As someone who grew up near where DCS operates from (Tamborine), I can tell you first hand it's tough. There is very little market share if you want to open up a shop or garage, the operating costs are high, and so is the chance of failure. As such, it's a very tight community which looks after its own. We may not be perfect, but we work hard to survive. That being said, when someone steps out of line and puts all of us at risk, we tend to vote and operate with our conscience. My personal view is that suing a small KZbin channel for an honest review is stepping over the line, and I will support the KZbinr. I hate to see this come from my community. It just seems so unnecessary

Me sitting at home in Croatia watching Mr. Rossmann after years of not watching my KZbin subscriptions list just to end up emotionally invested in this that happening all the way around the world from either me or Louis. I have a hunch this is exactly the kind of publicity DCS never wanted to receive, and exactly the kind of publicity it deserved after the litigious actions undertaken. From the bottom of my heart, I want and need you to win this so that we as a whole can continue to have free speech and free access to objective information and not a world where a single thought and a single opinion is valid, and the corporations can do whatever they want. 0:45 Hi, Dutch urban planner here. As it happens I work with a nearby municipality and visit Haarlem weekly for meetings, so the adress struck me as odd and I looked it up. The Dutch DCS system adress is questionable: Donkere Spaarne 42 Haarlem is a residential home and the planning permisions (bestemmingsplan) forbid running a business including all forms of retail from there. If they are located there, we would enforce against it. Their phone number starts with 0970, which is a corporate replacement for a mobile phone number; There is no landline in the Haarlem region. Our phone computer logs that if you call DCS Netherlands, it just connects to a computer located in Belgium. Didn't wait for a pickup or reply, but based on this information I am confident calling the Dutch adress a fake.

I discovered this issue on a US channel (Will Power) last night, where he discussed the case briefly and then did some testing and a tear down of the battery. While the testing, on a brand new battery not subjected to longer term stresses, seemed okay, the tear down inspection was an eye opener. I’d recommend people go take a look. I shake my head at this whole litigation attempt. Instead of learning of their shortcomings from genuine product reviews and either amending their products (or how they should be used in this case,) they have chosen to destroy their reputation and probably their business model. This now has an international audience watching and waiting, and no prizes for who they hope wins. As an Australian who will probably never have a need for a lithium deep cycle battery, here I am, on KZbin that discovered this kerfuffle via an American content producer. I know plenty of off-roaders and I have told them about this lawsuit. How much damage has DCS done to their business. Even if they win, they still lose.

It astounding that DCS are continuing with this litigation given the damage it is causing to their reputation. You would think at some point senior management would see that this is costing more in both reputation and revenue than what they could ever receive in compensation by suing Stephen Fischer. I might have purchased it despite your results, that I found 30% better than the Led Acid installed in my EV. Unfortunately I find DCS’s behavior towards you and other testers results absolutely unacceptable, why I will refrain from purchasing their products, including my home battery (30 kWh), solely on business methodes. It's like you being held accountable if you yell something in a crowd at a sporting event, and others get riled up and smash a window for example, or start using obscene language etc. It seems the legal system invents ways of always being able to always have work to do, like some huge complex choreographed dance. Like if a programmer purposely embedded code that necessitated emergency callouts for repairs to critical software which costs big dollars, a system that is constantly in need of money being spent therefore keeping people employed, when in essence, they're creating their own work for themselves.

I am totally on your side, it's disgusting that your going through this just for being honest. If a company goes after people for honest reviews that show their products in a bad light then how can we trust the good reviews? A company behaving like this puts a huge red flag over them far worse than any negative reviews. They are just shooting themselves in the foot with this stunt. What they should have done is to take a good honest look at the batteries and think, how can we improve these do do what they should do.

Re your earlier video about the issues in the first place, any LiFePO4 kept in hot conditions will reduce in capacity. Automotive batteries in engine bays are starting banks plain and simple. Capacity is rarely a concern until it gets VERY low. If you have auxiliary uses you're best to out additional batteries in a more hospitable location for capacity uses. I've been running home made LiFePO4 packs in my fleet of vehicles for 4 or 5 years and I do them in a way that no company could warranty. To get best starting performance you MUST have direct connections to the cells. Therefore you get no overcharge and overdischarge protection. I use inexpensive active capacitor balance boards and enable with key in run position so only vehicle parasitic draw is a factor. Over that period I have lost a few cells in exactly two ways. 1 headlights left on, full discharge at high rate, balance board cannot keep up, weakest cell hits zero first, remaining cells pump current through weakest cell backwards which destroys it. In rare cases it can be two vs two. 2. Severe over charging. 18.7v alternator output on our boat killed 8 cells out of 16 in 4s4p configuration. What has never happened is a slow discharge from parasitic current killing cells. I've run many of my packs into the ground multiple times and they've always come up just fine. When discharged slowly with a balance board connected they go down evenly and when without they go down so slowly that the few mA of reverse current doesn't seem to harm them. Is capacity still 8Ah or 16Ah depending on the car? Probably not. Do I care? No. Is current dump ability still what it used to be or similar? Yes, and this is all that matters. I use headway 38120hp cells. I will be putting large capacity prismatic cells in two vehicles one being our 100 series landcruiser, but tge exact capacity will never matter as it will be huge overkill even at 25% of original. Something around 200Ah per side, probably. I'll set them up just like the small cells.

