You may not know what happens in the background check process buying a firearm. You can proceed, delay, or deny. In this video I cover what happens when your federal background check gets denied and the ramifications of a denied background check. The FBI conducts the background checks for the ATF and once a dealer submits the background their hands are tied.

Good info. It is to bad you even have to share it. I am an American citizen with certain rights given by the creator,and guaranteed by the bill of rights. In the constitution Government is set up to protect those rights. There unconstitutional laws will never stop criminals from being criminals. They are only used to disarm the law-abiding. You have to send whatever they ask for to appeal a denial or to go through the VAF process. I’d recommend you read through the links in the descriptions of my videos about delays and denials and go from there.

at 6:00 no, i do not. because on the off chance someone had the same name, or confused as a criminal i would not rather the goverment hold me up because of it. Because a criminal doesnt give a fucc and can get a gun at the same place he buys his weed. doesnt mean i should be held. GUNS ARE AS EASY TO BUY AS A $10 of weed. i dont think these processes do a damn thing. if someone wants to do harm, theyre gonna. dont exclude me from a legal purchase even if i do have a record. if im gonna do dirt, im not going to purchase a legal, traceable weapon to do it with.

I’m not exactly sure what you mean. If it’s that you’ve previously been involuntarily committed so you’re prohibited, you’d need to probably seek legal council to see if there’s even anything that can be done.

The ATF will be in touch for the firearm in question if it was transferred and later became a deny. They don’t have any way to know about anything other than that specific transaction unless you’re in a state or jurisdiction that requires you to register guns, which isn’t very many, honestly.

I’d recommend working the process with the dealer. On a successful appeal you’ll get an AMD-ID that’s only valid with that dealer so it benefits you to keep that relationship in good standing. You don’t HAVE to buy the same gun when you go back with the AMD-ID so if you’re thinking of changing up the gun just communicate that to them and see if they’ll apply what you spent to the new firearm of choice.

What about them not having my same SS number? Isn't that supposed to be a unique identifier? Why should someone that has done nothing have to jump through hoops and spend additional money to "clear" your already spotless record? System is broken if they can't do it accurately every time.

The initial check is ran by a computer. They don’t use the SSN unless it goes to a person on a delay. The system is flawed for sure.

It’s kind of at their discretion. If you have a good friend or family member you could have them hold your firearms for now and once you’re done with the appeal just get them back. It’s all a matter of how on the up and up you want to by while appealing, especially if this is your first denial/appeal.

Update. I got approved they give me a certificate and a number to get the tool. In my case too many people with the same name. I'm working to get the LTC I'm in Texas. 😀

That's the stuff that keeps me up at night, I have several prohibiting charges but they were reduced (or dismissed) to none prohibiting convictions . It still makes you paranoid that something didn't get filed right by the system.

Seems completely unreasonable that a dishonorable discharge strips you of a constitutional right. But I don’t know what conditions lead to a DH discharge. If you can’t handle boot camp do you get a DH discharge?

Not sure but I know if people try in relative close timeframes it usually denies them repeatedly. The most important thing is to work the process.

I’m in Texas, ironically the only time I got a delay was when I put my SSN on an electronic form. The girl working there said it wasn’t optional and the sale wouldn’t proceed until I put my SSN. I don’t have a record so I put it down and boom delayed for 24 hours. When I don’t put my SSN, I’m cleared in at most 20 minutes. I also have a very very common name, especially here in southern Texas. My ssn hurt rather help.

SSN actually doesn't get used UNLESS it gets delayed and it is 100% optional, so she was just poorly informed. Being in Texas...get your carry permit, then no additional check required, period. Your LTC is your background check here, we have what's called a NICS Permit Exemption. I'm in Beaumont, btw.

You can believe what you want but being a user of weed makes you a prohibited person under federal law. If there isn’t a way to trace it like a medical card then they don’t know and probably could never prove, but you’re still lying on a federal form, which they could pursue as a felony charge if they wanted.

I have charges that were reduced to none prohibiting convictions, so the original charge would cause a denial but the conviction I was found guilty of is not on the list of prohibiting criteria. I'm going to apply for my CCW permit even though my state is CC. I'm doing this just so if something was filed wrong by the court I won't have a denial hanging on my record. I know I could probably just go to my local shop and do the background check and be fine but I'm a worry wart so instead of risking it and having to file appeals and waiting even longer I'm going to go the safe route

I bought 3 guns within 3 week period no issues I was in and out on my 4th gun I got a proceed as well and then on the way to pay fbi called FFL said I was delayed 2 days later denied. Idk what happened ? I’m now appealing on the denial and I sent a VAF form both with fingerprints. How fast do you think this will get overturned. I don’t have any felonies or warrants or drug use. I’m in Ohio I think we have the same laws as Texas

If they’re asking for prints, my guess is somebody else with the same name did something recently and they want to verify you aren’t that person. I had a guy need to send in prints and he was approved in under 10 days.

