Or you can take the route that apparently a lot of commenters would of using your 1st amendment to record, your 5th amendment right to remain silent, let the cops respect your 4th amendment right by legally obtaining a warrant for the evidence you recorded of yourself breaking the law, then you can use your 7th amendment right to trial by jury. Do you see how using MORE of your rights isn't ideal? If you are standing in front of a judge and paying attorneys to argue all of this in court this is the LEAST practical way to enjoy your FREEDOM!!! There is no sense in not recording and not remaining silent about things that might incriminate you. You can do all those things and still de-escalate and be cool with the cop… your comment isn’t legal advice but it also isn’t good practical advice. The cops love this advice though. Came across your short, just wanted to share some quick thoughts as an LEO: My agency used to have a zero-tolerance policy for "super speeders," i.e., anyone going 20 mph over the limit on any state maintained highway. Any person going 20+ over would immediately be arrested under the reckless driving statute. No tickets, no warnings. It was really unfair because it didn't allow us to consider the full picture like tailgating, weaving, traffic density, and road conditions. Clearly, you weren’t being reckless; the roads were empty, dry, and you remained in control of your vehicle. Under our old policy, though, you’d have been arrested. Thankfully, after enough of us complained, the policy was dropped. That guy clearly has issues, he was trying to flex his authority, which I’ve always found disgusting. Believe it or not, most of us, at least the men and women I work with, hate writing traffic citations. I always say there are enough a**holes to give tickets to, so when I have the opportunity to cut someone a break, I do it. 100% of the time. We all do stupid things. It's should be our job as LEOs to TEACH our community, not to turn their lives upside down. And I will die on that hill. It's not hard to determine if someone is genuinely being reckless or just having a lapse in judgment. Unfortunately, not all of us are good at making that call.

I’m not telling people to do anything other than being situationally aware. If you can’t understand that this cop was 100% justified to arrest me and recording him doing so had NO value to me. Had I NOT been speeding and knew full well he was incorrect, then yes, keep recording. I was wrong and it was on me to talk my way out of cuffs, your comment “they can have bad days too” is spot on, when people are having bad days AND can put you in jail, you better dial up your people skills. @@MotorsportCreative actually had I been arrested it was my video evidence of myself committing a crime against my word. Recording the arrest wouldn’t have helped prove my innocence, it would have given them access via warrant to prove my guilt. Always record is the worst advice ever because situational awareness should ALWAYS guide your decision making, not rules created by people who have seen a handful of bad police interaction videos on KZbin. It lacks a greater understanding and context of how you and your actions can contribute to NOT getting arrested for crimes you have committed and just go home instead. Talking yourself into handcuffs is certainly a thing and actions speak louder than words. Continuing to record can be perceived as being a nuisance and it’s ill advised to be a perceived as an annoying nuisance to the person who can arrest you at the moment.

Yeah it was strange. I also think letting someone you just told that they are under arrest and going to jail put distance on you is not tactically sound. Had I been a bad actor who was armed, I would have had all kinds of time to pull a weapon. Typically speaking I would think a cop who informs someone they are under arrest would do so as they were cuffing and controlling their body movements to prevent potential dangerous escalation.

I have a little experience in law enforcement in the military. That cop was just pinging you to get your reaction. He thought you would be an ass and maybe take off. When you remained respectful you put your self in the best possible situation for the best possible outcome. You are absolutely correct in following your instinct to deescalate the situation any way you could. That cop is a small town cop usually board out of their skull in between responding to kids shoplifting bubblegum. You were respectful and he in the end respected you back. You were honest at the outset and the cop also knew that too. He was probably surprised to see someone taking responsibility for what they had done and was more or less throwing themselves on their own sword being humble and the cop realized taking you to jail was more work than was necessary and no public safety interest would be served.

