Thanks for the awesome information, we can never have too much of it! It’s a different feeling in our country right now too, we in Oklahoma had a guy from Afghanistan get caught planning his terror attack on Election Day where people were voting. It’s easy to find to read about. The number of people that have snuck into our country that hate us the last 4 years is unreal. So it’s more likely that some of us may see something messed up like that than any other times in our lives.

@@1611KJV No. The self defense liability insurance offered to USCCA Members (through the UFCIC) has never dropped coverage for any of the USCCA Members that I’ve represented. The USCCA is a leader in this space, and has been for years. Many of these negative stories are being generated by younger, competitor companies (i.e. companies with conflicting/competing interests).

I was looking at 18 years in prison in a self-defense case, and i didn't even have a gun. My public defender and the prosecutors were both horrible. I had to take the stand to save my own life. 3 years of my life lost stressing as they charged and dropped the charges several times. And then the trial. In a different state where i was on vacation so the air travel broke me. The prosecutor called my work and tried to get me fired. After my innocent verdict, they did fire me for missing work due to being at the trial. Compete hell, and to this day, i still don't feel like i won anything because I didn't. I just suffered less than I ultimately could have😢 We need better protections in this country for self defense!

It is super simple. Shut up and get a lawyer. That police officer is not your friend. Yourself speaking while you are in full panic mode is not your friend. Say something like "i was afraid for my life and i want my lawyer" or "i acted in self defense and now i want my lawyer". That's all that police needs to know.

Life in the courtroom is scary. I was a juror on a murder case this past spring in Texas both the defense and the prosecutor had no idea what they were doing, the police didn't understand firearms even.. 12 people saved the day.

@@rokkudaiit’s true. I served in the Marine Corps and went on to serve 40 years in law enforcement. I probably saw at least half barely pass qualifications and need to be closely monitored for safety issues. They were mostly college graduates who never touched a firearm. The former military police officers are usually much better at safety and accuracy. They have a broad understanding of firearms. I’ve witnessed so many accidental shootings some permanently disabling the officer that I was part of the first range instructors who required ballistic vests while on the range. So yeah you’re correct. The few active shooter cases I was on scene for, my second biggest concern was crossfire. Some of those officers had zero situational awareness. I wish it was better but it’s a reality.

Reminder that USCCA will drop you the second you’re charged with a crime. Read the fine print. Be a member if you want, but always retain a good defense lawyer. There are memberships for that too. USCCA is no such thing.

@@troy3456789 yeah you can go with them if you’re comfortable dealing with a organization that’s out of state, assuming you don’t reside in AZ. I haven’t vetted them myself. It’s certainly among the most affordable options and I know they link you up with a local attorney. However, it’s probably not as good as establishing a professional relationship with an attorney practicing in the county where you reside. To be clear about USCCA, there is plenty of value in the service for the money you’re spending. Their news letter and training resources is probably the best thing about the service. But most people sign up assuming that they’re “covered” in a self defense scenario. I just believe that’s a misrepresentation of their service. “Covered” is vague in scope and broad in translation.

How far down the list are you? Self defense incidents with insured trained USCCA members are not frequent. If a couple other attorneys are in front of you they may be getting the cases. I have a different insurance provider. My lifestyle dictates its highly unlikely I will ever use it. I am aware of an attorney in my state that handles cases for them. He is not swamped and he is fairly high profile criminal defense attorney. Most do not involve actual shootings. Not many self defense shootings in my area. The ones there are don’t seem the type to carry USCCA type coverage. Only reason I know is because charges were declined and it made news.

Me: 911 Please send police and hurt wagon to address, then hang up. Police: Do you need to the paramedic? Me: Yes Detective: Miranda Rights read, then so let's talk about tonight, what happened? Me: Am I being charged? If so, I want my lawyer, if not, I want it in writing from DA and signed then we will talk.

Most of the time in any self defense case you get charged right away with something anything. You ran a red light to avoid the contact with a road rage incident then you had to shoot well guess what you just got charged for running the red light and then fired on someone it is included in the case dropped. Watch some videos about the difference in AOR attorney on retainer compared to USCCA

USCCA dropped 15 people in 2023 for loophole reasons. They will not help you! They are an insurance company first; they will do everything they can to keep from having to pay.

