@@Martin42944 Sure, but your "smaller" and my "smaller" are probably vastly different. I want more efficient government with less revolving door incentives. Civil servants should be taken care of, but not allowed to enrich themselves with their granted powers. Less "big stick" also encourages more private transgressions. Red Paint "ketchup", coal dust "pepper", the tobacco industry, the fossil fuel industry, the railroads in the 1800's and 1900's. Toothless or insufficient laws and regulations throughout history put the lie to the naive idea of "small government" But by the same token, bloated and excessive regulation merely empowers the person with the biggest eloquence of lawyers (apparently that's the mass noun for lawyers? What do you want to bet a lawyer coined it?) in their pocket.

For those wondering about Karas case, she is charged with 18 U.S.C. § 1017. This CLEARLY states that to be found guilty they must show that this was done "with wrongful or fraudulent intent". This is key because the only way they can show intent is by having someone who actually bought a fake document from her. Without intent there is no conviction.

That's not necessarily true. They can use statements she made, and actions that she took. Would you want to gamble your life on persuading a jury that you spent money on all those things just to satisfy your curiosity? More importantly, she'll face such a huge "trial penalty" for not pleading out that seeking a jury verdict is almost always limited to the incredibly foolish or recklessly stubborn. 94% of cases are plead out.

@@CreativityNullPast convictions are not admissible during a hearing or trial, they're prejudicial and they have no relevance or bearing on your guilt. They can't be used to establish intent, or serve as evidence that you had knowledge of how to commit a particular type of crime, or for any other purpose. There are a very limited number of circumstances where this rule can be broken, but the courts must first decide whether the probative value outweighs the prejudice, and that's a tough bar to reach. They can certainly be used when determining an appropriate sentence should the defendant be found guilty, but prior to that point they cannot be used in court. Or at least, that's how it's supposed to work, who knows what kind of shenanigans happen in modern day American kangaroo courts.

@@sfdntk I read something where they could be used to question the credibility or truthfulness of the statements in some cases. Though that's only if the defendant testifies, which they have the right not to. I also wrote this 8 months ago and at the time was not aware it couldn't be used against you in that way. Also, the police almost certainly used the prior conviction as reasonable suspicion for the charge and the arrest. They know they don't have much of a case, so they're intentionally dragging it out to make her suffer for sure. It's incredibly gross.

It's just not admissible as evidence and can't be used to impugn a defendant's character. And that's definitely a good thing in this case, because the way the prosecution has completely twisted the facts to paint a thoroughly dishonest picture of Kara's intent and character is already bad enough.

Actually it yields plenty of positive outcomes... for the politicians who want to look tough on crime; for the judges and lawyers; and for the bullies that are attracted to corrections, law enforcement, and the millitary. NOT ALL OF THEM. Please do not misconstrue. I've been in the system, it's definitely a case of some bad apples ruining the name of the people who are in their line of work to do some good. But there's a certain type of bad apple that is attracted to the badge/gun/guard type work. Thankfully those people are being weeded out more and more as we institute police/prison reform... but I could tell you horror stories that I witnessed, or heard from enough witnesses that I believe their accounts to be reasonably truthful.

This reminds me of when ICE detained one of my sister's top students (who had not committed a crime). Even with a former federal prosecutor, sitting congressman, state Attorney General, and a very good lawyer on our side, it took weeks to find him and we couldn't establish reliable communication. They moved him across the county multiple times without warning and we'd lose contact with him for a few days each time. Absolutely ridiculous system, hopefully things will work out for Kara

One of my close friends came home from work to discover her boyfriend had beaten her son into a coma...the assclown told cops she gave him permission to do this so of course they arrested her too. Kid died. They held her in county for two years, dragging it out as long and as miserably as possible. She finally gave in and took a plea and is now serving a 25 year sentence. Absolute nightmare. They should have at most 30 days to either go to trial or dismiss the charges, there's no way in hell they needed two years to gather the evidence if there actually was any. It's basically just torturing people until they confess.