Varies some by state. Pawn shops aren’t any different than a gun store when it comes to the selling of a firearm.

I wouldn't do a NICS check for any reason now. In 2019, mine came back OK within 5 minutes. If denied, in some states, they have to contact your local police that you were denied. I'd rather buy from another AZ resident hand to hand.

If denied, local law enforcement is notified by law within 24 hours. I think that was part of the Bipartisan Safer Communities Act.

Sometimes people never clear. You can still go through the VAF process for a UPIN in these cases but under federal law a dealer can release a gun after 3 federal business days. A lot of big box stores won’t do that, though.

The question on the form asks if you’re currently subject to a court order. The answer would seemingly be no. Look up the ATF 4473 and read through the yes/no questions and read the instructions for any that you’re not absolutely certain about.

I used my old address because that's what my ID read, and I got a delay, deny. Guessing that's why, I have no criminal record. Same state, here in AZ, already got my upin, gonna go get fingerprinted later. Does sending fingerprints help speed up the process?

If they asked for prints it’s because they think you’re somebody else that’s been printed and is prohibited. I had a guy have to send in his prints and that was why.

I’m gonna say “it depends” on this one. You shouldn’t show up as denied BUT it depends on if during the appeals process whatever was holding you up actually fixes their records. Otherwise, you could get denied again in the future.

Good morning. Jersey here, the first problem…lol. I slammed into an issue purchasing my first firearm. Passed all of the state requirements and purchased my first gun online. Seems I made a bad choice in FFL because it’s basically his hobby and I’m always on the back burner. He finally gets in touch with me two days ago telling me I “can’t have the gun” because my DL is “delinquent”. He wouldn’t elaborate, asked me if my DL was valid then hung up. I have no criminal background and my last speeding ticket was from 96 and paid off. The only thing I can think of is, here in Jersey, my full first name isn’t able to be on my DL. But the FFL isn’t forthcoming with any information. didn’t even mention the appeal process. He has been sitting on my gun for three weeks and I have a class this weekend so I can start the process for my concealed carry. But I don’t have the gun I’m supposed to be learning with. These classes are hard to get here as half the state signed up for them over night. Thank you for the information, I’m not sure where to go from here. I guess I’ll have to badger this FFL.

Call another FFL, explain the situation and then get the guy you originally shipped it to to transfer it to the one you called. The full name not being on the DL is an issue so be sure to bring a supplemental government ID that has your full name. Have you actually met the guy in person or did he say all this from a phone call? Another local dealer should be able to help you out

Told me it would take four to five days for results. A week later he called to let me know what happened. He now just emailed me to let me know that he attempted to do a name change but it won’t let him. So he now now has a call out to NIC to see what the issue is.

Him not being aware of what’s going on is on him. He had to countersign your 4473 that he verified everything matched. He shouldn’t have submitted it without supplemental information with your full name. That said, if it was submitted with your full name it should process normally, he’ll just still need supplemental documentation to cover his rear.

HEY, thanks for the videos with clearly provided info and experience. I'm going thru it now. just got denied today and very concerned. Didn't know anything about the CHALLENGE TO GUN RELATED DENIAL or VAF until after watching your video. Hoped I wouldn't need to. After following up on a failure of agency personnel to do their job its been possible to get a GCIC report that reflects a non conviction. Its taken months to get squared up and my lawyer says I'm not prohibited. Then I found this FBI document that's titled TYPES of DOCUMENTS REQUESTED BASED ON PROHIBITORS. Its regarding the VAF process. Made my heart sink. 😒

If you have the documentation to support that you've never actually been convicted, it may be a process but you should come out the other end ok. Make sure to appeal it and work the process. Unfortunately some agencies don't close out their paperwork properly and it takes a bit to get it sorted. You should be able to supply that documentation as part of the appeal process and at least get permission to purchase once from the dealer you appeal the transaction through and then you can work on the VAF and getting a UPIN.

I do have documentation to support my not convicted status. What threw me was that my GA Crime Information Center report shows that status, however it uses the word DISMISSED. It appears that federal PROHIBITORS to firearm ownership might be more strict than state. The state of Georgia law codes actually use the words "Relief from Disabilities" regarding firearms rights. I live in TN now, but grew up in SC. After 12 yrs being up here, crime free, I applied thru SCPPP for a full pardon. After 10 months, I finally got a hearing in Columbia SC. I drove down, and was granted my full pardon and restoration of ALL of my rights. So, I drove home thinking I had this on the bag, boy was I wrong. That was just the beginning for me. Aftwr 3 weeks I applied and was denied here in TN. Now, the 15 days have passed and I have my Conditional proceed paper, but when I called The TICS unit, (Tennessee Instant Check System) they kept telling me they needed more info. So I done all the leg-work and emailed then everything, including a current SLED CATCH/FBI criminal background print out. I called them yesterday, the TICS unit. Guy said, "we now have all the nessacary documents and it's on the desk of the guy over my file

You have to have a denied transaction and appeal it. You’ll need the transaction number from the attempted purchase that’s tied to that background check. Then you can follow the links in the appeal. The dealer you went through should have given you this information. It’s disheartening that so many don’t help people work through the process.

