If you've been receiving SSI or SSDI benefits in one state, you'll continue receiving benefits if you move to a different U.S. state. If your visiting another U.S. state for 5 months, then you'll want to be sure to use your personal my "social security account" to ensure you receive your benefits. Search Google for "Traveling. You Can Still Access Social Security Resources," for more information. Also, contact your local SSA office for more details. Thank you.

Hi. Yes. Some benefits also apply to nonimmigrant visas. However, not all the benefits are applied the same. For example, Green card (GC) holders can live and work in the 🇺🇸 permanently, are eligible to apply for US citizenship in 3 or 5 years, can work at any employer that they are eligible and start or work at a separate business as well. H-1Bs cannot live in the U.S. permanently, cannot apply for citizenship, and are generally tied to one sponsoring employer. H-1Bs can own a C Corp or LLC, but generally H-1Bs cannot work for their own business, unless it is the sponsoring employer. There is much more flexibility and certainty with a GC than an H-1B. With a GC you have many more benefits and peace of mind.

Congratulations on your green card approval! Once you receive the physical green card, then you can travel outside the U.S. for up to 5 months and 30 days. If you plan to travel outside the U.S. for more than 5 months and 30 days, then you need to apply for a reentry permit and receive your reentry permit before traveling. Please also review CDC guidelines and the traveling guidelines for the country your traveling to. Hope this helps you.

Hi Pushpa. That's great that you have completed your 40 credits of work. Congratulations. However, you are not yet eligible for social security benefits until you reach the age of at least 62 years old under current law. Please note that this is a very complicated area of law. You'd have a responsibility to complete a SSA-21 if leaving the U.S. for more than 30 days. You may be eligible to collect social security benefits if you do not travel outside the U.S. for more than 5 months and 30 days every calendar year. If you stay outside the U.S. for 6 months or more, then your social security benefits would be stopped. Please contact your local Social Security Administration Office for more details. You should also consider the benefits of applying for citizenship in regard to social security benefits. See here for more information www.ssa.gov/international/payments.html

Some benefits include paid service in any of the 7 branches of the military, possible enlistment bonus, incentives to help further your education, time off, healthcare, housing, VA loans, and applying for citizenship after 1 year. Contact your local military recruiter to discuss in more detail.

Hi Kerisha. I'd recommend creating a USCIS account and seeing if a biometric notice was ever sent. Also, check his USCIS case status online. Lastly, you can call USCIS Customer Service. Hope this helps.

Hi Diana. Glad you found the video helpful. Also, entry into another country outside of the U.S. depends on your country of citizenship, not your green card. Whether or not you need a visa to enter a certain country is based on your citizenship. You'd need to check with the Embassy for the country you wish to travel to in order to determine if a visa is required. Hope this provides clarification.

H-4 holders can own a C Corp or LLC, but generally H-4 holders cannot work for their own business, unless it is they have an EAD, otherwise they'd need to hire a manager to oversee the daily operations. There is much more flexibility and certainty with a GC than an H-4. With a GC you have many more benefits and peace of mind. Hi Marty. Yes. A legal permanent resident (aka a green card holder) may work as many jobs as s/he is eligible for including starting your own business. However, if you signed an employment agreement with restrictive covenants, it may restrict having another job. Without any employment agreements with restrictive covenants, you can work mutiple jobs wherever you are qualified. In addition, if your wife also received her green card, then she can start her own business. H-1Bs can own a C Corp or LLC, but generally H-1Bs cannot work for their own business, unless it is the sponsoring employer. Also, nonimmigrants cannot own shares in an S-corporation until after a certain time frame of being in the USA. Green card holders can own S-corps or LLCs taxed as S-corps. Furthermore, nonimmigrants who purchase property are subject to FIRPTA. Therefore, they can purchase property, but without the right guidance, they will be subject to FIRPTA, which is a 15% withholding tax, unless an exemption applies. Therefore, there is much more flexibility and certainty with a GC than an H-1B or other nonimmigrant status. With a GC you have many more benefits and peace of mind.

Hi Julia. Thank you for your question. To become a permanent resident of the U.S., you must intend to permanently reside in the U.S. Once you permanently move to the U.S., you become a tax resident of the U.S. after residing in the U.S. for 183 days and then you become a non-resident for Canadian tax purposes. If you are outside of the U.S. for more than 180 days (6 months) in a year, you could be regarded as having abandoned your legal permanent resident status. Therefore, if you do not intend to permanently reside in the U.S, then applying for a green card through marriage is not recommended. Hope this provides clarification. Hi Don. Yes. Enlisting in military service is also a great benefit for green card holders. With 1 year of military service, green card holders may be eligible to apply for citizenship as well.

I am also a Law Fraternity, practicing as a Lawyer at Madras High Court, India, after retirement from Income Tax Dept, Govt. Of India Services, as an Officer. So a family of four just won the opportunity to get a visa and have the green card and they didn't do the paper work for getting the visa to travel to the USA yet because they are concerned about the family incomes because the father is 62 years old and it's hard for him to find a job in his age so is he qualified for social service benefits as soon as he arrives to the USA ? and if not is there an opportunity for him to work even if he is 62 years old??

Hi Rawan. Glad you enjoyed the video and found the information helpful. I appreciate your comment. Also, it sounds like you know a family who was selected in the diversity visa lottery. That's great! Also, an applicant for a diversity immigrant visa does not have to file an affidavit of support also known as the form I-864. However, an applicant does have to prove that s/he is not likely to become a public charge. Once you become a U.S. citizen, then your green card becomes invalid because you are no longer a permanent resident. You will return your green card to USCIS at your oath ceremony because you'll receive your Certificate of Naturalization.

