It's come up many times in court and the courts always rule police departments have the right to not hire anyone intelligent if they want to. Thank you for explaining primary and secondary offenses. My dad was a cop and I was trained and almost became one. The cops around here HATE it that I know that, and some other things. Was hanging with some friends, one of them was a cop, and I said you can't arrest someone simply for resisting arrest. You show up in court and the only charge is resisting arrest and you're walking free on a dismissal if your defender is even remotely competent.

If a cop is writing a ticket for an expired registration for someone and you walk up and cover the license plate up. That is a primary charge of obstruction. But in order for cops to make not providing an ID obstruction, they first have to have a lawful reason to obtain your ID. if they have no reason to obtain your ID, then not providing it isn't obstruction or any sort of crime.

I often wish that 1A auditors would use public transportation, and not carry ID at all. My favorites are the ones who don't speak at all. If you won't talk to them, cops get super frustrated. I remember this video from along time ago Does he NEED A DRIVER'S LICENSE to use a remote control car also? Show a sign OR THE "ORDINANCE" that says he CAN'T. We All know the ordinance exists-in his head. Slave owners mentality thinking they have authority over the citizenry by virtue of their duties to enforce the law. In this case there was no law to enforce, therefore, they attempted to enforce there own sense of authority without reasonable articulable suspicious of criminal activity. Which is the essence of a harassment.

They will run the license plate on his car. That is why some Auditors park their car elsewhere and walk to the location. Running info thru David or NCIC has in a sense backfired on them. They are in the data bases too, along with all the complaints citizens have made about each one of them.

It is no wonder why kids these days have no clue how to go out hand have fun and enjoy the days outside and not be on their phones or playing video games and not socializing. I remember seeing a video of a group of kids playing WWE wrestling and they were having a blast at it and some fool called the cops and said there was a gang fight going on and they came in hot. The cops then attempted to charge all of them with assault and battery because of what they were doing.

This is absolutely insane. To harass someone with a toy car. You don’t have any actual crime but to bother a family with a toy car. Detaining a person demanding a ID this was a public area. Band someone from a beach, the other person giving anyone a hard time is this officer. This was absolutely just try a power trip.