It's something like 90 for speedy trial rights, or at least it was in my case. However, you'll wind up waving the right to get time for your counsel to prepare. People should be out on bail except for cases where they pose a specific threat to the community (including the potential witnesses).

I spent two years as a correctional officer in a private prison. All this stuff rings true, they just get to make up the rules as they go as their mood suits that day. There is basically no oversight at all unless there is something very egregious going on, even then it's hit and miss. It's a horrible industry that is ripe with abuse of inmates. I tried to stand up for them and got told by a supervisor he was going to do everything he could to get me fired.

You're absolutely right - the point of the system is to dehumanize you into submitting to it - and brutalize you once you do. And the worst part is, they can lie to you and everyone else the whole way along the line, and just don't care about what happens to people who get caught up in that - guilty, innocent, or any mix of the above. If we can do anything else to help her, including to transition back to life after she gets out, please keep us informed.

As tempting as it is to think that, you should remember Hanlon's Razor ("Never attribute to malice, that which is explained by stupidity"), and ask yourself can you credit the system and the bureaucracy with the intelligence to make that choice, rather than the incompetence to not consider a choice at all?

@@smokerjim The only problem with the Hanlon's Razor reasoning in this instance is that we're talking about the US federal prison system, and law enforcement/detention is known to attract people who have a malicious streak. I'm sure I don't need to point out recent examples, it doesn't require any complex google-fu to find them. I wouldn't be at all surprised if someone decided to throw her in the male unit with the thought that maybe the other inmates might happen to just "solve the problem" that they wanted to go away (or at least create a situation that required Kara to be removed to a hospital so she "wouldn't die on our block" as Dev put it). Horrible to contemplate, but it definitely would not be the first (nor would it be the last) time that prison administrators have been deliberately slow to respond to such a situation.

My comment was based on what I've read regarding the history of incarceration and punishment in the US and other places, past and recent, and a brief time working in some major correctional facilities around Sydney. I would like to think we're in a similar boat to the UK down here and Hanlon still applies more often than not. But I know it's simply not true in some cases, especially where indigenous Australians are concerned. I suspect that trans inmates suffer harsh treatment here too, although I have no direct examples I can point to.

From someone from Europe with a prison system which focuses on reform and creating a good future neighbor as far as possible, the american system seems pure evil with the profiteering from private prisons. Add to that, it also seems that if you are a defendant, you have informally been declared outlaw. Outlaw as in no laws apply to you, and so, no consequence for mistreatment.

People are generally much better behaved in Europe, although I do have to say that after living in the state of Texas for 48 years I was never a victim of violent crime until I visited Spain in 2017 where I was mugged, threatened with a knife and beaten by "Spaniards". Kind of soured my opinion of the country and I have no intention of returning after that attack.

I should point out that during my experience in Spain the real Spanish people were wonderful, my problems were entirely at the hands of some characters that looked like they had just arrived from Somalia or something so no offense to the people of Spain but I'm not sure that diversity is actually a strength for your nation.

Her loss and possible restoration of 2A rights is going to be very specific to her particular criminal record. First are any of her priors felonies or any type domestic violence. If there are no felonies, no domestic violence, and no occasions of being found not guilty due to mental disease then she should never have lost her rights. If there was/were crime(s) that would cause a loss of rights then you have to look at the jurisdiction(s) where the conviction(s) occurred. If it's a prior federal conviction she's screwed (there is a federal restoration process but the department that handles it has been purposely unfunded for around 20+ years). State convictions you have to look at each state's laws. Some states you have to apply for restoration of 2A rights, some states automatically restore rights after a certain time period, and some states only restore rights upon a pardon or reversal of conviction.

