She claimed to detain him under S1 of PACE because he was looking in bin which is a lawful action, i.e., there was no legal grounds for the search. A lawful action doesn't become an unlawful action just become someone objected to that unlawful action. She has given him grounds for a civil claim, e.g., (a) false imprisonment, and (b) battery. Both of which are crimes. The Police should stop employing people who commit crimes against members of the public.

Before you sue, Report the PC for the section 26 offence they committed, That is a criminal offence and the police are DUTY BOUND to investigate, if they fail, then you sue the police force naming the chief inspector personally for Malfeasance in public office, false imprisonment, Assault, dereliction of Duty! The payout will be tenfold, and Accept no Settlement without the proviso the PC & inspector are sacked for Gross misconduct also meaning they lose their pension. Police guidelines on the use of handcuffs state that the unnecessary use of handcuffs is an assault for which the officer can be prosecuted. If you were not clearly violent, and not likely to escape with two officers there, plus the fact that you would have had to leave your bike behind, then the use of handcuffs was assault. Go into the station and say that you want to press criminal charges against the officer. It may not go past the CPS but it will cause her a whole load of grief and can be part of your damages claim.

Detained for section1 of pace means they have reasonable evidence that you are carrying stolen property or illegal items like drugs or weapons they must tell you what they expect to find and why. They even said you have done nothing illegal but put cuffs on you. Then a female police officer searched you and put her hands down your pants and threated to arrest you for not giving your details. Absolutely everything they did here was wrong! You must file a lawsuit and sue them. That female police officer needs urgent remedial retraining she hasn't a clue.

21:20 When police do a section 1, they have to say specifically what they are expecting to find. They can't be vague and say anything that might be useful in breaking into a car or house. They have to be specific because they have to have reasonable suspicion before hand as to what they are searching for. Otherwise it's basically stop a random person, say some vague stuff about section 1, and then if something found they can say they acted properly and if nothing found then can say sorry on your way and who gives a shit about your rights.

Taking Goods from a Wheelie Bin: Is it Illegal? If something has been thrown away, is it illegal to take it? Sometimes, according to the law. Technically it is theft if you take something from a bin or skip, though whether it is illegal depends on the motivation of the person taking it, and whether or not the property has a rightful owner. Back in 2011, an Essex woman admitted handling stolen goods after taking potato waffles, pies, and packets of ham that had been discarded in a bin outside of a Tesco Express store after a power cut had caused large amounts of food to spoil. The woman denied theft, and said she only got one bag of food. She added that many other people took food from the bin. Her defence was that Tesco no longer wanted to sell the food, and rather than let it go to waste, she took it to feed her family. But did she have the right to take it? Tesco said that the contents of the bin belonged to them and that they always strive to reuse or recycle waste wherever possible. What is theft? According to the law, “a person commits theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.” Just because someone throws something away, it doesn’t mean that they don’t own it and if it can be proven that the property had a rightful owner, it would be deemed illegal to take it. But if someone honestly thinks that it’s okay to take something, even if it belongs to someone else, they might not be guilty. Theft has to include an element of dishonesty. Legal precedent If the person who threw away the goods intended to throw them away and wanted to claim no further ownership, this would be classed as abandonment. If goods are abandoned, they legally have no owner and anyone who takes them would not be guilty of theft. In one case in Basildon, a man was charged with theft after he was seen taking bags of clothing from outside a charity shop. When are these morons going to learn that you can't assault people with handcuffs just because you've never met someone before !!! that's not what handcuffs are for and not what's in the NPCC Guidance on the Use of Handcuffs which you can download from the description of most of my videos by the way.

It really looked as though you stumbled upon bins that contained serious breaches of GDPR, material which had not been shredded or destroyed. The way those cops reacted, it did not appear "normal", it looked like they were searching you for paper etc. Removing your gloves etc. There have been cases in the past, medical records for example, just tipped in bins. Disposing of printed data is expensive, take a look at "confidential data shredding" on line, it can cost £1000's per week.
