So I live in the desert and a big thing that isn’t being discussed here is Def driving through and destroying wildlife. I know the desert looks very barren but I promise it’s not. There are many protected species of animals and plants that are endangered and protected, you can’t walk a few feet without seeing something living. You can get an ENORMOUS ticket for touching a native tortoise at burning man so imagine carelessly driving through an ecosystem for god knows how long? And another think I want to mention- between cactuses, rocks and most importantly washes it is INCREDIBLY DANGEROUS to drive through unmarked desert. Google a desert wash, they can be 4 or 5 foot drops out of nowhere and that’s only what I’ve personally experienced and seen in person, I’m sure there’s worse. We ride and drive horses out here and we have to be very careful even on marked trails to protect the ecosystem and ourselves. What he did was both catastrophically damaging to the environment but I can’t stress how dangerous it was.

The thing Def is glossing over is, the rental in her name is more than just the cost. She's legally liable for it, like if she lets someone WITH AN EXPIRED LICENSE take the wheel and go cross country in the open desert, then let him post a video documenting that happening!!! Yeesh. She'll be lucky if the rental co doesn't see all this.

what tiana did when she missed work is actually the COMPANY POLICY for where my brother works. if someone feels sick they are TOLD to leave work and get a covid test and arent ALLOWED back at the job-site until their test results come back clean for covid. its just responsible not to spread disease around and its also for the companies BENEFIT not to get other employees sick and end up with even MORE call-outs for sick-leave.
@shyviolets2 жыл бұрын
Just because it's policy doesn't mean employers are happy about it. I was general manager of a restaurant and the owner was constantly trying to pressure me into getting employees to come in no matter what. Before COVID we were expected to work even if we were sick... but he'd never admit that if directly confronted. He'd conveniently "forget" things like how many days after a positive result someone would need to quarantine or act like he'd never said something. The sad thing is businesses can run with healthy employees or sick employees... businesses can't run when everyone needs to stay home. COVID was the final straw for me it was honestly disgusting we were serving food to families for gods sake...
@dainironjaw54252 жыл бұрын
Yeh getting sick should be a stay home. my boss told me it was up to me to find a replacement or go into work. I was a dishwasher for Swiss Chalet, she was the restaurant franchisee. I stayed home whenever I was sick, One I'm not getting other workers sick, Two I'm not possibly contaminating clean dishes or freshly cooked food because I'm in the atmosphere, she also wanted a sick note from the Doctor each time, and I'm like yeh not walking to hospital wait for hours to get a note saying I'm sick.

She accused him of being unprepared but she went on an work project wearing shorts and not researching what she needs? She’s an employee not a 5 year old child. I can get where both of you are coming from but def escalated the situation entirely with the lawyer ploy.. ( @mardelima1 ) if he brought those tips up I would have respected that more, but bringing in a ‘defamation’ case would be ineffective. you have to show beyond a reasonable doubt that you lost revenue from that statement and how it’s false which ultimately makes me agree ( @Adria Staley ) that it won’t go far..
@AdriaStaley2 жыл бұрын
@@mardelima1982 Maybe implication is enough and doesn’t require an name being said, however I do agree that I would have researched things too. Though the main thing is HE didn’t seem to research or prepare at all. I don’t know what her specific job was but I think it’s not unreasonable to think that a persons employer would have planned much much better. As far as the car goes he didn’t even take care to make sure the car didn’t get damaged. If the car was in her name with the rental company (which I’m guessing it was if he wasn’t licensed) it could potentially flag her in the system for the future. Even if he did pay her for it, it is incredibly irresponsible. Though if a court does actually take the case and it gets to discovery, all of these details will be found out but until then it’s just kinda up in the air as to who has the more credible story.

I've had too many times where people dismiss me for being younger or started infantilizing me. When I was a minor, it makes sense, but didn't make it any less suffocating to experience. Hence, I don't completely agree that lying about one's age makes them unsafe, it just makes them a bit shady.)

He didn’t even bother to Google what the event was . I’m also mystified how he can spend $4000 by renting a car and staying in a place that has no hotel or motel and no food. I will say I don't think most of this situation is her fault at all, but for anyone else reading, who may find themselves on a work trip without their own vehicle and lodging plans, ALWAYS DO YOUR OWN RESEARCH. You should never take a trip without a residential/hotel destination without understanding the risks involved. You don't need to pack anything you think you don't need, but google is your friend. Take the essentials always, when there is room, and also never rent a car that someone without a license will be driving. You could end up in a lot of trouble, or just footing a bill.

