Sir kewal mein institution ki stage par baat kar raha hoon (preliminary issue before suit to be inquired) For example =mein suit file kiya on the face of record pe hi court ne bola it's time barred or we don't have jurisdiction kya yeh decree ho ga

Agar yeh decree huwa to res judicata bhi applicable hoga on further suit, lekin book mein likha hai ki on lack of jurisdiction or grounds of limitation pe res judicata applicable nhi hoga kyon ki these cannot be said that matter had been finally decided if not decided on merits

For example= declaration on question of limitation, jurisdiction, res judicata, maintainability of suit does not come within the ambit of decree because these are order which do not amount to decree because which determines only the plaintiff right to sue
