you for talking about this. It's an inequity that feminists don't normally acknowledge. If equal prison sentences isn't "the answer", then I'm curious to know what "exceptions" the courts could make for men to get rid of the inequity.

When Valerie Solanas shot Andy Warhol and a London art critic,, she was given a three year sentence, with "time served" for psychiatric treatment/observation included... If those two men had shot her, what would their sentences have been???

i'd really like to hear her say something i disagree with. i already respect her ability to reason so it'd only take my respect for her to a new level because it's starting to feel like she's only saying what i want to hear.

This presentation points out the huge problem our justice system has with bad sentencing standards. The double standard is obvious. For an adult man to have consensual sex with an underage girl, the sentence might be 20 years, but for a women here, it is probation. Our whole system needs revalidation and our courts and sentencing public policy is so decentralized that I could not tell you where to begin. I would like to see less vengeful punishment with excessive time in jail, for consensual crimes like 2 teenagers “parking” and having consensual sex, 2 adults having consensual sex on a beach, a motel pool late at night. When consent is part of the act, I would like to see less government involvement in the punishment, and less use of the registry to “ruin” the lives of what might have been an innocent act of passion.

I spent some time in Alaska in 1996-97. One story I recall involved an argumentative couple leaving a bar late one night. They got into a car with her in the driver seat and kept arguing. After a brief drive around the parking lot the man was ejected from the passenger side. The woman drove forward, stopped, then ran him over and killed him. She told officers it was an accident and she was never charged. My co-workers referred to it as a "Spenaard County divorce" and said they happen all the time there.

It breaks my heart that this is among a precious few videos about this with a woman speaking on it with objectivity.. A _man_ is is 'too privileged' and there for forbbiden to have an opion, _much_ less speak itn in the presence if of their brave and stunning betters.. so only another woman can even stand at the starting line to put herself in danger. The level of societal gas lighting we've reached is terrifying

1. “Being lighter on men” will not make things equal they’ll make them equally worse. 2. We don’t want “harsher” sentences on women we want women and men to have the same sentence for the same charges