There is no minimum duration that an employee must remain with the sponsoring employer after the green card has been approved. However, moving to a different employer shortly after the green card is approved may lead to issues with "intent" during the naturalization process. Hi Cecy. Yes. You can travel by plane anywhere within the 🇺🇸 with your green card and a valid passport. Also, you can drive anywhere in the 🇺🇸 with a valid driver's license. Great question!👍 Green card holders also known as legal permanent residents may be eligible for the following under certain circumstances: (1) foreign tax credits, (2) foreign earned income exclusion, and (3) foreign housing exclusion. Claiming legal tax benefits does not affect your citizenship application. With that said, to be eligible for some of these tax benefits, you need to be living and working outside the U.S., and such time outside the U.S. can affect your eligibility for citizenship. The time frame depends on which USCIS office is processing your application. Your 1099 income would count as earnings that could be used to calculate your Social Security benefit amount provided that you report the 1099 income as self-employment earnings and pay self-employment taxes on your net profit. The earliest a person can start collecting social security benefits is 62 years old. Speak with your tax advisor to make sure your paying self-employment taxes on your 1099 income. Also, contact the Social Secuirty Administration to discuss your eligibility for benefits. You can also discuss calculating the difference in benefits if you decided to start collecting at 62 years old versus later. Hope this helps you.

Hi Asif. Spouses and children under 21 can apply to receive a green card with the EB-2 NIW applicant. Green card holders are subject to "immigrant intent" (i.e. their intention to live and work in the U.S. permanently), as well as the physical presence and continous presence tests in order to continue to remain a green card holder. It sounds like your current plan for your children would not meet the immigrant intent standard nor the physical and continuous residency tests. It depends. Your parents must have been married for 10 years, your father must be receiving benefits, your mom must be at least 62 years old and not remarried, and then she may be able to collect social security benefits. However, if your mom is living outside the U.S., then other rules also apply. For example, in general, for foreign spouses to collect Social Security benefits then the foreign spouse must be a U.S. citizen or green card holder and not have lived outside the U.S. for 6 months. There may be exceptions for foreign spouses that are from a country that has a Social Security Agreement with the USA or if the foreign spouse and US spouse lived together for at least 5 years. Your mom can contact the Social Security Administration or a Social Security benefits lawyer for more information.

When completing the DS-260, you must provide a U.S. "permanent address" and a mailing address that you want your green card mailed to. You are not required to live at the "permanent address" permanently. However, you should move to the address listed on the DS-260 and then you can later move to another residence and update USCIS. By not moving to the permanent address upon entry, you may leave your subject to issues of "misrepresentation" down the road. It depends on your circumstances over the past 18 years. When a green card expires, it generally does not change the permanent resident’s lawful status, except under certain conditions. For example your legal status can be affected by departing the U.S. and remaining outside the U.S. for more than 1 year without a reentry permit, criminal convictions, public charge issues, etc. I'd recommend speaking with an immigration attorney.

USCIS will only mail your green card to the U.S. mailing address you gave to the Department of State during your immigrant visa interview or to the U.S. Customs and Border Protection (CBP) officer when you are admitted to the United States. When joining the military as a green card holder, do I become US citizen after army initial entry training meaning after Basic Training and AIT? AIT is where the army will train you to become an expert of the MOS you choose when enlisted Basic training is where you will go to learn the fundamentals of being a soldier

If you served honorably in the U.S. armed forces for at least one year at any time, you may be eligible to apply for naturalization (i.e. U.S. citizenship). Contact your local recruiter for more details.

After 1 year of military service a green card holder who meets the eligibility requirements may be able to apply for citizenship. Please speak to your local U.S. military recruiter for more details. Wish you all the best in the new year!

Hi Nasir. As soon as you become a U.S. citizen, you can sponsor your parents for legal permanent residency aka a green card. The green card issued to parents of a U.S. citizen is granted for 10 years.

Hi Nasir. A green card grants someone authorization to live and work in the 🇺🇸 on a permanent basis. Therefore, a green card serves as proof of legal permanent resident status and work authorization.

If my whole family becomes green card holders, am I allowed to carry valid green card if I’m under 18 or should my parents carry it?

If you are 18 or older, you do have to carry your green card with you. Section 264(e) of the Immigration and Nationality Act requires all lawful permanent residents (LPR) aka green card holders to have "at all times" official evidence of LPR status. You can carry your card if your under 18, but it is not required until you turn 18.

Yes. A U.S. national guard/reserve solider can play NCAA sports at any U.S. college or university where s/he is accepted and admitted and recruited to play or gets selected in tryouts.

Yes. Green card holders are eligible to apply for in-state tuition for public colleges and universities if they meet that state school's residency requirements. Otherwise, out-of-state tuition will apply. For private schools, private tuition rates apply. Contact the schools you are interested in and ask about tuition and scholarships.

Hi Monira. Green card holders may qualify for federal, state, or local public benefits. It depends on your circumstances. Also, you must make sure that you do not accept any public benefits that would violate your current status and make you ineligible for future immigration benefits. See the current public charge rule that is in effect from 1999 here www.dhs.gov/news/2021/03/09/dhs-statement-litigation-related-public-charge-ground-inadmissibility You can also contact the Western New York Law Center for any questions you have about New York benefits and the public charge rule.

Hi Monira. You stated that you are pregnant and wanted to know if you move to NY are you eligible to receive any public benefits. Green card holders may qualify for public benefits, if those benefits do not violate the public charge rule that is in effect. Google "Western New York Law Center" and then contact them and ask what public benefits you may be eligible for in NY that do not violate the "public charge rule." Hope this provides clarification.
