It's probably a misdemeanor only because Utah likely doesn't have a summary offense class. It's probably like an M4 or something. If they really wanted to hammer it home, they could have hit him with false imprisonment, which would be significantly worse for him. Technically, they could have hit him with battery. Assault is when you give someone reason to believe that you're going to attack them, battery is when you put hands on them; that's why assault & battery come as a package usually, and it's an upgrade from simple assault. Then you can have aggravating factors like the use of a weapon or continuing to attack someone on the ground where you might just end up with an attempted murder charge. Heh...I've spent a fair bit of time in court, usually with a PD, which means that largely you go in and they go "okay, so what's your defense(?)" and then they zhush it up for you. So far, so good; as you may be able to tell by the fact that I'm free.

I cycle a lot to save gas, but I'm like a casual video gamer. Going slow and calmy enjoying the adventure. And I swear there's so many try-hards out there who are fully decked out in their bike outfits, and I've watched a LOT of them blow straight through stop signs. I'll be going 15 mph on a residential street, and they'll come zooming past me going 25+ straight through stop signs. I've also seen them straight up merge and cut lanes without ever looking behind them. Like jesus man. I bike to save money and get exercise. I don't got a death wise. Goddamn crazy ass people out there on the roads these days. And I'm also the cyclist that if I see another oncoming rider, I'll pull to the side and just chill and let them pass. Or if I'm on a sidewalk and passing a pedestrian, I get off and walk past. It's not a race, lol.

I had a guy ride his bike towards me in my lane. Attempts to not hit him failed. I'm pretty sure it was deliberate. He was ok but did try to sue me, but luckily in Mississippi, people on bikes are required to follow the same laws as cars, so he was automatically responsible for the accident because he was in the wrong lane. Bikes make me nervous.

What "damages"? There was no financial loss, no injury of any kind, just some wasted time and inconvenience. At most it sounds like maybe the kid had to take a couple of hours out of his schedule to go talk to the DA and get things dismissed, and that's it. *There's nothing to sue for here to begin with.* On top of that, there was never any court case (because it was dropped) so there's nothing "on record" as a result of this anyway.

Great video! I want to give you the perspective of an avid cyclist. You’re 100% right, the entitlement of that Karen was both absurd, and stereotypically ludicrous. For the record, 6 feet of distance between a car and a cyclist, for either one of us passing one another, is perfectly fine! I live in New York City, so 99% of my writing is here. And sometimes you’re lucky to get three or 4 feet of distance. And as long as everybody’s observant, that is more than fine. I’m glad that Cyclist got the ticket and got the conviction, and I’m also very happy to read the update in your description saying that the young motorist had the charges dismissed. Also, another observation. The Cyclist was very lucky that he didn’t get himself handcuffed and arrested for getting in the cop’s face, and not respecting the authority of the officer when he arrived on the scene. One more thing. In my opinion, the way that Utah policeman handled that, was a master class in Law enforcement de-escalation. Anyway, great video thanks for posting it!

gary didn't receive harsh enough punishment. He should have been arrested for assault and battery and false imprisonment and falsifying a police report. Nothing the cop said did anything to convince gary he was completely in the wrong. He only backpeddled when he realized he was getting his own ticket. He left that whole interaction thinking he was victimized by Pierce and the cop.

This is relative law for one of the many jobs I've had where knowing law terms and implications of them to your actions is critical. So I know the difference, especially since in that line of work, illegal detainment will lose you your job.

Dashcams are so freaking worth it. They can prove you’re not at fault for traffic accidents, situations like this, and even if the police try to pin something on you. Definitely worth getting one. My car came with build in ones, front and back view and I can turn off audio so no one has to hear my gawd awful car singing haha

I used to work in loss prevention, and it’s amazing how often people try to walk back their illegal activity when they get caught. We stop someone on their way out the door, bring them back to the office, explain that we need to call the police over the $300+ of stolen merchandise they tried to leave with and… “can’t I just go pay for it?” Nah dude, you committed a misdemeanor. Sit here and wait for the cops and they’ll decide if you can pay your way out of this one. You can’t just apologize your criminal activity away.

