In VA, it's illegal for our guys to work on duty unless they're wearing OUR patches. The only way around it would be if the other agency hires our guys as direct employees, W-4 and everything, and pay them directly. If they come work for us, they have to wear their employer patches unless we hire them directly. I wish that they'd change that rule here because I agree with you.

I agree, even with the clients when I pitch an idea I say “hey in just here to solve problems, if you like the security company or officers you currently have. By all means stay with them, I wouldn’t want someone undercutting me. Only if you have legit issues and are wanting to switch will i pitch” class and respect are key Also if a client is willing to do that - they aren’t worth it, neither is the other company If they try and steal your client and not help, it will come back God loves humble people. I help out my old boss with work all the time, and I agree it's not appropriate to be using you're own uniforms if representing another company. I have uniform shirts with just security on them for this reason

Just remember, at least in florida, you must wear the company patch you are representing. Your license is in jeopardy if you're caught without the company patch.

Good info. However it may depend on the contractual agreement and laws in your state. For example in GA the state requires that you work for a company you are licensed under, and wear that company patches. If I have my officers working at another company’s site they are protecting then I must have a sub contract agreement with that comoany. Also, if I am the company that has the agreement with the client then I will have within our contractual agreement that stipulates I may subcontract to another company for additional help when needed. Also, as it relates to your officers quitting after forming their own agency and then taking your client. In your contract it should stipulate that your client cannot do business with your employees or subcontractors for at least a year after your contract terminates. Just a few things to chew on .

Well commander I only go by Texas rules down here for the uniform there lenient with some stuff just depends on the situation but here the rule for the 37 Tex. Admin. Code § 35.14 - Security Officer Uniforms (a) All commissioned and noncommissioned private security officers shall, at a minimum, display on their outermost garment the name of the company by which the security officer is employed, the word "Security," and the last name of the security officer. These items shall each be of a size, style, shape, design, and type that are clearly visible by a reasonable person under normal conditions. (b) Subsection (a) of this section does not apply to a personal protection officer while performing personal protection services in plain clothes.

Wow, you really NEED to read FL statute 493 in the applicable administrative code. FL Statute 493.6305 clearly states " licensees shall perform duties regulated under this chapter in a uniform which bears at least one patch or emblem visible at all times clearly identifying the employing agency" so unless the other company hires you directly as a W2 employee (you cannot work under a 1099 as a licensed security officer), files an employee action report with the FDACS officially hiring you and each officer and places you under their workers comp what you just stated is not only a violation of your license but a misdemeanor offense. Additionally the client would have to sign your contract, there's is no mutual aid for Florida licensed security companies, the only time there is an exception would be when the Governor of Florida declares a state of emergency.

Hello Sir First Apologies if my comment came across Kurt. I would respectfully request you to clarify this in your video or posting so that a new agency operator / license holder does not find their officers and self in violation of their licenses. Working alongside other agencies is a great thing however day to day you should be wearing your agency uniform as required per Florida Statute 493, your insurance requirements and Florida workers comp laws. You can work under a subcontract only if the original contract holder has a limited power of attorney authorizating them to hire upon the clients behalf. I would also highly recommend checking the company you're working unders insurance while wearing your uniforms to ensure they cover subcontractor liability. I would make sure they cover you as an additional insured with a waiver of subrogation. That is just my unsolicited two cents
