I get everything you say and agree but what grates my cheese is you say public consent. I'm a member of the public I don't give my consent to be filmed on CCTV yet I gave no recourse because we give implied consent by going on their premises, however I cannot avoid going onto virtually any promises if I want to live,work, eat and drive. I'm in effect forced to give implied consent if I want to live in this country, I am filmed every day without my given full consent, yet businesses and other public pee their pants at a bloke with a camera 😂 What a dunny place we live in. big brother is indeed watching us and nobody cares ...unless it's a saddo with a camera. 😂

You're missing fact that you do not have to give consent. Permission is not needed in public for anybdy to record you or for private land owners to record you on their premisses. There are only a few exceptions. However you do have certain rights as far as company is conserned afterwards via GDPR requests as they are a private data handler. You can request copy of CCTV if you're on it but compay has to obscure others in some cases. You have certan rights but no being flmed in most cases isn't one of them. If you're in a video on youtube or other sites you can request you're obscured and channel owner or KZbin will honour it in most cases if you're no subject of story in backgroud etc. However this can be ignored somtimes under journalistic reasons for example people in videos falsely claiming laws or making a scene as then they are the story and used to educate or entertain.

@deydodontdedoh You do make a valid point, but that discussion is about wider policy and probably beyond the scope of this channel. Moreover, the problem you identify does not in any way justify the behaviour of auditors, a different category altogether. I will say that some CCTV is zealous and unnecessary, and where it involves active monitoring and recording, it sometimes can be intrusive. On the other hand, most applications of CCTV seem to be justified and are applied passively in that recordings are only accessed and used for expected purposes - such as the detection of crime and anti-social behaviour - otherwise the recordings are deleted after a due period, and everything is regulated by data protection. It is a tricky topic for debate because the zealots will always be able to fall back on some legitimate justification and, to an extent, you have the Pandora's box problem: the technology exists and can be easily and cheaply applied across virtually any nuance a building occupier may encounter, making it hard to regulate.

Good points indeed and I get what's being said but in general it seems a bit bonkers people in general (street photography) and businesses are getting worried about a person with a camera. Sure a person could be upto no good on many levels but so too can businesses. Photography is a popular hobby and a largely innocent one. Businesses often want permission for someone with a camera yet don't seek permission from the public because it's taken that CCTC is a given. A business can withdraw permission to have you on their land yet they have assumed consent when you go onto their land to film you, yet film them even though they are filming you, they can withdraw the invite and boot you out. We do not as public have that apart from GDPR but that is after the fact and is not consensual to begin with. I know maybe I'm being very sad about it but just the principle of the whole thing, ok for big business but a sad sack with a camera and they act like someone has just cursed in church 😂 appreciate the replies 👍🙂

To understand, imagine if all the public CCTV cameras in the place where you live one day tracked you and you alone and that evening published the footage on KZbin and other social media platforms for people to watch and make fun of you. Imagine if, on complaining about it, you're told that, "It's just photography". Obviously you would not be happy with that response because, unless there is a reason specifically for the cameras to track you and publish it for all to see, what has happened amounts to harassment and is a breach of data protection and privacy. Auditors have invented justifications for this behaviour, such as holding people accountable when in reality they are just wasting people's time and not exposing anything other than the occasional police officer or security guard getting irate with them out of frustration.

He likes filming through windows (bedroom windows) and has been seen to hover his drone at window levels to film inside. He’s flown dangerously over railways and was recently warned by police for flying with no visual line of sight - an interaction that police put on record, being told the next time he was caught doing this he wouldn’t be so lucky. He uses the drone more aggressively than the camera, to simply wind people up.

Walking quickly past cars while swinging the camera around is hardly an effective means of giving information to one's subscribers. Surely still photos are a much more effective way of showing a subject. Anyone with a professional interest in car dealerships would know how to show the cars on offer. Of course, frauditors have no interest in what they film. They just do it to create situations and harass employees and members of the public.