Im in Wisconsin have never had any encounters with law enforcement other than a rondom speeding ticket/ minor traffic violations whi h have been paid. Ive biught a hanful of friearms ober the last 5 years and have never had any issue. Just this week i went to my FFL to pick up a lower that I ordered and to my suprise i was instantly DENIED, i filed an explanation withthe FBI and got a response the next day that very vaguely indicated im mentally unfit, been committed to a mental institution, etc... (this is all news to me)... i contacted my doctor to see if ive been reported and was told no. (As a matter of fact that she didnt even know that was something she could do)... Im trying to figure out how to appeal this but it does have me kind of bummed out. It mentions adding a much descriptive information as i can but i have NO information.. this is all entirely uncharted territory. My doctor is treating me for ADHD and mild depression.. has been for a few years, I wonder if the feds automatically see what im prescribed and can use that against me all of a sudden? .. its all prescribed not a single thing i can think of that should forbid me from aquiring a firearm.

Wisconsin background checks are initiated at the state level, not using the federal system. I’d recommend you talk to a local dealer about how to appeal it at the state level.

(The state got back to me right away and basically told me it's an issue with the federal NICS system) Apparently 9/10 Denials are false positives. So now I'll have to wait 2 months to a year to get this straightened out. Its crazy, I basically am guilty until proven innocent.

That’s going to partially be state dependent. States with medical cards that run their own checks seem to have a “rule” that the card has to be expired for a year and then they’ll clear you assuming no nothing else in the BGC.

Hi great video, I had an issue that I received a denial for, I corrected the issue , it was showing wrong on the background check. In the letter I received stating that that issue was resolved they said that they found another issue that they didn't have enough information for to determine and they said it is a probable prohibitor. ( Not a prohibitor, but a probable prohibitor) They said that they cannot find any information on it and that I would have to And if I can't that my status would remain on delay. Well I did get exactly what they Asked for "final disposition and level of conviction" which was to pay the court cost that is all. Then they came back saying they wanted all of this other information, other information about court proceedings and victims there were no victims and if I can't find that information my status would remain on delay , what Does that even mean? It sounds like I'm the victim. thank you for your time.

What was the charge? It’s going to depend a lot on the local jurisdiction that oversaw the charge. I would probably reach out to the local jurisdiction and explain to them what happened (original charge/etc) and that it’s coming up in a background check and you’re having issues. I wouldn’t volunteer that it’s for a firearm purchase but if asked I would definitely disclose it. 99 times out of 100 if you’re trying to do what’s right they’ll work with you. Unfortunately this does happen pretty often when local municipalities don’t close out dropped charges or otherwise resolved charges properly.

A cop pulled up we have to go to court. They have it marked down as "Affray". It was like a production line one defendant after the next no sooner did One get finished another one took their place. Is that still going on? If so that’s why. They can’t decide anything until anything that’s pending is settled. If it’s been settled then that’s what you need to ask for from the court. The final disposition of the case/charge.

No, the UPIN gets added to the paperwork to be used in the conducting of the background. Theoretically, it should clear you fairly quickly but it isn’t a guarantee.

I live in California and purchased my first gun ever almost 14 days ago. I used my UPIN for the purchase. Received a delay status on the 5th day of my 10 day waiting period. Now I'm playing the waiting game wondering when the FFL dealer will call me back giving me an update. I read a lot of stories and experiences others have had regarding delays and undetermined status rolling over 30 days. Then having to resubmit everything just to have it happen again. Praying I don't fall into that category.

I just ordered a gun to my local bass pro shop, and i just started worrying about my juvenile record. I was arrested when i was 12 for burglary. (I know) I was always told that when i turned 18, my record would be expunged. Im 21 now, and I am worried this will make me get denied. I haven't had any trouble since. If you get denied just work the process. There’s a chance you may need to get a lawyer to follow up on the expungement but let’s hope it doesn’t come to that!

Heya, I have a situation myself. About a year ago, I was arrested for poss of m., had the charges dropped to a class c and then put on differed adjudication. I bought a rifle online, sent it to an FFL, and was delayed and then denied. My D.A. ends June 6th and I have stayed in good graces with the law. Will I be able to appeal my denial after my differed adjudication is up? I’m from Texas.

