Indiana supreme court MISTATING that RA is being held in JAIL instead of PRISON shows how little they care about the law. The system in the US is already in disarray but this is absolutely not justice for RA's constitutional rights. Gull has done this more than once.

Just like the Idaho4 trial: Delay, delay, delay. Those poor families. It's unlikely it'll ever get to trial before 2026.
@mikusheadphones
@mikusheadphones 8 ай бұрын
BK's case has over 51 fucking terabytes of discovery to go through, in which the STATE STILL DOESN'T HAVE ALL DISCOVERY, that's why there are delays there. There also are REALLY suspicious legal loopholes that seem to have been jumped through that may violate due process. There is NO justice without a fair trial and a fair trial requires due process. The WORST thing for families is that a conviction is overturned or a person gets acquitted because of these legal technicalities.

I said by the time the trial eventually happens I will be completely bald. Let's hope that's not true for the families of Abby and Libby and also Rick and his family. I'm still open to him being innocent. I hope the evidence at the trial leaves no doubt as to the truth either way.

I'm happy RA's lawyers have been reinstated. They really seem to believe in his innocence and are passionate. Regardless of how I feel about someone we all deserve a robust defense that will "zealously" defend us. This means he'll have a fair trial and we may see some really good lawyering. I hope this is filmed for the public. I think ALL cases should be streamed for the public.

Hi, thanks. It seems like the judge, defense, and prosecution are arguing about a variety of things that keep delaying the trial. I don't know why the defense hasn't filed the 70 day speedy trial request if they know Rick is 100% innocent like his temporary attorney Lebrato said last week. I know they recently received more evidence they said would take a few weeks to review, but the next hearing in is 5 weeks compared to filing the speedy trial request which would be 10 weeks away.
@mikusheadphones
@mikusheadphones 8 ай бұрын
@TomWebsterChannel they literally haven't gotten all the brand new discovery, you can't file speedy when you haven't even been able to look at the discovery, that ineffective counsel. Also WHY WOULD THEY want to try a case in front of this judge who illegally removed them, then told new counsel that she'd have a hearing on a Franks at least 3 times, then immediately denies it when reinstated? She doesn't cite have law in all her dismissals of motions, she only holds hearings for prosecution filings that are a train wreck. Also there were charges that were changed, which requires more defense strategy. They were ready with the previous charges for trial, the issue now is that nick changed the charges and so they have to change the defense strategy. I get that you are trying to be balanced but the lack of understanding why you wouldn't file speedy here feels intentionally biased tom
@TomWebsterChannel
@TomWebsterChannel 8 ай бұрын
@@mikusheadphones The wording in that order about having a Franks hearing for Lebrato and Scremin was odd. Based on the PCA and the alleged lies/withheld info, I still think there was enough for the original judge to sign off the search of Rick's house so Gull would have never agreed to a hearing and throw out that evidence. It wasn't intentionally biased, I'm not always right. You made good points.

Thanks Tom! I have a lot of respect for Justice Slaughter he is more of an "originalist"when it comes to the law meaning he follows the law as it states and believes if you don't like the law then ok change it but only after it's been voted on vs the other justices where they can just interpret what they think it meant, change laws when they wish and use their power to do so whenever they feel like it. The law is supposed to be clear and not ambiguous. But either way I think the other justices were trying to strike a balance, however I think in doing so they are inadvertently going to cause more headaches not only for this case but other cases in the future. I guess time will tell..

This is probably the wrong video to ask these questions, for which I apologise. It’s just so difficult to drill down on specific information on this case on the web. Could someone tell me: 1) what date in Feb 2017 did Richard Allen report to the police that he had been on the Bridge/Trails?; 2) what date in Feb 2017 was the video and voice recording of BG released by the police to MSM? I think it makes a difference if RA reported to the police before or after they released the video/audio as I think one can assume the murderer was unaware the events were being recorded. Thank you.
@TomWebsterChannel
@TomWebsterChannel 8 ай бұрын
1. It has never been confirmed by Police, I imagine it will be revealed at the trial. I’ve heard anywhere from the 14th to the 23rd. 2. I believe Feb. 15 after 5 pm.

@@TomWebsterChannel thank you, Tom. No wonder I couldn’t find it! I think it’s crucial we know the exact dates. I’m puzzling as to why (assuming RA’s the murderer) he would report to the police that he was on the bridge at the exact time of L&A’s abduction (1.30-3.30, I realise this time is now contested, it may be 12-1.30). He also, allegedly, told them what clothes he was wearing. If he did not suspect he had been filmed, why do this? I’m assuming he did not suspect he was being filmed otherwise he’d have taken the phone from Libby on the bridge. If he is the murderer and saw the MSM reports of the video/audio, I’d think he would report himself as a form of alibi - but he surely would not say he had been there between 1.30-3.30! And would say he was wearing different clothes. But it wasn’t followed up, which adds to the confusion. This case breaks your brain!

@@EastoftheDanube if he is guilty, and he did pass the four girls as he entered around 1:30, even though he supposedly had a scarf up to his nose and a hat and hood, maybe he was concerned that those four girls could identify him at CVS, which obviously never happened in 5+ years. It will be interesting at the trial if any of them identify him as the man they passed at 1:30.
@EastoftheDanube
@EastoftheDanube 8 ай бұрын
@@TomWebsterChannel hmmm. I don’t see how anyone could identify a stranger with a scarf up to his nose and a hat on! We all pass strangers all the time when we take the dogs out for a walk, or whatever. I’d be damned if I could remember any details of the strangers I pass while I am focused on other things. This is why Dostoyevsky said, “no one lies like an eye witness”. This case stinks. I’m now suspecting a local paedophile ring dealing in snuff videos. It’s the only theory that makes any sense, especially due to the trial delays. I hope I’m wrong. I hope they have the right man behind bars, awaiting trial.

Ciao. Richard Allen was arrested in Oct. 2022. People who are arrested are supposed to go to a jail before their trial and if they are convicted they go to a prison, but since Richard / Rick is the most well-known person charged with a crime in Indiana now the police are concerned he might get hurt by other men in a small jail. So, they sent him to a larger prison and keep him in a cell 23 hours a day. For the first 5 months, he was okay mentally, but on April 3, he met with with his defense team and got evidence papers. He then went back to his cell and put water on some of the papers and ate them. He has a tablet that he can make phone calls to his family and he called his wife and mom and said he killed Abby and Libby. This audio was recorded, but the exact words have not been released, but can be played at his trial. The judge and Rick's attorneys have been arguing for the past 4 months that they all are bad at their jobs and should be removed from the case, so the trial keeps getting delayed. The prosecutor McLeland added 4 more charges a few weeks ago. Previously, Rick was charged with being "Bridge Guy" and kidnapping, but now he is charged with killing Abby and Libby. There is still no evidence released to the public that shows 100% that Rick is Bridge Guy or the killer. We'll have to wait for the trial to see if there is strong evidence. Grazie.
