Your assessment is partially correct because it is incomplete. If you ask people in GC backlog for more than a decade, they will tell you that they may not want the GC, if you can alleviate their basic issues which is more to do with fairness. 1. Hassle of leaving the country to renew the work permit. Particularly so during and after the pandemic, a slot needs a wait time of more than a year. 2. Children going out of status when they are 21 years of age. Compounding these basic requirements are: 1. Difficulties in changing jobs. 2. Discriminatory regulations during the pandemic when movement in and out of the country was restricted only for work permit holders. Emergencies forced many work permit holders to spend days in nightmares. The solution to this is, just to provide a modified EAD after a particular period say 10 years and let the GC take its own course. If they have come legally and contributed to the US economy, be fair to them. You can retain rules like the worker should be in a job to be in the US etc....

I am completely agree with you. Suggestions you have provided are inline with Professor that propose something for that Senator don’t have to squeeze system much. 1. After 5yrs of I140 approval, there should be EAD and employee free to travel, stamp will be valid till green card comes. Free to switch Job without making any change at Petitions and GC timeline 2. Non Citizen Child of this category people will have extended rights to stay and work in USA. Action is must from our side. We need to create a platform or community where we can have all H1B holders together. Lets do something concrete and make things done.

The main problem in H1B is to vacate the country in 60 days after layoffs. Forget about preparing, that is very less time to even get interviews, get hired, visa transferred and start role in new company. It creates unwanted stress and uncertainty. Also have to think so many times before doing any investment in US like a home. Yes home is not an investment, but even to get that, you need to have some job security. Best would be to come up like providing EAD for atleast those with I140 approved so that this axe always doesn't hang on top of their head. Advance parole would help with travel related issues.

I came in 2016. My PERM is in process. I am sure I might not get a GC, but one thing baffles me is restrictions around H1-B. I can not start a business, I can not monetize through youtube or social media. I can not travel with ease. And every time I travel outside, I need to get my visa stamped 😑. I don't mind about the G.C. I am worried about restrictions around H1-B. Though it is not true we are slaves. But, atleast I fell this is modern day slavery for the corporate companies😌

It's valid argument, when you are sitting on other side, but maybe govt can help or give choice to withdraw their green card application and leave the country. SSN tax and other that we wont even get to use in life time, people can relocate home country and start their new life from fresh. Put country cap for 140 Approval if not H1B, so ppl can leave after 6 years of work and take back their tax contribution if they can't live here or chose to not live here.

I would say - making a max wait time cap for the employment based GC to 8-10 years would be a better solution. Ex - if the max wait time is 8-10 years then those waiting will have a clear expectation they we will be getting it in 8-10 years and also most of the kids of them would be covered before they turn 21.

Diversity is an argument......but its not a great argument. Because the same congressmen and senators who defend to uphold diversity in immigration programs, would immediately flip when illegal immgrants are concerned. There are 1 million legal immigrants waiting and probably wait whole lifetime in the back log. Compare that to 10-15 million illegals waiting to be legalized in US. So lets extrapolate the same fairness and diversity criteria to illegal side of affairs as well. Why only Latinos and Spanish speaking population mostly from south of US be the largest beneficiaries of any legalization process. For sake of diversity lets have a quota system and per country cap in legalization of illegals as well. If any sort of immigration that is threat to diversity is more likely to be illegal immigrants than the legal immigrants, I mean that is margin of 15 times over. I know diversity is the stated objective of US immigration, then how come in amnesty laws passed in past 40-50 years and there have been quite a few, legalization has happend sans diversity. I point that, not as a obvious flaw in the argument, rather to point out, as an immigrant its not your business to say what should be the immgration policy of US should be. Whether its fair or unfair or inbetween its just not your place to cry foul.

Country cap is an absurd ! 1) I have seen kids who came to us around 7-8 months have been decades still in h4 . How are DACA kids different! They have all the privileges! So legal dreamer kids are forced on to green card backlog again. After staying in this country for they life ! Which country they belong to 2) this is employment high skilled , ideally it shouldn’t be country based Highest skilled person should be encouraged . Put some rules for highest skills I am fine with. They were several if they think they can fix it 1) exclude family members from backlog 2) we have lot of illegal immigrants coming into the country working for lively hood ! Again we have go thru the process get your i140 etc. in the mean time ,priority date comes and goes.( they can fix it , if they really want) dollars 💵 involved 4) one time eb3 priority dates move . Sometimes eb2 priority. This line jumping process there is fees involved it . Dollars 💵 involved 4) I don’t want to talk about diversity visa ! Bottom line , if they want to fix they can do it! I honestly don’t care about the green card anymore. It’s no longer that appealing. India has far outpace US in terms of growth in the past few years. The one thing I would have like US immigration to fix is make it flexible for ppl from backlogged countries who would probably never get their green card to ease their travel status so we can move freely outside the country. I missed very important events, even my wife’s grandmothers funeral due to no visa slots available.

Why should they put a limit on F1 visas, students are clearly saying their intention is to study and come back. Now they cannot ask for GC like they are entitled to it. For US colleges, F1 is way to spread knowledge to global students and increase revenue. Not a GC providing system. The last category is quite disgusting like “pulling up the drawbridge” as they say in Britain. The solutions you discussed are from the POV of the government and legislation. From the POV of the immigrants, the best solution is the EB1 path as used by a couple of my friends. On a different note, The US immigration system is so bad that my girlfriend and I are leaning towards living in England permanently rather than go through the process to live in the US. She went through the process (after having moved as a child from India) and now living in Britain.

