Had a similar experience last year . My brother and I were flying our drones when an irate guy came up and assaulted us,he also grabbed my brothers’ controller, causing the drone to crash and be lost. Milton Keynes police sided with the assaulter, and told my brother to go buy another drone! Reported all this to Professional Standards, no action taken against the sergeant we reported the assault to! Typical police crap.

Why is the sergeant acting as judge? Surley his role is to gain evidence and pass on to the CPS who then make a decision as to the possibility of a successful prosecution. The letter of apology does not need to be accepted by the victim and the victim should have influence as to the progression of the case. Has the CAA been informed of the crime of endangering the flight of an aircraft directly? In my opinion the CAA must directly prosecute as a test case for public (UAV flyers) interest. If they do not it leaves the law invalid and so opens up the capability of individuals to abuse the rights of responsible flyers. Well done DJ for following this up and i hope it reaches a correct conclusion. 😎

I definitely agree with each point you make. As for reporting directly to the CAA, I think this is definitely a good shout as most pilots of any aircraft threatened by whatever means do not usually call the police, I would think. If I was DJ I would approach the CAA with the concerns that this man endangered the flight and so on......

Police apparently can do what they want I’ve just been investigated for “harassment with threats of violence” against people who are actually harassing and stalking us - luckily I can prove the threats with violence bit was entirely made up. Chose not to give the evidence to the police thinking I’d be taken to court as they had three people apparently witness it but I did make it clear to the police I could prove my innocence so because the CPS wouldn’t charge me, they slapped a Community Protection Notice on me - little plebs can act as judge jury and executioner when they don’t have enough to go to court, fumin 🙄 Ah well, they’ve been making false allegations for two years so no doubt it’ll continue and I’ll get a day in court one day - either that or I pay 10’s of thousands for a private prosecution because the police have ignored my requests for help against them 😠

If a drone pilot also pilots aircraft, he still has to register and pay the CAA separately each year for each activity provide proof on request and abide by the same air laws. But if he's interrupted while in command of a plane, it's a crime, not so when in control of a drone. But the liability in the event of an accident is the same. The protections afforded were removed by excluding drones from the sections of the ANO quite recently.

He apologised for over reacting to the situation, not hitting DJ, not striking the drone controller and not verbally abusing him. It is a cleverly worded letter which is typical, another reason it is stated as being without prejudice which means it can't be used in legal precedings. Probably drafted by their solicitors.

What an utter joke! The police in England don't take things seriously enough. I'm english and grew up in the black country and have seen how lenient the CPS are. I moved to Scotland 10 years ago and here we don't have the CPS. It's the Procurator Fiscal. Everything gets passed through them and it's either a fine or a court date. If he had committed that offence in Scotland then without a doubt he would have had at least a fine. Makes me angry how the police are strict with us drone pilots and making sure we are flying correctly or they seize drones and/or arrest us but someone can commit an offence to a drone pilot, endangering people and as long as they type an apology in an email then alls well!!

Extremely concerning also is the fact that the police tried to gaslight you into not showing the apology when by their own admission this was the end of the matter and the investigation had concluded. They are protecting the aggressor and subtlety threatening the victim who should be the one getting the support. I think the police were embarrassed and wanted this to be all off social media but DJ saw through this I'm glad to see.

The nice thing about cameras is that the auditor can review the video as many times as he wants, and the other party may have forgotten most of the confrontation after a couple of months. So the auditor always has the advantage. And not letting him get away with it is great.

A very interesting update, DJ. I'm not really surprised at the decision reached by the police. Although pretty traumatic for you at the time, it was a fairly low-level "assault"/incident. I think the MD realised straight away that he'd overreacted and did back off quickly. He has apologised and now received some much-deserved public comeuppance. What I am surprised at, though, is the poor grammar used by two supposedly professional people in the update. PC Laura Steele wrote in her covering letter: "outside of" instead of outside, "libra chemicals" with no capitals, "Crime" which didn't need a capital and "Crime for assault" instead of Crime of assault. And MD Phil Carlson used very amateur/annoying repetition in his letter of apology. Employing "interaction" twice in his two-line second paragraph. And "future" twice in his closing one-line paragraph/sentence. Doesn't the guy possess a thesaurus?

If you do not know what it means, then Mr Carson has used it in the wrong context (both parties need to know why it has been stated). It's a basic statement when the person/s are accepting their wrongdoings, it's to stop you, from taking him to a civil court and using it for financial damages against him. Meaning he did something wrong and is admitting it, BUT you cannot use that admission, in a civil court, as an admission of guilt (even though it is). A nice caveat to include in an admission of guilt, if done properly.