Whilst his mannerisms in these videos may seem to come across as 'polite' one could always argue that to turn up at somebody's private premises to record without introducing yourself and asking for permission, is in itself bordering on rude behaviour. Never mind putting on the internet and earning revenue from it. Looking at some of his other videos, this is probably one of the 'better' ones you chose to look at.

Absolutely agree 100% normal business etc will conduct their approach and business ina far more professional and respectful manner but I do think.as this situation is a relatively new concept when dje turns up unannounced I think it catches some dealerships off guard but gradually I think that will change and the dealership will put some thing in place to prevent this situation occurring again and protect their business

@@bertblaser And to be honest, I don't have too much of an issue with someone wanting to turn up unannounced, but they have to understand, that they are trying their luck when they do that, and the business concerned is under no obligation to allow him access. This is where these 'auditors' fall down for me, because they seem to have developed the notion that they can do their video and upload it from wherever they like, irrespective of the company's wishes. The dealers may put policies in place and even signage, but I doubt that will stop some of these 'auditors', they will just march on to demand a copy of their policy and why it is that way.

DJE was Curtis Media, but after he hit the headlines last year, social media took him off so he started up again as DJE Media. There is a DJE Media listed at Companies House but it is nothing to do with Curtis. Curtis is listed at Companies House as Lynxus Ltd. When he claims to be a member of the public, he is a limited comany, there for financial gain, not a member of the public. Sometimes in these showrooms he says he wont film staff, but he does, he has his covert bodycam running all the time, filming and posting people who say they dont wish to be filmed and posted on media. If I was being filmed in a business by a filmer, I would ask the business for a Subject Access Request for the footage he has with me on, but thats just me.

This is a great alternative perspective for people who consume auditing videos. Most reasonable people, dare I say it even those who enjoy auditing videos know deep down it’s shitty behaviour. There may be a case for the earlier police videos but targeting normal people doing their jobs or going about their lives is just crap.

Ive seen numerous videos of dje and for an auditor he comes across as being polite but when hes ask to leave the toys come out the pram the ferrari visit was a shocker there was no filming allowed he continued and protesting why no filming the poor lady at the desk ask him 4 times please do not film me the manager politely ask him to leave and eventually he did but then decided to get the drone out the drone was very close to the glass windows filming and zooming inon staff for reaction i guess on a lot of occasions a manager will ask for the name u tube channel etc etc dje will decline that until the video is made if staff have been confrontational he wont proivde that information if how ever you've been good boyyou might be lucky Im not sure how much longer he'll be able to do what he does these showrooms are generally part of chain and they have a head office managers have been sent memoirs from head office no filming allowed like i said for an auditor its normal behaviour but normal people have far higher standards

The Ferrari vide was quite interesting as during that another photographer walked in just as DJE was being led out by the manager. Upon hearing that no photography was allowed inside, they just shrugged their shoulders and walked straight back out, likely to move on to find somewhere else to photograph. A much more reasonable and professional approach instead of arguing the toss, like DJE did. That Ferrari video has also be taken down and reposted a few times now as well.

He spends most of his time in these dealerships telling the staff about how they can react in two ways and the viewers like both, he just keeps repeating himself over and over again. He talks more about his channels than the companies he visits. His migrant hotel videos were good though, I must say that. And he is polite. I'm not comfortable with going in to these private businesses and expecting to be welcomed, maybe let them know you're going to film outside but that's about it. If I was buying a car I wouldn't want someone recording it

Curtis likes filming ladies. He always says hes a member of the public when he is a limited company at Companies House. He goes around doing what he does for financial gain. He films people's faces and voices for financial gain. GDPR? I feel this business arent used to people coming in filming, this will be why they didnt trespass him. Regarding the showrooms who have chucked him out, I don't feel their business will have been affected at all, people buying top dollar cars won't be watching these videos. If they do they may like the staff removing undesireables from the showroom.

