I have a question that I think could benefit a lot of viewers. For the K1 visa, you will have to have met in person within 2 years of filing. Could the foreign person come visit the United States citizen? Or does the US citizen have to go to the foreign fiance's country for the visit? Even more importantly, what if the foreign-born fiance gets denied for a visitor visa to come to the United States for the visit? Would a visitor Visa denial make getting a K1 Visa later difficult?

The location of the where the couple meets, has no effect on the 2 year rule. As long as they met in person it counts. Having said that, in demonstrating "bona fides", the location of meetings, the quality of the time spent together, who is met during the meetings, the quantity of the time spent together is relevant. If a beneficiary applies for any visa and is caught in fraud then they will make further visa applications difficult. If an applicant is totally honest, and still denied, the effects would be based on the reason for denial.

I filed usics petition for fiance for Philippines April 2023 received confirmation letter may 5 2023 it been 8 months no word from usics in California .

As most similar cases are taking 15 months, its very premature to worry that you have no word in only half that time.

Expect about 12 months just for I-129F.That's what it took for me and also Philippines but that doesn't matter because they process it in California.

Hello i have a question , i have sent my I-129F form in october and it got rejected for a missing fee and after that i have resubmitted it in January and the fees got withdrawn from my bank account but they didnt update me back since that time at January is it normal or they should get back to me soon any idea of what is going on?

Sounds like a rookie mistake, perhaps followed by more, compounding the issue. One expects to get a receipt from USCIS within 3 to 5 weeks of sumitting an application. If your application gets rejected again, that is nature's way of teaching you need to work with a professional who knows what he is doing.

For sure the vast majority are. As USCIS is still publishing process times for K1's at the other centers, my best guess is that either they still get some, or they still have a backlog.

Yes you are correct. All K-1 visa petitions are processed at the California service center. Unless there is a criminal background of the petitioner then it’s forwarded to Vermont.

I do not know enough about your situation to have any opinion on whether or not you are likely to be denied. Back taxes are usually not an issue, unless the IRS has filed a lien against you. If that has happened then the lien is subtracted from your verified annual income for them to consider whether or not you are financially eligible to sponsor your fiancee.

It is possible to be granted a fiance visa without meeting. One must have good reasons why a meeting is impossible. With or without a meeting the underlying "bona fides" of the relationship are what counts to demonstrate eligibility. An in-person meeting and the evidence that can be generated during the meeting go a long way to show that your relationship is genuine, is sincere, not a sham to trick immigration.

Assuming all other eligibility requirements have been met, as you have met in person in October 2023 you are eligible for a fiance visa till the second anniversary of your meeting in October 2025. berry, in simple terms, you have two years from the most recent time you two have met to file for a k1 fiance visa. oct 2023 being the most recent time, you have until oct 2025 to file. if you two marry in their contry, then you will need to file a spousel visa and times will be different in processing.

My guess, is Nebraska, has less K1 cases to process, so their statistics are easily skewed.
