Many individuals believe they can close that chapter of their lives after being released from federal prison. They envision a total return to normalcy. I know from experience that the reality is often different.
I know from experience that victims still awaiting restitution do not simply move on. Their demands and the Department of Justice's expectations follow long after the sentence ends.
This story of a physician who recently contacted me underscores the ongoing responsibilities and potential pitfalls awaiting those who believe they can ignore their financial obligations after federal prison.
This doctor, having served a sentence for a white-collar crime, returned home only to face the harsh realities imposed by the terms of his release. Despite his freedom, he remained under the watchful eye of the justice system, specifically his probation officer.
During a recent tax season, the physician received a substantial tax refund-$40,000. Instead of adhering to the conditions set forth in his judgment and commitment order, which required him to turn this money over to his probation officer, he decided to keep it. This decision was not only a breach of trust but also a direct violation of his probation. When the probation officer discovered this, the consequences were immediate and severe: a potential return to prison for at least one year for violating probation.
This case highlights a critical aspect of post-prison life for white-collar defendants: the necessity of fulfilling financial obligations to victims. Ignoring these responsibilities can lead to further legal trouble and more severe penalties. The Department of Justice and the victims affected by white-collar crimes are steadfast in their pursuit of justice and restitution. I can relate. My son came home from a long tour in Iraq, very early on. The Pentagon, Cheney, gw Bush, and Rumsfeld all said, "We didn't expect so many soldiers to survive". He and I both had to make a really big noise to get a piece of paper that said, "Congressional Order" on it, for him to get long over due care. And still had to fight every step of the way to get continuing care.

My local probation officer was a good man. I was sad when my probation was over and I couldn't speak with him anymore. On my last day, while in his office, he saw on his computer that I had been charged with violation. He went into the courtroom and got it removed. He was pissed.

@timjensen6968 Because he was submitting to the Court that I had successfully completed my probation and the Court violated me falsely on the final day. He knew that I was a target of corrupt people.

Once I got a Notice to Appear in Court via US Mail and when I called the Courthouse to confirm, they said I wasn't on the docket. When I went to court I asked a bailiff to check the list my name was hand written on the last page. Not in the computer.

My Federal Probation was like yours. I had one violation he talked to the judge for over 3 hours explaining everything that I had been through and everything that I had accomplished. Judge dismissed the violation. 1 year later he asked the same judge to terminate my supervised release and the Judge did. I see my former po every once in a while and we smile and knod.

@jamms992 I knew that there would be ethical issues for his job if we had conversations after the probation ended. "BIG church" harassed me while little church protected me. There was a Saturday night event that I wanted to attend, but if some guy I didn't know showed up, I could face violation. When I called the PO ahead of time for his advice he said, "There is no legal reason for you to not go to the little church play. But you know how these people are."

Wow. In Australia the government wouldn’t have let you touch that tax refund. They would’ve taken it before actually giving it to you to pay that government debt. Same happens with unpaid child support.

The time younserve is only a fraction of it. Youre not done until you complete your probabtion and you will never finish probabtion if you do not meet the financial obligations of your sentence.

If the payments are in the probation order, then yes, you have to pay while on probation, or risk being violated. BUT, if the payment of the restitution is not enumerated as a probation term, then it's enforceable only as a civil judgment ... your probation can run its course without any issue arising from your lack of payment. Then 20 years down the road you get a lien release in the mail and you know the Judgment has become uncollectible.

Yes, that is one side of it and very much a CHOICE. It has been my experience that once they convict you of something, they seem to view it as an opportunity or reason or excuse to do it over and over again. I am currently working on a way to extricate myself from their flagrant abuse of civil rights and violations of their oath.

@@olesuhr727 the underlying reason why physicians or any professional who requires a license to work loses their license when convicted of a felony, is that they can no longer be trusted. If a doctor is willing to commit a crime to enrich themselves how can the government or anyone trust them with someone's life? That said, I do believe a physician can petition to have their license reinstated a few years after completing the terms of their sentence if they accept responsibility, show remorse and make an effort to pay their debt to society, but I could be wrong.

It's all about the money. If at all possible, pay off everything you owe all at once. Then there's no more probation, no court, no more anything. You're a waste of their time if you're paid in full.

My friend/business partner/attorney embezzled $50,000 from (me) our company. Ge claimed to have made a mistake. I took six months to quietly remove myself from all legal entitlements. Then I put the keys on his desk along with a document giving my half of the company to an employee. I never looked back.

These smart guys take the cake! Come on, man. Didn’t it occur to this doctor in an era of computerization that a match is done between the IRS and DOJ on refunds? This is basic commonsense. He is not prevented from receiving the money. His violation was not reporting it to his probation officer. It would up to the probation officer whether or not that money should be used towards restitution.

Only in certain cases . I know someone who doesn't ever pay child support and never paid any restitution for her sexual assault. She has only served 240 days of a ten year sentence that should have been life .

A surprise for you it doesn’t quite work that way, I was sentenced to 45 years for a murder when I was younger. I’m no longer locked up. That should have already been done by Court,Family courts take Tax Refunds from people who owe back child support, automatically. Somebody didn't do their Job correctly because if someone owes Hundreds of thousands they shouldn't be getting a Tax Refund Check. They'll Drag a guy through broken glass for a dollars for kids but not for an Actual Criminal. Proves they intentionally hurt fathers on purpose. This guy just proved it.

These same doctors often work for the federal government after release. Such as federal prisons, VA hospitals, military bases, and indian reservations. Without a license to practice medicine. You see, medical licenses are issued by the states doctors practice medicine in. By working at the locations i stated, they don't need a license. Those are technically "Federal Preserves", and not governed by state laws. Look it up.

Thank you for informing us of this but what about Mr. Trump’s who has broken practically every law imaginable & still hasn’t had the consequences he deserves. And the f does have dementia, he’ll still Manage get away with his crimes harm he has done individuals, businesses, communities, our government & our country. He was s like rampaging pandemic in one evil human being! Let’s see some justice that matters in terms of Mr. Trump’s egregious behavior.

Fun fact: the doctor's "prison" is most likely a golf course. Jordan Belfort described his "prison" as "a getaway resort".

Agreed, Maxwell airbase a federal prison camp has a golf course although prisoners do not play golf the cut grass. In the 70’s it did have a swimming pool, 60 minutes did a story on this, pool was filled in

@@thomasowens7197 That story was called "Club Fed," and it was an early Barbara Walters piece. After it came out, the BOP closed access to all the golf courses and most of the swimming pools. But the tennis courts and baseball ball fields were still accessible.