Note: Unless you are on "Supervised Release" (It's fucking post-sentence probation/parole... gods I hate the bullshit renaming of things in the legal profession. Call a spade a spade for the love of all that is good and holy!), and do not intend to cross state lines, the feds can't really do a damned thing about your gun rights. That's a state matter. I am not a lawyer, but I am a federal felon. I know people from my time in the system that have their gun rights back in their state, and owned legal firearms. Obviously Kara will need to check the laws with her specific situation, but in general so long as you don't cross state lines and aren't on probation? I'm reasonably certain you just need to worry about state laws.

I'm in Denmark, so I'm fairly sure it doesn't get *that* bad here, but I'm definitely taking your point about interacting with the police and having a lawyer serous. Yeah those shackles hit hard. The thing that jumps out for me is that they're clearly transport shackles. Those are explicitly not intended for long term use and noted as such in the manual supplied by the manufacturer. I've been in them (for kink reasons, not legal troubles) and they get extremely painful after a while. Their prolonged use should imho be classified as torture. Even IF there was a reason to keep Kara shackled long term, they should be using something like Segufix or Humane Restraints cuffs, not transport irons. This is another thing her lawyers probably are or definitely should be fighting.

If you look at the picture where the shackles are shown, there are folded up cellulose based incontinence pads underneath the shackles. My guess would be that Kara has already been developing sores underneath. Not to foget about the bedsores she probably also is developing right now... My heart really bleeds when seeing this. I know how it is to be bedridden but I'm lucky enough that the Netherlands has a somewhat working health-care for people like me so I have a specialized bed and a medical airmatress that alternates the pressure continuously through the 21 cells with a 3 cell configuration. So at any given time my body has pressure on 7 out 21 cells and that's preventing me from getting bedsores again.

I think Kara's treatment has been inexcusable. Having said that, a friend of mine was in a LI nursing/rehab home for nearly four months, due to surgical complications. They were treated abysmally, i.e. phone privileges, half servings of meals, forced to sit in a hallway chair for hours...the owners of these facilities milk the system and abuse the patients, routinely. As to the postal inspection, NYC has been rightfully paranoid about terror and security since 9/11. Still poorly trained and inexcusably ignoring constitutional rights, a trend the Rudy Guiliani really pushed when he was mayor. But when it comes to forged IDs, especially "Secure ID" forgery, they have zero tolerance. If Kara was at all involved in that, they'd go berserk. You remember the two bombs at the Boston marathon? Where the second was delayed, to ensure it killed first responders? NYC is one of the few places where ALL responders are trained to expect dual attacks like that. And until police secure a scene, even fire rescue personnel may not be allowed to respond. "You're not in Kansas anymore."

When I was at FLETC I met a nurse who worked at Manhattan detention center. She was sent to FLETC to learn how to use fire arms. She told me that part of her training was to shoot escaping prisoners! I asked her about how she could reconcile the order to shoot someone who was a threat to anyone with her oath to do no harm. As a Gay, disabled, Air Force veteran who cannot work therefore my only income is less than $4000 per YEAR, I know how difficult it can be because I was in the Air Force was still “Don’t ask, don’t tell,” from 03/2001 to 12/2004 and as part of my job in the Air Force Intelligence Agency I saw and know of certain ways that the government can/could do to “get revenge” on people who they think/feel have done something they consider is wrong. It wouldn’t surprise me at all if the government would use every agency and every resource they could to turn someone’s life upside down. I’m so sorry Kara for the way they treat you. It’s wrong. Don’t let them win fight hard to beat them and keep your chin up and your hair down and just know you are wonderful and you will get through this. I wish I could fix it for you and I would, in a heartbeat. Because I can’t imagine what you’re going through and what I would go through if I was there because of my broken spine I’ve been in excruciating pain and can’t do much of anything without pain killers. Luckily, I get them right now but I know if I was in your shoes I wouldn’t make it because they wouldn’t give me my pain medication and that would make me be in so much pain I wouldn’t be able to walk to the bathroom. So to wrap it up, I hope this ends soon for you and stay strong. You have a huge amount of people who want to see you out and on your own. ☺️😗