At 22, I'm certain I would have kirked out and caught a case. I do not enjoy being controlled in any manner, so a situation like this could be my undoing at that age. Disorderly? That was straight up the definition of false imprisonment, assault, AND battery. That old man should have been cuffed up and taken away. That kid should have NOT been given a citation at all as the officer didn't witness and there was no obvious damage or injured party. I can call and say Gary is selling crack all day, would he be cited or arrested every time based on my word? With the way this was handled by that cop, I could call and make crap up on anyone without a problem, which is not at all how it works. Kid should sue Gary, AND the PD.

He didn't charge the old man properly, WROTE THE KID A TICKET based on 0 evidence, when the kid has the evidence proving his innocence ON SCENE, which means he (the kid) had to waste HIS time to prove the old mans hearsay wrong to the DA for it to be dismissed, not the officer. After the citation is written the cop has no more say in what happens. The officer was 100% in the wrong on BOTH sides here. Favor? Thats laughable.

Because not every absolute violation of law must be charged and prosecuted. And you don’t want it that way. If we all would be charged for every technical violation of a statute, we would all be in jail. Example - Driving: if you adhere to the absolute of the law, most would never get a mile down the road without getting arrested for something. 1 mph over speed limit; following too close, not an absolute perfect cessation of motion with a stop, left turn (judged by an officer) to be just a bit too close to an oncoming veh, impeding traffic because your under the speed limit…just for a start!

@ you are correct on the Vigilante angle. Depending on state law wordings, the biker could be “unlawful detaining” or “false imprisoning. However, bottom line is he is a cranky old, being self-entitling (and over-argument), and stepping over a line. A D.C. charge more than adequately covers this. At least in Wisconsin, I would have gotten a good talking to by my Lt, the DA, and/or maybe a Judge if I would have tried to escalate this (…based, of course, on ONLY what we see in the videos…) to more severe charges. We would refer that as “piling it on.” The litigation akin to trying to swat a fly with a hammer.

Most of them are MAGA and want Trump so they can say and do anything they want with no consequences while everyone not MAGA have limited speech, religious rights, the right to vote, etc. and get serious consequences simply for being alive in the USA and not MAGA.

That cop is awesome! So calm and giving good explanations and correcting the guys claims which were all supposition and biased opinion. Peacock needs to take a chill pill, digest the advice the officer gave him and be a better human in the future. Geeze Gary- Lose the crankiness, dont be a spin doctor and stop being a bully. Kudos to this very calm and decent young man for being a bigger man than Gary could ever be!

BS like this is why they had to heavily change biking laws in my county. They were taking over streets by riding up to 6 wide, not allowing cars to pass, constantly calling 911, and threatening drivers like that. The changes made them disappear within a month to ride in another county after they got hit with ever-increasing fines and eventually jailtime.

It isn't anywhere near that bad here, but there's a bunch of hills and it's pretty common to see cyclists riding in traffic up the hill. They'll go like 3mph tops holding up traffic when there's a sidewalk that they're legally permitted to use within literally feet of the road.

Bike laws might as well not exist where I live (semi-rural PNW). Bicyclists do whatever they want without consequences because the police don't care enough to ticket them. I've nearly hit several blowing red lights and stop signs without even pretending to look and been cussed out because I didn't give them a 'car length' of space (not the law).

@@CassandraY That was the catalyst for change where I live. They started to get way too comfortable with acting like there were no rules and could get away with whatever they wanted to do because the previous laws had no real bite. The final straw was a mob of 20+ bikers that went after a car that dared pass them while they illegally took up the whole road.

I hope he sues. He's right that without the video footage he could have ended up in jail. That's not okay. This cyclist guy needs to pay just for that.

@@WoozyPolarBear uhm no? Every car will open when the internal handle is used unless there is a child safety lock (only on rear doors). It is a standard safety feature on cars.

10:12 The cop is saying he has to give the teen a ticket on the account of the cyclist and that it may or may not be discarded by the dashcam footage (it should). He's saying however that Karen's ticket is on the ground of the evidence the teen presented to him, the teen didn't press charges, the cop gave a citation on is own behalf because of disorderly conduct.

I think the cop was just trying to get the Karen cyclist to chill tf out and tell him he's getting a ticket even though he hasn't actually seen the dash cam footage yet. But I did see someone commented the ticker was dropped so doesn't matter either way

The kid is also super polite and calm. He didn't lose his cool like the cyclist. The kids' parents raised him well