Cautions are a convieniant excuse for the police to dismiss incidents whilst pretending to serve justice to victims. A caution means absoultely nothing to the perpetrator. The attitude of the police is disgraceful but the courts would only fail you too anyway. Go and knock a pride flag out of someone's hand at an event and see what happens to you.

That's exactly what I was thinking. So, they got DJ to recall the incident over the phone and PC Plod writes it down in a Word document in his words and this is the statement of facts. Pathetic, the video is the most accurate statement of facts.

Yes, because they need a statement written out for the criminal process. The officer could watch the video and make their own witness statement having seen it, but it is "best evidence" for it to come directly from the victim. The alternative is that you upload a video to the court, with the title, "trust me bro, there is a crime somewhere here", which the court doesn't have time to do.

So the knowledge gained from this experience is, that if the manager behaves like an aggressive tool he gets a slap on the wrist for being a naughty boy! but if he conducts himself in an appropriate manner, its ok for his staff to therefore behave like wankers?? mollycoddling the guilty means less paperwork but doesnt and wont prevent it from happening again, complete joke of an outcome!!

Outstanding work DJ. The truth is out there now. If he was convicted of a criminal offence as a CEO. He would not be allowed to enter America on a Business visa, for international meetings. Including some other countries. That may have been taken into account. Not to proceed to the courts. Perseverance and patience very admirable dealing with all that. Respect. It is patently obvious the police were trying to get this off their hands for whatever reason, rather than doing what should have been done - an assault conviction, and also aerial issue.

Why you were there and at what time, is irrelevant. It has nothing to do with the assault itself and are just trick questions to find something to get you on something. Never answer questions like that. And, here in The Netherlands we have an Ombudsman where we can go to if the outcome of a police investgation is not what you expect. They will review the case and correct or not correct the police decision. There's a onbudsman in the UK aswell.

Apparently full Audio, Video as well as a full Confession of Guilt still isn't enough to pass onto the courts. At least not to this "Decision Maker." They probably didn't want to deal with the air navigation order because it would mean involving the CPS, I don't think the CPS are involved in cautions. They also likely had no knowledge of the air navigation and were too lazy to do the research.

A very good point. I was always led to believe the police made a case file which was sent to the crown prosecution service to see if there was a case to answer. Now a police sergeant is judge and jury. Our Country England 🏴 needs a better judicial system

They'll get on you about how many grams it is because of the "danger" But refuse to acknowledge that assaulting someone (which he admitted to.) who's flying causes a much larger hazard. It could go into a street or a no fly zone, forbid it actually hits anything. If I grab the steering wheel of a car away from the driver is He still responsible for what happens?

Hi DJ firstly thank you for keeping us all updated with this. Exactly what I expected to happen. The police have just swept under the carpet more or less saying go and do what you want to do. If you’ve got enough money you can get away with it. They just like a quiet life it’s things like this that make people hate and fear the police rather than respecting them. Playing devils advocate, if he had no prior criminal history and he was honestly sorry for his actions, they could have given him a Community Resolution which would not have been recorded on the PNC...but a conditional caution is a step up from that and is recorded. So he will always have this on record and if he was to ever do something similar again it would be used against him. I think its a fair outcome and he will certainly have faced a lot of sleepless nights during the process.

Good on you for pursuing this DJ. It is awful that you had to endure this aggression. I think this decision by the police is very disturbing. Surely it should be a decision for a court to decide what happens. Isnt that why we have the courts? What gives the police the right to decide who gets presented to the courts and who doesnt? Which apologies to accept and which ones not to? How do we know these decisions are being consistently applied? What public oversight is there of all of this to make sure that this power the police have is not being abused? Would an uneducated, non english speaking, poor man be given the same leniency? Somehow i think not. Can victims appeal the decisions of the police? And if not, why not? I can entirely understand an out of court disposal where both parties agree, but where the victim wants a prosecution to happen, and there is sufficient evidence to do it, then i dont see what right the police have to deny the victim that right. Who are they serving here? Also I think the way your request for consideration of the endangering aircraft offence was dismissed was really quite rude. At the very least you should have been offered an explanation of why that offence could not be prosecuted. If they dont even consider the offence it is no wonder nobody has ever been prosecuted for it!