I am absolutely disgusted and infuriated that Kara can't get a speedy trial to literally save her life, while meanwhile an evil man who has unjustly enriched himself on a conspiracy to destroy the institutions we hold dear (for however much that might be misguided) throws out a motion to get a speedy trial as a 'gotcha' to his prosecution and has it granted with enthusiasm. by the judge. We have two justice systems: one for the rich, where they don't even have to see the inside of a jail cell pretrial, and the one for the rest of us, that Kara is experiencing. I wish her all the best, and hope something will advance for her soon!

This is actually relatively tame for pre-trial detention in the federal system. Though the silver lining is that both outcomes of the trial will likely be much better for Kara. Beating the conviction will obviously lead to a release back into society, which a conviction should see her sent to a medical facility, though I am personally unfamiliar with the female side of the federal system, I do know they have at least one fewer security level than males do (I think they have minimum, low, and maximum... it might just be minimum and maximum though), and the low end of the male side is better than pretrial... Basically they treat all pretrial detainees as Maximum Security Convicts. So even if you're there for wire fraud or tax evasion, you're treated like you're a murderer or drug lord. I doubt very highly Kara will be sent to Max. So even a prison sentence will (likely) be better than the bullshit she's going through now.

Because, believe it or not, the average American does not want prisoners treated well, nor are they interested in rehabilitation or second chances. Anyone in the prison system is deemed, essentially, a throw away person not worthy of thought, let alone defense. There's no curiosity as to the nature of the charges, nor the concept of humane incarceration. There are many here who, if they were in charge, would reduce prison even further to a cage with some bread and water. I had the misfortune of experiencing this first hand when a close family member was incarcerated. The mistreatment and extortion isn't a mistake of incompetence, it's very much purposeful. Even with sound convictions, Americans don't seem to understand that the system is so egregious that the family of the convict, who have committed no crime, are also forced to live through an absolute nightmare if they are not willing to simply abandon their loved one.

My comment wasn't so much surprise (tho I was surprised she wasn't actually attacked by the guards, which should say everything about my expectarions of the US prison system) but more of exasperation. The US is trying really hard to pretend its a "civilised" country, while stomping down as hard as possible on those on the lower end of the societal ladder.

Several people asked Runkle if he was going to cover it in tonight’s livestream (I think he said it’d be in a separate video soon) which led me over here to see who you are and what “today’s video from DeviantOllam” was. I’m sending good wishes and prayers for Kara. I encourage you to use your platform to educate those of us in the US about the presumption of innocence. Jurors in the US are not supposed to go into a criminal case neutral, they’re supposed to assume the defendant is innocent unless the government proves guilt beyond a reasonable doubt in a trial. Its important for jurors to think critically and independently, especially in a criminal trial. That also means not having everybody try to escape jury duty. After decades of Law & Order, CSI, NCIS, Chicago PD, many people don’t realize when they’ve started to think “you were arrested, they must have evidence of you breaking the law” and/or “if they were innocent, they would have talked to the cops and cleared everything up”. This ignores the different (far lower) standard of proof required to charge somebody with a crime, and it doesn’t consider how cops and prosecutors will take statements out of context and twist their meaning. Our system intentionally has the right to remain silent and the presumption of innocence, and a standard of beyond a reasonable doubt for criminal cases. I’m not a lawyer, I just watch them way too much. Please be careful about saying she had certain templates or a home lab, even if you think its a fact. I don’t want your videos here or your phone calls with her to become evidence.

I am very much hoping things get better for her. In the mean time, though, I would mention that medical necessity often is able to supersede various standard procedures for inmates, which may be a discussion to have with the medical staff about if the restraints pose an unnecessary danger or hampering of her ability to heal (it sounds like she is treated as a high fall risk, so she probably should already be in an alarmed bed, which would make multiple restraints to it likely unnecessary, and if discomfort negatively impacts sleep, that is hampering the healing process). Also, you may be able to look in to some sort of temporary designation of healthcare proxy, which I believe would entitle the individual to updates on health status through the facility. Right now she's not just a detainee but also a patient, and there may be things you can do to help her because of that.

