They are using the "Double Jeopardy Clause" to avoid the real problem here. The Double Jeopardy Clause in the Fifth Amendment to the US Constitution prohibits anyone from being prosecuted twice for substantially the same crime. The relevant part of the Fifth Amendment states, "No person shall... be subject for the same offense to be twice put in jeopardy of life or limb.... "

If you want to charge the guy yourself, go to the Clerk of Court. That way you get to state it all there, on the record(this could be important later), and you get to state the specific statute you think he violated(again on the record). Alternately, you could file a motion as an interested party in the current court the case is in and state there on the record your evidence and the statute under which he should be charged. Be up to the Judge or Magistrate at that point.

Submit a complaint about the thin blue line. I did it hear in Los Angeles and they removed it from their wall in the lobby of the Lynwood jail. It’s unethical and supports separation between citizens and police. We don’t pay them to protect each other we pay them to protect us and our rights.