I can tell you from experience that there are the few companies that directly resort to litigation due to constructive criticism. IMO, the companies time/effort/money going to court is better going into developing the product instead. As a publicity standpoint, it raises far more negative response than the negative review itself. You will get through this!

I cannot understand why they would not have firstly reached out to you to point out why they take objection to your investigations, testing and published content, given a clear explanation of where (in their opinion) you went wrong and allowed you to correct it and move on. That’s how adulting is done. Hi Stefan and God bless you in defending yourself, your channel and your livelihood. This situation is ridiculous and sad. It is NOT Australian. Your channel is great, reliable and honest with real life applications and reviews. In fact it was your channel that inspired me to bite the bullet and buy a Li battery and the very same DCS battery that you had reviewed. I am sure I am not the only one to do so and DCS should be thankful not litigating. I wanted to buy a quality and reliability Li battery and preferably Australian made. I didn't want to buy Chinese or similar and I preferred local. I thought DCS was the way to go. Your reviews showed exactly what your experience has been when using the batteries as described by DCS and can't possibly be defamatory but is actually your reality. DCS had plenty of opportunity to rectify the situation and I can't understand why they didn't. From what I have seen on DCS FB, they may have defamed you but you didn't litigate them. I have had a similar experience with my battery prematurely failing within the warranty period and it wasn't used under bonnet. My claim has been rejected after less than 200 cycles. I have been told that I didn't use it enough. It sounds like your experience where you used the batteries in the outback too much. Unfortunately I believed what was stated on the Web site being a MINIMUM of 5,000 cycles and 6 times the service life of an AGM and do the job of 18 AGMs. My 2 AGMs under the bonnet are about 2 years older and performing well. I became a member due to your reviews of DCS batteries and some other. I cancelled because I couldn't afford to continue long-term. I have recently reactivated to support you. Hopefully this litigation will end in or before October. You have had 38,000 views in ONE DAY and a huge amount of support including around the world. I think this litigation will damage DCS. I hope that DCS will see a way forward and stop the action against you and fix any issues and honour warranties and become a great Aussie battery manufacturer as they could be. God bless.

As an older American I cannot even wrap my head around the concept of someone being sued for a comment that another person makes in a comments section of a video. I came across your defamation case via another channel so stopped by to give you my support. I have zero understanding of deep cycle battery technology so my opinions on that aspect of the company are irrelevant. However I have read numerous online reviews of the DCS batteries to gain enough insight to determine I wouldn’t consider buying any of their products based on product quality as well as their - alleged - treatment of customers who’ve had problems. I’m also of the opinion that even if they provided a top quality product I still wouldn’t purchase anything from them based on their law suit brought against you. I’m 100% behind the little guy when it comes to corporate bullying and intimidation so they’re never getting any of my business regardless of what products they’re offering. I have a feeling, that DCS is going to get a serious lesson in the Streisand effect which will likely be more harmful to them than any KZbin reviewer could ever be. So much so, I wouldn’t be surprised if the company completely tanks as more people find out about your legal battle. You are doing a great job, detailed honest comment is valauble. It is up to us as viewers to decide if any reviewer is credible and in line with our own values. the internet is the wild west, so everything is about the credibility and demonstrated values of the content creator. Regardless of what anyone posts, its important we all take in a variery of views, for that to happen we need content creators to have freedom to do what they do - as long as its done in good faith and without commercial interferance.

From the U.S.A. I became aware of this only today and posted comments for this one i will say only this yu are doing good and important work for the benefit of everyone .I wish you the best at the next hearing people like you are essential in informing the public on the quality of the products we buy .whether it be for the good or bad .I am 67 years old and retired long haul trucker of 45 years . and seniors are most vulnerable to this kind of issue .

Good luck with the case, it’s a shame companies like DCS think this is the correct course of action, as false reviews also open you up for legal action, it seems like with the current state of affairs content creators can’t win, so a win might just set a precedence and offer clarity in the future for all content creators. Once again good luck, let’s hope you come away with a win, and in turn a clear precedence that others can point to, to possibly stop others going after content makers.

Dear Stefan. I have never commented on your videos ever beforehand. Your site and your posts are nothing but useful, balanced and objective. You are someone who I have observed over many years, to make honest and nothing other than factual reviews of products. I have actually used your reviews to engage with vendors to discuss purchasing 4wd products to fit to my 4wd, and in doing so, to discuss pros and cons. In a constructive, factual manner leading to a purchase, or not. I have no need to purchase battery systems, and I have not seen the video(s) of concern here. It is of concern that such a person with your professionalism and high integrity is being challenged here. Such biases are not obvious in your content I have seen. You say it how it is, in a professional and courteous manner. For that, I thank you, and I wish more content producers were as professional as you.

I've been watching this unfold and also seen the support from some very big channels overseas. Great to see tbh. I can't even imagine this will be costing in terms of lost sales and goodwill when it could have been an opportunity to look at how the product can be improved. There's a lot of noise around this technology in so many industries/uses so the industry needs good news stories and not this sort of thing imo. Cheers.

Based on internet search of the company name, DCS appears to be a global multi-national company with employees working under the DCS name across the globe (judging by contact information for DCS posted on their own websites, DCS is active in at least a dozen countries). Whether that is relevant is up to the court to decide! Looking forward to updates, following closely!