Many Indian people who moved to the US for education in 2015 mocked my friend, who decided to study in a top Canadian university (UofT). He was called names and tagged a loser because he did not study in the US. Fast forward to today - he is now well settled in Canada with a Canadian passport, a beautiful house with $350k in equity, an Audi worth $100k, small debt, and a job that pays above $200k. And most of those self-proclaimed ‘succesful’ Indians who studied in the US are either back in India because they were laid off and could not find a job or oh H1B with constant fear of losing a job, or in Canada on a PR with no certainty on their future and a hefty pay cut of 30%. Their American dream was short-lived, whereas my friend travels the world for fun with his strong passport.

Indian immigration system is harder in some ways compared to US. 1) OCI cards of foreign spouses get cancelled if divorce happens but US doesn't cancel permanent green card through marriage in the event of divorce. 2) India does not allow dual citizenship while US does. 3) If my knowledge if correct, India doesn't have a permanent residency through job. It only gives temporary residency through investment, which is much more in amount than US requires for investment green card.

as I said in the video, there is no quota on temporary visas like student visa, h1b, tourist visas etc. When this quota was made, the idea was to maintain diversity and nobody thought so many from one country would choke up the system. The backlog issue was not there for a very long time. Only 20 years later the backlog started to develop.

If you’re talking about EB1C, then I understand your argument. But PHD or not, EB1A is an extremely high bar to clear. As an EB1A GC holder, without PHD, I absolutely do not agree with that statement. If you haven’t been through that journey and don’t understand USCIS policy manual or how the law around criteria is written, then it is a very ignorant statement to make. Don’t get me wrong, I like your content, and I agree with your assessment on this topic.

With country caps, why not they make it as first come first serve for EB GCs. EB1C is nicely exploited by consulting companies. Also why not country cap on Illegal Immigrants? To maintain diversity, they have separate diversity categories. Rules needs to be modified along with time. Anyway it’s their country and there rules. Now talent is going where they have freedom and people are realizing the backlog. Time will change and then this country will realize. Nothing stays forever.

I suggest one solution, which might be too far fetched, but still can help many Indians get Green Cards. Even if India is a large country, not people from every state in India immigrate equally. The numbers are much higher for states like Andhra Pradesh and Telangana. If the US government decides to put a cap of 7% for 'every state' in India (depending on the Indian state you were born/your domicile) instead of 7% for the entire India, it would be much more helpful to people from Indian states who immigrate much less than the rest of India, for example the northeast. Since I am from the northeast India myself, I will strongly advocate this, as there are very few people from places like Shillong and Guwahati, here in the US, let alone other places of the northeast.

If America wants to remain competitive in the coming decades and maintain its edge, it should make radical changes to the immigrations system and get more skilled immigrants with advanced degrees in STEM fields. Currently, US gives a tiny fraction of green cards to people that are highly skilled, highly employable, and with advanced degrees. A vast majority of the green cards go to family-based categories. Most of them come to US as dependents and burden the welfare system here or engage in low-skill and low paying jobs. You can see the effects of the failed immigration policies already as US is losing its competitive advantage slowly. While US brings low skill immigrants, all those high skilled aspirants sitting in decades long backlog now can immigrate to other countries and help those countries grow. Nonetheless, these effects are not immediate. Usually, it takes a decade or two or even a generation to really see the effects of good or bad policies. Hopefully, American law makers will show some forethought and mettle and refine their broken immigration system.

The US already has decent STEM graduates and their salaries has not gone up because of these H1b visas. The US should just stop issuing new visas for the next 10 years and work to clear the backlog

The blogger here has failed to include one other major trend with an even more powerful voice: people want Green Card employment quotas to be moved over to family based immigrants. The reason this demand is much more powerful than H1B people’s demands are because it is the US CITIZENS who are lobbying to bring their family members here and are once again stuck in a per country quota loop for siblings especially. So desi Indians must understand that UC Citizens of Indian origin’s first lobby power goes to pressure organizations that want the Congress to bring reforms to eliminate quotas for siblings and adult children migration. I am a US Citizen of Indian origin but I lobby mostly for family based immigration. So, be careful about who is doing what in the US before betting on a life in the US. As the US slows down and turns increasingly protectionist, employment based immigration controls will only go up and not down. Why? As the vlogger mentions, US Citizens are getting affected and they are the voters. Expecting US now to be like in the early 2000s when it was liberal with immigration is asking for trouble. Once again lobbies such as Latino Americans have far greater lobbying power due to historical numbers and North American Free Trade Act than Indian Americans overall. So relying on Indian Americans to lobby for H1B-GreenCard changes is also fraught with risks. Indians are better off now running businesses, doing work in their own countries after getting some exposure to US work and business standards. But long term family life and money making in the US is no longer a viable option for Indians except the mavericks who want to succeed, come what may.

the good news is that nobody is forced to watch my videos. People keep asking for this content so I make it once in a while. Roughly only one in ten videos is on immigration related topics. No more. I have a full time job, so I do not make much content. Also, I do not ask people to like, share, subscribe to my channel like most youtubers do.

You are Not 100 percent correct. Im an example for coming here in 1990s and even back then it wasn't easy to get greencard faster. It took me 7 years for I140 approval alone.
