@jonathanbirch2022 It can't be considered a HIPAA violation because the police and security guard "smelled" an illegal substance. The security guard initiating the "smelling" and searching of the patient's belongings could be a violation based on the fact that the security guard told the police personal medical information about the patient, without the patient's permission. There are other factors involved here though. A big one is whether or not the security guard signed any type of HIPAA-compliant business associate agreement that prohibited him from discussing any patient information with anyone. Regardless, the security guard did violate the patient's privacy and he should be fired from that hospital, especially if he's an employee of a security company hired by the hospital.

He's renting a hospital room. That's his room. They can't just barge into his room and search his property, any more than they can enter a rented house without a warrant.

Sort of yes and no. Hospital rooms are treated a bit differently than a standard rental. However, personal effects of s person, regardless of where they are, are still to be treated as such, just like how a cop can't search your car because they are investigating a crime at a convenient store and the store owner said the cops may search everything and your car is in their parking lot. So the cops may search the room and things that belong to the hospital, they cannot search anything else without consent, cause, or a warrant.

But he should be the one conducting the search, he would have no standing to pass this authority on to the police officers. He was sorely mistaken if that’s what he thought.

He used the police to remove his own responsibility and in an attempt to sheild himself from the lawsuit. If he had the right he would have talked to the security head of the hospital and then searched his room which wouldn't include his personal bags as that would still be a violation of his rights. He would only be able to search the hospitals property ie drawers in the room any closet excluding anything inside not openly visible he still wouldn't be allowed to shuffle through your baggage. He doesn't even have the authority to call the police department on anyone in the hospital without permission from the security head of the hospital. That's why in audits of well run security outfits you'll see the guards make multiple calls before police involvement because they have to have permission from the client rep. I can tell you this though he can still get fired for this incident for any number of reasons causing a disturbance in the hospital, if he didn't call the client rep before the police, but he can immediately be fired by his company because they don't want to shellout on the legal insurance on a case they already know his involvement lead to a violation of rights because they don't want culpability put on their company image and a headline that negatively impacts their ability to get new contracts.

Yea, let me tell you how that'd go. How was he damaged? No ticket, no arrest, they showed up and asked some questions and did some looking from a "tip." You wouldn't even make it to summary. They'll get away with it. 2A violations are civil rights violations and they've been happening for decades. People have gone to jail, for decades. No one is collecting from the clear and very obvious intentional 2A violations even though there was clear harm. CA and NY are the worst. The most unsettling part is the Doctor telling the patient he cannot continue to film (to protect himself and others), then having the complete audacity to say "no one is going to help you" if he keeps on doing it... This took place in a medical facility where sensitive information is discussed and can be inadvertently revealed. The doctor could loose her job and even her license if she allowed live taping to take place. Well the security guard thought that he could give them the right to search the room in general since he is a guard there, which may be true, but he does not have any say over the patients private belongings and anything which carries his belongings, The cops should have known, but chose to let the guard take the fall if it went to court. The fact that they felt the need to do this during his treatment is both humiliating and dehumanizing. I'm sure this is also traumatizing to a patient that has to do frequent treatment, because now every time they walk in there they can go right back to this incident. The man is already dying and now he has to deal with this too? They could have waited until he was done to search him. This is seriously just a mess no matter how you look at it.
