My son is as derivative but he is already in US and has overstayed more than a year. his DOB is Dec 1 2000 EB5 Case Submitted: 05 Feb 2019 I-526 Case approved: 16 June 2020 Welcome letter received from NVC: 14th April 2021 Date fee paid for WQ : 25 Apr 2021 Is he still less than 21 CSPA age ?

if a child ages out even with CSPA when his parents get GC from their EB2 category, can they apply for his F2B case using the old EB2 I-140 priority date, or he gets a new priority date as of date of F2B application? If they can use their old EB2 i140 priority date, then f2b case will be faster.

Does the age freeze after approval date ? until you get final interview call ? as my filing fate was "" 28-june-2010" and approval date was "July 30, 2013". And yet not recived call as current case in chart is "08NOV07".

And as we know the age will be freezed while you fill the ds-157 form cause there is no I-360 form any more. So am I qualified for the visa

Hi Reg, it may depend how long the petition takes to approve. There is a calculation of determining whether child is “aged out” even if he is over 21 by time visa is available. However, your child must remain unmarried in order to qualify. After his petition is approved, we recommend you schedule with us to verify if he still qualified even if he actually turns 21 years old. Call 346-330-5888.

Hi, I am not sure what you mean automatically apply. In a negative way or positive way? If government does not list your adult child and the formula shows him or her as under 21 by cspa then need to make argument to them. This is what we do for clients.

Great glad to know your name was on the letter also. You should have your documents ready for interview. Did you get medical exam and biometrics? Supposed to do that before interview to save time but can still do it after.
