I was really good friends with his brother and we hung out basically everyday. I would see Jake frequently when picking up his brother at their house. Jake was little, around 5 or 6 then. Jake was always a nice, quiet kid and the last time I talked to him, for about an hour around 2016, he seemed to be doing okay. I would see him around when I visited our hometown over the years and would always chat with him for a little while. I saw him in either 2021 or 2022 at a grocery store and it looked like he was either coming from or going to work, it was a very brief hello. Its crazy to see him in this situation. Actions have consequences, and this was unfortunately the worst outcome possible. He was being truthful about his stutter though. It was always something he struggled with. Man, its weird seeing this. I didn't know him well enough to know if he had problems with alcohol or drugs. He was always a nice kid. He made some real bad decisions though. They are more likely to survive as they have slower reaction times and don't brace for impact, this means they are more likely to suffer less broken bones ect and the alcohol then acts as a buffer that inhibits certain chemicals that are released when a person suffers a major injury. I still don't understand why breathalyzers aren't a standard procedure in drunk driving assessments. In Australia, we just go straight to the Breathalyzer, cops don't even need probable cause. "G'day mate, RBT, blow into this tube for me." ... "0, you're all good have a lovely day." Or in this case, "You've blown six times over the limit. You're going to jail." Edit: This was simplified, the process is: Roadside handheld breatho to get an initial reading -> "Arrest for purpose of breath analysis" -> taken to a cop shop/RBT bus to do a fancier breath test for a more accurate reading -> If you're over, you then you get a blood test while your charges are filed. -> You are released into the wild, but make sure you get picked up by someone and your car can get picked up or it will be towed
@generallyspeaking850Ай бұрын
Here in USA 🇺🇸 each state is different. I couldn’t believe all they wanted was a urine test and that took 30 days to make an arrest. No BA nothing. Just roadside field sobriety test and a UA.

I'm an Aussie and I think we have had too many rights taken or trampled on but breathalysers are completely understandable and just common sense.
@ryanwilhiteАй бұрын
If we went straight to the breathalyzer, then cops wouldn't be able to claim their sobriety test indicated intoxication and thus gives them probable cause to arrest anyone, no matter their level of intoxication. Many people have supposedly failed field sobriety tests only to be verified as stone cold sober by blood testing.
@noah567829 күн бұрын
@@QuilloManar There are pros and cons to both approaches. You generally have less burden of proof in Australia. In cases like this, it’s much better. But in others the US is better. Not as simple as you make it out.
@QuilloManar28 күн бұрын
@noah5678 In the US case it's better because the cop can _feel_ like you're not sober even after passing all the arbitrary sobriety tests, and he can justify ticketing you for no reason. 😊 Also it's great because the cop will hold you up for like 30 minutes doing this silly thing, whereas the Aussie cop can only hold you for like, 2 minutes. Barely anything. 🤷

Laws won't fix it. Deterrence is only part of the problem. Why not make it easier to not drive literally everywhere? Put maximum speed governors on cars. She managed to save her little sisters life by pushing her out of the way, but unfortunately, she didn't move fast enough to get herself out of the path of this guy. When he went to court, we found out this guy had been pulled at least 22 times for DUI . This was back in the 80s when people got away with DUI like it was a seat belt ticket or something. In 1987 I was driving an ambulance that was hit by a drunk driver. In 2001 I had neck surgery due to that crash. Since the day of the crash I have not had a single day without pain in my neck. The worst part is the guy who hit us blew .07 so he was not arrested. He had driven 1 block from his apartment where blew a stop sign. Oddly enough even though we had a patient, nurse and EMT in back I was the only one injured.

You can’t confirm that without evidence proving their BAC since he was also acting like someone who just got into a major accident and suffered a concussion. That is why evidence is so important for the trial. There can be a lot of reasons someone acts like that and many of them don’t involve alcohol intoxication. For example: TBI, stroke, epilepsy, diabetes, disabilities (developmental/intellectual/physical), concussion, medications, etc. Thank god you aren’t in law enforcement.

Standard procedure with a DUI. If you act civil throughout the process, they send you home once you fill out paperwork and give samples. They can't hold you on something like manslaughter without evidence and he hadn't broken any other laws outside of driving drunk. The accident is still just an accident, until they can prove with legit evidence that you were driving while heavily intoxicated. They also need process the scene and get the death legitimized via the coroner, before they can say you killed someone. If they don't do everything by the book, hence the time taken to do the field sobriety tests, the guy can walk and not be held responsible. I would pick up a 6 pack of Michelob and drive around town drinking it by myself. Countless times I would drive absolutely smashed. I never got busted and never got into an accident so I was lucky. As I got older I started realizing I wasn’t as good at driving drunk as I use to be. I even drove drunk AF a couple of times with my infant son in the back seat. What an absolutely selfish and disgusting person I was. July 28th 2001 was THE last time I had anything to drink. My wife and I both just stopped. It’s just not worth it. When I was younger my brother and sister ragged on me every chance they got because I was drinking or drunk. Some 20 years later I’m at my now doctor brothers house and I open their fridge to get a pop and it’s packed with beer! Come to find out my sister is a lush and loves her red wine! They busted on me for years but I quit. I had no idea that my brother and sister, who I held in high regard, were a couple of hypocrites. I was able to forgive them for their BS but like clockwork every time my brother gets a chance he throws up shit I did some 40 years ago. I still love them both though.