This is crazy,,,,, I'm from California, i ride a FXR Harley, back in 2001 in August, i was on I-40 passing Holbrook AZ on my way to Grants New Mexico at around 2am,,,,, i had locked my throttle at 74mph...... i was moving right along in the slow lane, , when all of a sudden i passed a State Trooper vehicle that was on the center divide, with all his lights off..... He then began to give chase (i guess you can call it that ). he entered the highway behind me, with lights/siren on but he was in the fast lane.... i didn't really think it was for me, i figured he was called to an emergency, i began to approach 2 semi-trucks ahead of me, so i unlocked my throttle, began slowing down, one of the semi-truck switched lanes from the slow lane to the fast lane, i thought it was weird that he was passing the other truck, at the same time that the trooper had been gaining on us on the fast lane.... i thought to myself = "THIS TRUCKER IS CRAZY, HES BLOCKING THE TROOPER,, HE'S GOING TO BE IN TROUBLE FOR INTERFEERING WITH POLICE BUSINESS...." THEN ---- i started slowing down because i was gaining on the semi-truck ahead,, ( I'm used to in California, you move out of the way, highway Patrol will fly by you to get to his emergency....) As we came to a stop, i maintained my lane position, thinking the emergency is in front of the Truck ,, not realizing i was about to be shocked.!!!!! i realized we ALL slowed down to a crawl.......... the truckers were blocking the road, TO STOP ME.... and i wasn't even running... trooper was in the fast lane , i was in slow lane The Trooper turned his siren off, and over his PA system, he instructed me to pull to the shoulder, and throw my keys on the ground... (i was so confused)... i followed his commands, he pulled behind me lights still on, he gave the truckers each a wave, and thumbs up, they shifted in gear , and went on their way..... The trooper was not happy, said he clocked me at 75mph, and the speed limit was 55mph in that corridor... i told him i was positive it was 75mph, because i saw the sign and made sure to lock my throttle at 74mph or as close as possible to it to avoid any problems........ He said that the speed limit dropped, and the new posted speed limit sign was approximately 20ft from where he was parked .... i told him i did NOT see that sign, or else i would have slowed down................ Needless to say, i was arrested for criminal speeding, on a Saturday 2am,,, the Trooper said he was doing me a favor and allowing me to DRIVE MYSELF to jail, to avoid impound fees. i was in jail till Tuesday, said they had to run my name and background, and wouldn't release me until i was cleared. I was clean, and i was released.... i believe they have speed traps on that I-40,,, easy money.... i haven't ridden thru since then, and never want to ride thru their ever again.... NO THANKS.....!!!!!! They can keep HOLBROOK, AZ all themselves..... Well my reasoning prevented me from having to argue my rights to a judge so....... Everyone is free to do as they please but getting to argue in front of a judge shouldn't be viewed as the pinnacle of victory, being free to go home should be. This cop could have thrown criminal speeding charges on me AND proved it with the video I filmed of myself doing it after legally obtaining a warrant for the evidence, then the recording of my arrest would have just been administrative and hardly a viable defense that the cop was wrong for doing so. Maybe if I put up a fight like an idiot I could have tried to goad the officer into doing something wrong on camera OR I could have just picked up additional resisting arrest charges.

Overall I appreciate your attitude and response. However, I don’t know where the myth of “you should never panic brake” comes from. You should always brake (safely) if you are speeding in front of or when coming up on cop. Especially when they turn around to gauge your exact speed like in this scenario, they will not be able to prove you were speeding. If you are approaching and they have a radar it will throw off their reading. Braking is not somehow a license for them to give you a ticket or an admission of guilt. You would have saved yourself this whole interaction by simply throwing out this illogical mindset of trying to “play it cool.”

I found your video through a auditor. I’m drawn to a statement that you made about the stop. That was something to the effect that you found it of no value to keep your camera recording. Two things any aspect of your rights can’t be used to bring a crime against you. Good on you for genuinely trying to be a good human. Be careful taking that too far and giving up your own rights and safety. Recording your encounters with state officials that have the power and authority to arrest you or worse is the smart move and doesn't require putting anything in anyone's face nor proclaiming the knowledge one's rights...it's just something you quietly do for your own protection. There are *plenty* of cases of officers performing unwarranted searches of vehicles during traffic stops and seizing valuable property under civil forfeiture laws, for example. I find it interesting that you recognize the officer's egotistical and overly-aggressive approach which caused you to be overly concerned about using a "de-escalation" strategy and worried about triggering the officer with recording, but at the same time fail to understand why some people use the term 'bootlicker'. Clearly you aren't, but it isn't your job to deescalate anything, particularly when there isn't anything to deescalate in the first place. Of course it would be dumb to antagonize officers doing their job but clearly there's something wrong when normal citizens doing normal things must live in fear of the state taking their property or freedom on a whim. See the problem is, I WAS speeding so him being good or bad was irrelevant. If he wanted to arrest me, he could. He could have also seized my GoPros as evidence and obtained a warrant for the footage which would have made my defense nearly impossible. If turning my cameras off had ANY impact on the officers decision to NOT arrest me for criminal speed, then turning the cameras off was undeniably the right thing to do. This idea that cops “shouldn’t” be annoyed by people recording them is so disconnected from human behavior I don’t know where to begin. People are people and most people are very annoyed by people putting cameras in their face while they are tying to work and cops are CONSTANTLY being armchair quarterbacked by everyone and it HAS to be exhausting.