It is quite refreshing to see a disection of this auditor, using refrences to law vs "his" rights. I feel that it is truly for a reaction, rather than interesting content. Had it included salient information on products, then it would be of more value. Definitely right to have an element of scepticism.

THE problem, when auditors trespass, is their victims not knowing their rights under trespass law. Be it police, council employees, security guards, or private companies, they rarely know their true authority to remove unwanted visitors.

If as they say, their covert camera is always on. (Visually, there is no way of telling if the camera is on or off). What happens when they go to a public accessible toilet? If I were a customer of one of these dealerships and went to the toilet, I wouldn't be too pleased if one of these auditors came in and stood next to me. Whose to say what they do with the footage.

And as he has his video monitize they could obtain a privacy order and have the video removed from youtube. This is what ive managed to find out. Yes and no. if it had no journalistic value or claim and was just a simple video with no context then in most cases they could request it be removed or staff blurred and all this is down to policy not law. Otherwise you wouldn't get documentaries exposing companies with video on their lands or in buildings like from staff etc.

He was Curtis Media his Grans House got turned upside down during the NB episode, what I didn't like about him was he had Paul Ansil in the frame( so to speak) for murder and even put Paul's address on internet. Curtis also went out one night a young lady was drunk he was filming her at a kebab shop she was really very drunk, she grabbed his phone and chucked it on the ground . I believed that was immoral of him to harass drunk person like that. Sure yes his morals are highly questionable however his "investigations " of hotels being used to house illegal immigrants arguably are in the public interest, we need to know what the government is up to. I admire his indefatigability however ,after the cops roughed him up (NB case ) ,most normal people would have given up, he was banned from Lancashire, after that he kept going ,rebuilt his channel got on with it. I have certain level of respect for him, but I might be completely wrong , he is not a tw*t like Nigel is best I can come up with Good video thanks .

LOL, What Investigation of hotels being used to house immigrants? There is no investigation needed as the government announced it would do exactly that. I stay near one of those hotels and there are protests outside it all the time, the arguments make no sense to me as crowds of agitators proclaim that woman and kids are no longer safe in the area, almost as if crime did not exist before the hotel was occupied. And the protestors had the wrong end of the stick as the hotel was occupied by Asylum seekers and not illegal immigrants. People like Curtis look for a story that fits their narrative, the man is deeply unpleasant and has a chip on his shoulder and is looking to blame a group of people in society for his lot in life, but all I see is a racist roided up nonce who sounds like he has a gobstopper permanently stuck in his mouth. I took great pride in contacting that Ferrari Dealer ( a personal friend of mine) to provide the links to his YT channel and let him know how he can raise a privacy strike against him.

@@kindcitizen-oe5ck nobody has ever claimed that crime didnt exist before the arrival of people from foreign lands. This is a complete strawman argument and is extremely dishonest. What is true is that there is often a sharp increase in crime in areas where migrants settle this increase gets even worse with the second and third generations (migrants children and grandchildren). Go to any area in the UK with a high number of ethnic minorities and you will see that crime is higher when compared to other areas in the same region with low numbers of ethnic minorities. This is just a fact of life unfortunately. The less white and british an area becomes the more crime increases, especially violent crime. You may be able to find a rare exception to the rule but this is overwhelmingly true in almost every case.

More than one of his migrant hotel videos were appalling - especially as he encourages racism, but there was one particular hotel, where a young employee pleaded with him not to video him and upload it. Arnold was really enjoying the interaction - he had filmed the guy while he was inside the hotel trespassing, but he was blatantly bullying the employee, almost laughing at the employees obvious distress. It was really painful viewing.

I've watched many of his videos and you're talking utter nonsense. How you can be intrusive in public? And recording peaceful or refusing to take orders from somebody with no authority or right isn't "bullying". Can you give any examples? People are responsible for their own reactions and how they react to somebody doing something they don't like or think is breaking law. Ignorance is no excuse and him giving them opportunity to act good or bad doesn't mean he forced or provoked them.

