Seriously?! Wow great journalism... I used to find your stories about this stuff interesting but seeing how you respond to people and push your way around the restaurant staff is just ridiculous. You are a reporter, not the health inspector... if they don't want to talk to you they dont have to. Just because you have a copy of the health inspection and a camera doesn't give you the right to go into a place of business and bully the staff, who are just trying to support their family or themselves, with a paying job. Oh and you might want to ask the patrons, who are paying customers, if they mind being filmed. Not everyone wants to be on camera or on tv.

You're allowed to film in a restaurant, gas station, etc. A doctor's office is different, because there's medical records and stuff, so obviously you wouldn't be allowed to film there; but you're definitely allowed to film inside of a restaurant. They've been doing this for years. Calm down.

I totally agree that I don't want to eat at a dirty restaurant... but that's what the health inspectors are for. This is just TV sensationalism and, in this instance, Darcy Spears and the KTNV camera person are doing something far more illegal than a restaurant with a dirty kitchen. Anytime you film/record material intended for the public and for profit, you need to have a "Release for Use of Likeness" document signed by all parties involved (I don't know NV laws in detail but some jurisdictions require notary public). While this document is often forgone under the concept of Implied Consent, once the waitress and the man at the table said "no", the cameras should've been turned off and NONE of the footage was legally usable. I've watched a lot of these and find them interesting and informative (I'm in Las Vegas quite a bit) but I've always thought she flirts with what's legal. In this case, to quote Marge Simpson, she not only crossed that line, she threw up on it!! Darcy Spears and KTNV are not above the law. And, speaking of the law, these business owners are operating within the law as long as they address the problems and abide by the SNHD. If they don't, the LAW shuts down the restaurant. Business owners have hefty investments and don't want to lose them. Owner(s) of the BBQ King should sue the hell out of Darcy Spears and KTNV... ESPECIALLY for the defamatory yell across the parking lot to "Go in and eat a cockroach" after all of the illegal coverage leading up to it!!

Patently incorrect, journalism is specifically except from these regulations for good reason. They can film anyone in public, and until they're kicked out any open restaurant is public for them. Do you think Chris Hansen got all of the child predators to sign releases? No. I know TCAP shot on private property so it's not a perfect analogy, but in terms of requiring releases to be used in a for-profit enterprise it's the same thing.