The key is situational awareness, you can talk to the cops without self incrimination if you slow down a bit and are intentional with your communication. It's why I stumbled when I said "I've been coming from Boulder", I knew I wanted to small talk, but my nerves also got in the way a little bit which I am sure the officer felt as well. Several times I said "I did not know that, I am sorry" because it was a way to apologize without acknowledging intentional wrongdoing. Just gotta try your best, especially when you are smart enough to know you did something wrong.

I also knew I wouldn’t resist. So with all of these facts combined with the fact that there are 20 million police encounters a year in the US and 99.99999% of them are completely justified and uneventful, I had odds in my favor understanding that being arrested isn’t breaking the rules. Now on the flip side, knowing all of this. I also knew I was going to do everything in my power to use my people skills to change the course of those actions. Turning off cameras was a strategy that I used and ultimately, it worked. Again, this just one play in a playbook of how to interact with police and shouldn’t be dismissed. Situational awareness is critical.

The other thing is, if a police car does any maneuver near you, then immediately pull off the road as safely as you can. If they pull out from the median or flip around behind you, then you know you’re getting pulled over. There’s no point in running or “playing it cool.” You know you’re getting pulled over. There are 20 million traffic stops per year but everyone sees a few videos and assumes cops are just out fighting everyone. Statistically it’s just not accurate. Again, I WAS IN THE WRONG. From a legal standpoint, if I got arrested the cop would have seized my GoPro, obtained a warrant for the footage, then the video of my arrest would have been absolutely useless unless he was the 1% of interactions that included force. That 1% drops dramatically when you as the citizen don’t physically resist, which I wouldn’t do because I’m not stupid. So I will take my 99%+ odds that filming my passive arrest after committing a crime that I accidentally videotaped all of the evidence for wouldn’t have been very smart at all. This is the root of the problem is people seeing the statistical anomalies on social media then treating it as if it’s the majority. In this instance, the cop had every right to arrest me and would have obtained a search warrant for my GoPro's. That is VERY untrue, cops have a TON of discretion and truth be told, they can arrest you for almost anything, it would be up to the prosecution to determine if it was worthy of pursing the charges. If you have a poor attitude, it can absolutely change the progression of the encounter. Litigating your constitutional rights on the side of the road is NOT how it works, judges are who make that determination and your goal is to NOT have to see a judge in the first place. @@jessegardner33 then you will fit in well with all of the other people in jail who put their pride ahead of their freedom to berate an officer who could care less what you have to say and will just toss a couple additional charges on you to fight. I am proud to be on this side of the legal system being called a bootlicker by those who don’t get it. You have the right to use your words, but you also have the right to remain silent. It’s a fork in the road and from the sounds of it, you might want to look more into the silent option.

I got arrested two months after my dad died. Was sitting watching the cars on the highway from a visitors area with a friend. The cops were searching the area because someone stole a lawnmower from Lowe’s. My tag was dead and that was what caught his eye. I knew from the second I saw his lights I was going to jail. I had xans, some roachs, and a tiny amount of X. Told the girl with me to just say she didn’t really know me. Cop smelled weed, pulled us out the car. Found it all in pockets where I put it, to have it on my person (no sense in both of us getting in trouble). I was nice the whole time, polite and respectful. X is a felony so I knew I was in deep. On the way to the jailhouse me and the cop started talking, and I was just honest. My hero died in my arms, I watched the strongest man I know turn into a walking skeleton. He didn’t charge me for it. Just two small misdemeanors

As a law enforcement officer in Phoenix, and I used to be a Navajo County Sheriff's Deputy in Holbrook before moving down to Phoenix, in my opinion there was better/other ways to handle that on the troopers side. When he said you were "under arrest" technically speaking you were under arrest for criminal speed, but its officer discretion if he wants to take you in for criminal speed or just write you a criminal citation (which it seems like he did neither and just wrote you a civil citation). In my personal opinion you did great and didn't do anything to escalate the situation nor did you do anything to disrespect the trooper, which i respect as a LEO. In the world of traffic stops and law enforcement in general, respect should go both ways and it goes a long way, if you respect the officer/trooper/deputy, they will more than likely respect you. That whole area is full of nasty speed trap kinda areas. You'll be on something that's 65 then drops to 35 and sometimes down to 25 through the towns off the highways. Not always much warning either until you're past the signs and realize. Otw into new Mexico there's a bridge that drops right as you go over it and its so easy to miss if you're focused on the bridge or traffic.