I think the 2nd amendment “nonviolent felon” issue is a 3rd Circuit decision in a case and was an “as applied” to the defendant. It is persuasive but not precedent in other cases and most applicable in the 3rd Circuit. It is based on the tenants of the recent Bruen ruling by SCOTUS requiring a “history and tradition” test dating back to the early days of the country.

Hey Dev. I'm currently on Supervised Release for a Federal Felony. (Just to provide some context on my comment, and my reasons for investigating some of these things) First: Let Kara know that someone who has been through the federal system (low-custody, male, 5 year sentence) says: this too shall pass, and the start of the legal process is basically always the worst part. As far as I'm aware, so long as she didn't have her 2A rights taken from her by the state, and so long as the "firearm" wasn't provably manufactured in another state... she should have been fine. That "affects interstate commerce" bit in so many federal laws is... unfortunately overbroad and used to bludgeon people that the Feds really shouldn't be concerning themselves with. Also, you should double-check with a firearms lawyer from New York (or whatever state Kara is a citizen of) but as far as I know, even a federal felon, if their gun rights are restored by their state, may own and use a firearm manufactured in that state and so long as you don't transport it across state lines, the feds can't really do anything about it. That being said. I hope she is keeping hope for the resolution of her trial. Both outcomes should leave her in a better situation than she is currently in. Pre-trial detention is basically Maximum Security, and actual incarceration in lower security settings, while still much shittier than freedom, are at least usually an improvement on pre-trial. Also, just because you're cynical doesn't mean you're wrong. I would put money on the bet that this was a targeted investigation started because someones in blue thought the perceived disrespect displayed in the photo justified abusing their powers as government employees to find any justification they could to use the legal system against the person in that photo. In my experience, there are a lot of fragile egos in the kinds of positions that would have the professional contacts and favors to orchestrate a scheme like the one you suspect.

Shes going to do real time, probably in a real prison. The feds have *over* 98% conviction. I've been there, it's really crappy, gotta learn to get along

The court case you are referring to was heard by the appeals court in the 3rd circuit in Pennsylvania who found that it was a constitutional violation. There is another case working its way through the 4th Circuit in Maryland. That has not yet been heard by the appeals court yet. Neither case currently currently apply to Kara whose case would be in the 2nd circuit in New York. Currently the case from the 3rd circuit applies to residents of Pennsylvania, New Jersey, Delaware, and the Virgin Islands, as long as the Feds don't appeal. The case from Maryland doesn't apply to anyone until heard by the court of appeals. For The PA case to apply to Kara, the Supreme court would have to rule. If the Feds appeal the PA case, The Supreme Court could refuse to hear the case, in which case non-violent felons in the 3 states and one territory would have the right to guns, but no one else would. If the Supreme Court hears the case and upholds it everyone has the right, If the Supreme Court hears and overturns no one has the right. The Maryland case throws Maryland, Virginia, North Carolina, South Carolina and DC in the mix once the Appeals court rules. If the 3rd and 4th circuit appeals court rule differently, it increases the chance of the Supreme Court taking the case.

NY is often looked at my the right wing folks as some liberal morass of deviance and left politics. Not really. It's more right, not the 2A-loving right, the authoritarian right. Definitely look around for specifically a firearms law attorney, one that's very familiar with NY. You never ask, probably never will ask, but the community, speaking for the folks in the comments and myself, and probably a legion more would be willing to fund the defense. There's a lot of people who care, a lot We see the injustice the cluster-f kind of environment people get stuck in prison for long time in NY without a trial - and when they get one, they don't get good defense. Maybe we can change it a bit.