@@PeterBurt-l1v Yes, because the payment is for advertising revenue, so in that sense makes no difference to KZbin, and it's his own content, not someone else's. However, KZbin can still flag it as 'duplicate content', either due to the algorithm or someone reporting it, and if he makes a habit of it, there is a chance that the video or his whole channel could be demonetised. Given that it is his own content, it would only become an issue for him if he is doing it all the time - i.e. every video or every other video or something like that.

@@Awderuk Except that would be illegal. You have no right to force somebody to move on when on public property. Even on private property it would be illegal unless for defence. Also your claim they're not their to engage in conversatin is absurd. They are quite happy to to explain what they're doing and have civil conversation. However they're not obligated to listen if you're making false accusations or acting hostile. By reacting like you have authirty or right to stop them you are exposng yourself as person they are testing for. There are many good reaction videos too where normal people react in correctly way by asking qustons politley and then letting them get on with their day.

They seem flying a drone is a clever way around tresspass. But unfortunately. As far as im aware buissnesses own the sky up to a 1000ft above their property😂, so im afraid they may ve othwr more serious charges flying a drine above the footprint of a private buissnesses land👍any customers in that private car ahowroom and staff are entitled to privacy as its not public as such form how i understand. But this guy swems polite up till now

Occupiers do own the airspace to the extent required to undertake their normal lawful activities and any interference in this would be an aerial trespass. To my knowledge, the law specifies no fixed limit of height, it's something to be determined on a case by case basis and turns on the facts.

It us d to be above to the heavens and down to the center of the earth. Otherwise people could build a basement under your property or a overhang from a neighbouring adjacent property and have it over hang you property. Do you not own land? Check your rights 3 dimensional ask your solicitor. Above a certain hight that for airspace now planes and commercial flights. That's why you can fly a drone on your land. You could do a legal Google search . Because you think doesn't make it true.

To my knowledge, the law specifies no fixed limit of height, it's something to be determined on a case by case basis and turns on the facts. To add, the Civil Aviation Authority (CAA) does not 'own' airspace, merely regulates and authorises activity in airspace. Who actually 'owns' per se the airspace at any particular height and what is permissible at any height is not necessarily a black and white question because, as explained, it depends on (amongst other things) whether an activity interferes in the normal lawful use of the land by the occupier. In practical real world terms, a drone operator could go ahead and fly his drone over commercial premises on the basis that this is permissible under the Drone Regulations, but this is not the only consideration in law because it is possible to commit an aerial trespass even when the flight is otherwise compliant with the Drone Regulations. There is however some overlap between the Drone Regulations and trespass law. I've actually gone into this very issue in my videos about DJ Audits and BP Visits. As well as trespass, you also have to consider general criminal law, including public order offences, breaches of the peace, harassment, maybe even communications offences, and some of that will entail civil wrongs as well.

Can you just remind me please of what “ civil” means exactly, when applied to trespass. I know it means it’s not criminal, so why do the police say some things are not a crime, but say other things are “civil”. They’d say eating crisps in public is not against the law, but they don’t say eating crisps in public is a civil matter. Just curious. You sound like you know. Thanks.

@@StraightOuttaUrbex You clearly don't know the ins and outs of it. First, if I recall it right, I did not accuse him of aggravated trespass. My reference to that offence was in reply to you, not the video. However, on reflection, I think he was committing an aggravated trespass. See section 68 of the Criminal Justice & Public Order Act 1994 for a definition of the offence. Second, aggravated trespass does not require that he refuse to leave (though that can be an ingredient of the offence). Turning to the video, he did fail to leave when asked, and though I conclude he was trespassing from the outset, a condition of him being permitted to stay was that he should seek the consent of anybody he photographed, and he did not do so, therefore he was trespassing just on that basis. I gave him the benefit of the doubt at the beginning, but I was being extremely generous in doing so.

The exemption is for journalism not journalists - an important distinction. He is not carrying out journalism. Please also note that a journalist (or his employer) has to register as a data controller if he processes personal data.