You should be able to. We had a guy who had a deferred adjudication for a charge (I don't know what the charge was) and he had completed his stuff. He delayed and then denied, it took him something like 60 days to get the appeal through but he was able to. Talk to the dealer that has the rifle, communicate that you plan on appealing after June 6th to clear that denial (you have to clear that one before you apply again or you'll just get denied again) and then you should get issued an AMD ID for use with that same dealer for a 1 time purchase.

I didn't explain everything violation of my Constitutional Rights Free from unconstitutional search and seizure didn't give him permission to get it out of the car and it was 2 officer's, couldn't give me a valid reason for the stop went from the license plate to the license plate light, plus was admitting that he actually thought it was a stolen car.

Great info going through this right now I have cpl and bought many guns this year and every other year I get a denial out of the blue some shops will re submi and then I’ll get a proceed this time they won’t so I have a number to call since the fbi no longer does them it’s our state police . I had a felony 20 years ago for possession of stolen property long story short I got it all taken care and adjudicated and I still run into this it’s the 4th time since 1997 thank you for the info I’m a subscriber now ! I’m from wa state by the way . So I called they said email them my ntn in the morning with license and my cpl and they will tell me over the phone what the hick up is and try and fix it . Just embarrassing is all but I have a lot of experience in the whole firearms restore and process . Funny thing is I’m a licensed bail bondsman here in the state of Washington and with all this new legislation that’s out right now it’s actually causing many folks with juvenile records lots of problems and making them not be able to buy and carry firearms . Ammo is not presently regulated at the federal level. That’s 100% state and you’ll have to talk to your state agency about it.

If your rights are truly restored, yes. Just work the process, you will probably need to send something in about your case and having rights restored. I had a customer that had done deferred adjudication and it took him about 90 days to go through the entire appeals process. He had to get paperwork for his charge/case and that took a bit.

California is it’s own beast. The best thing would be to discuss it with the dealer you’re going through. Background checks are only valid for 30 days so the clock is definitely ticking.

It can be anywhere from 3-10 federal business days with you being under 21. And that just means it’ll go to an open status, not necessarily a proceed.

You'll have to appeal it and see. The question on the 4473 asks about whether you've ever been convicted as defined in the instructions. Did you read the instructions on the form to ensure your specific case didn't still exclude you from being eligible? You would have had to answer that question "No" to be eligible and whether or not you can answer it "No" with your prior charge would be directly dependent upon your case the how the instructions read. If after reviewing the 4473 again and reading the instructions regarding the specific question about domestic violence you believe you shouldn't have been denied, then start the appeal and provide what they request. It may take you sending in court documents.

And he said my gun rights are back because the cocaine fell under the Brady bill.. And since it was vacated will it say vacated on my rap sheet or will it go away completely off of the rap sheet And will I have a problem buying my gun

Unfortunately, no. You can look at the form online and if you aren’t sure about any of the yes/no questions, read the instructions thoroughly. A dealer cannot run a background without it being tied to a gun purchase so the only pre-screen is the buyer ensuring they’re answering those questions properly. Everything but the first question needs to be “no” for the dealer to proceed with the background and eventual sale.

Honestly, the only time I've seen denials when the person didn't have a criminal record was in the case of stolen identity or the other person being a really bad person and you just have to send in prints or something.

I've had customers win on appeal in 10 days (mistaken identity) and as long as 95 days (deferred adjudication, documentation was needed by the feds). Another is 4-5 months in because of an old old old charge in CA. Very situation dependent!

If it’s like Texas, you can take the class and then you have 6 months to send in your paperwork, which is when the background happens. If that’s how your state works, I’d personally take the class and just hold the paperwork until after the appeal.

I got denied 2 days ago and I've never done anything that's not legal etc so I have just submitted the forms for my identity history summary and have to mail the fingerprints in tomorrow so I can find out what the issue is. I do collect SSD because of a motorcycle accident but that should have nothing to do with me getting a gun. BTW I'm in NY not NYC. Should I start the appeal process tomorrow to? The bad thing about denials is they never go away, so you’ll need to appeal it or at the very least contact the authority that does the backgrounds in NYS. I’m not entirely sure they use the federal system, they may run their backgrounds through a state system with how stringent gun laws are there.

The difference in address shouldn’t deny you if IL uses NICS. Something else is going on. I can use a government utility bill and a drivers license with an address that isn’t current. NICS doesn’t take the whole address, just the state.

That’s not a simple answer with how it’s phrased. A person that gets denied isn’t necessarily a prohibited person. There COULD be a mistake in the background check - something not closed out right, mistaken identity, etc. That said, a prohibited person cannot have access to firearms at all. If they live in a home with somebody that has a firearm the other person must secure it so that the prohibited person can’t even get to it. So, something like in a safe where the prohibited person doesn’t have the key/combo.

If you aren’t prohibited by law it is legal to make your own gun at a federal level. Some states have restrictions on what can be made and you still have to comply with the more strict rules