While def definitely doesn't have a case for defamation, the fact she doesn't mention his name is not enough on its own to negate the lawsuit. Defamation by implication is a thing, in fact it is what Johnny Depp won with as Amber Heard never mentioned his name in the op ed. If the person you're defaming can be clearly implicated they can still sue you. That being said, there's still no way Def would win for a ton of other reasons.

As hilarious as def-defamation-gate is as a concept, it’s in the same vein as that shitty game company trying to sue Jim Stephanie Stirling. The main problem is not that he’s ruining who he’s attempting to sue, it’s the mental health and stress aspect of openly harassing them into silence like this. And she doesn’t have the platform Stephanie does not to mention how she expects to afford fighting even the most outlandish of claims. What really fascinates me about the defamation case is that there IS NO CASE HERE. Defamation is extremely hard to prove even in the best of circumstances, and he has to prove that NOT ONLY what she said was untrue, but that she knew it was untrue, and spread with with what is referred to as "Actual malice" (which has nothing to do with being mean, it just means that it was spread with full knowledge of being false). The fact that she didn't even use his name in the video or even use ANY known identifiers of his online persona is the real sinker here. He's a public figure, which already makes this hard for him, but he essentially told on himself instead of doing the smart thing and shutting the fuck up and perhaps like. Reflecting. You know, like an adult is supposed to. Maybe even reaching out to her and getting a more fleshed out version of her side of the story rather the the abbreviated version on tiktok IDK man. So defamation is really, really hard to win in the US. In Britain, it's actually easier, but in America, it's really hard and the standard is really high. You have to prove that not only did she lie, not only did she intentionally say untrue things, but that they actually inflicted harm upon you, and even more than that, that they knowingly did this to cause this. The standard is extremely high. And if he took it to court, he'd lose and have to pay for the whole thing, because there's no way to show that her words were lies, and even if they were, that they caused any kind of material harm to him or his business, because his reputation is so ungodly negative by his own hand!

I'm not a lawyer either, but I'm pretty sure Dennis would not succeed in the defamation case anyway. The woman was not named and that was at least one of the reasons why the case didn't succeed, because people would not have known it was her had she not come forward. However, I'm very sorry to say that I tried to find this case to give a reference, but could not for the life of me find it and I can't remember the name of the band, only that it was one that I recognized as a household name.

There are some trips you can do on the fly and there are some you can't. Anything local you can easily get together and go but if it requires anything further than like 2 hours drive I would never go without full info. Burning Man is one of those trips you need some planning for even if you're local. Partying in a desert with no food or water = dehydration and heatstroke central. I do think both should've done some basic research, I never go on trips if I don't have basic information about what we're doing, but an employer is in charge of explaining some basic work based things about such a trip. She probably assumed there was water and food there and so did not get the water for that reason. (Yet again I blame both of them for not looking anything up individually). Neither him or her brought a cooler for food or water so I can see why she would be upset. I think she placed a lot of blind trust in him planning this work trip and he completely botched it. Which led to the whole problem. Regardless of it all though it's the employers job to fully brief and prepare an employee for such trips so her trust was technically in the right place, maybe not individually on a personality level but on a working level yes. Like what kind of employer doesn't even have a valid ID for such a trip??

About the Drivers License thing, as someone who just had to renew their CA drivers license, the DMV encourages you to get a Real ID rather then just renew, so that might have been what he was complaining about. You need Proof of ID and Proof of Address. You can even do EVERYTHING ONLINE NOW for the DMV to get your Real ID, thats what I did. He made excuses and drove ILLEGALLY because he was NOT on the Rental Agreement. Hope she consults an attorney immediately!! This is actually disgusting. You’re not allowed to do this to employees in the United States! There’s strict laws on this stuff here. Now, the murky part is him not directly telling it to a potential new employer, but it’s the internet. And, if she has applied places and didn’t get the job, well…HERE YA GO! He’s out of his ever-loving mind. She can sue for everything he’s got and probably win. This isn’t drama between 2 KZbinrs, it’s between an employer/employee ex. Unbelievable. This might break actual criminal laws, too, I’m unsure on that. Labor laws possibly. She needs to consult an attorney right away. Everything needs archived, too. I will archive the video of his to WaybackMachine for her, if someone can let her know. This isn’t a joke, future employers will see this and it will negatively affect her employability. And, no, it doesn’t go both ways. It’s the power imbalance and the law sees that. Employees are allowed to express their opinions about employers.

Also he broke the law the minute he had her rent the car for him then drove it like he stole it because he didn't give AF about the damages in HER NAME. All without a license. Breaking the law.