Great interview! Dave is the real deal. A huge percentage of my IT clients are lawyers, so I spend a lot of time talking to them and bringing up self defense law whenever I can. Although anectdotal, I spend a lot of time educating myself in 2A and self defense law and have come to the realization that I wouldn't want to be near a courtroom with 95% of them in a self defense case, even some who are friends. It takes someone like this, who has slogged through years of these exact kind of cases to be able to represent you effectively.

District Attorneys are politically motivated, not by justice. A crime involving a gun is a way to make a name for themselves! Victims are charged immediately with one or more felonies, that if they win will remain on their record. They can not recoup the costs of defending themselves, so attornies are more likely to NOT represent you! The "system" is flawed (~95% of cases are decided by plea), as clearly pointed out!

Tell them you were attacked, be upfront about that! Some guys were silent for days in jail until they said that, then the evidence matched the story, then police released them. Also stay a long way from dei cities.

Get something. Just for representation during the interview if nothing else. You can choose your attorney on most of these plans. Pick a high profile criminal attorney. Few attorneys can make a living just handling self-defense cases in a small geographic area. Too infrequent so its likely going to have to be a competent criminal defense generalist.

I recall reading about a case, I believe out of Phoenix, in which an incident involved an admitted self-defense shooting in which the person who defended themselves was nevertheless convicted of discharging a firearm in an unsafe direction because there were buildings behind the perpetrator. Understand, no other than the perpetrator was struck by a bullet; And the perpetrator was armed and shot at the defender. So, apparently, the law requires the victim in the moment they are being shot at and their life is at stake should not shoot back if there is a building (i.e. a place where normal people would regard as a place to hide from shooting) is in the line of fire, in a city, which is comprised of buildings 360-degrees.

I used my 2A tool. My public defender was working for the prosecutor. When she said it will save the county lots of money by not going to trial. Disorderly was dismissed. Pled on the obstruction charge. Wife recently had radical hysterectomy & I would walk out without paying anything.

This talk is awesome Colion... I've never shot a firearm, but want to get into it as a sport. Having said that, I just bought my first rifle to get started. I plan to take a three day class to learn firearm use, in addition with self defense classes. My first step- getting insurance before actually shooting and joining USCCA. I love experienced advice, and this is top shelf.

I also recall the prosecutor commenting about the defendant in the Trayvon Martin case that the defendant had suffered a wound from his head being pounded on the pavement that would only have required a bandaid, suggesting that he was required to wait until he actually suffered a life-threatening wound before he was entitled to use his firearm to stop the attack.

If you are found guilty, even if it's self defense and you can repeal with uscca. You have to pay back the fees, they're an insurance company, not law ferm. Heavy duty country does a good break down on it, attorneys on retainer looks to be a better option.

In my ACC class the prosecuting attorney advised us to only say that you've experienced a traumatic event and not in an emotional state to speak to anyone at this time and request a lawyer. Unfortunately you'll be pressured to talk by law enforcement but remember that anything you say will be used against you in the court of law. Be respectful to responding officers but stand firm on your right to remain silent until your lawyer is present even if they suggest that only "guilty" people say that. He also said that don't be surprised if the family of the attacker will lie, claiming that they are grieving over their "angel" that wouldn't hurt anyone while in court. Be smart, play your cards right and don't give any incriminating evidence to the prosecutor who can turn it around and make you look guilty while you exercised your 2nd amendment rights legally to protecting yourself and your family. They'll try to turn it around to get a conviction no matter who was right and wrong so it is best to not talk and give any bogus "evidence" that will unfortunately waive your rights and put you in prison for a manslaughter charge 😏

Our legal system is now so messed up. Much stronger protection for most criminals and very little protection of someone who must protect themselves.The very idea of actual justice has been pretty much lost.

Letter and semantics of the law vs. Natural law and the spirit of the law. God gave us the right to defend, not murder. Murder is what criminals do defend is something law abiding people do.

I self snitched on my self when I was accused of aggravated assault in Pennsylvania as an armed guard! Despite the cop never recorded my self snitching, & the "victim" vanished, but they seized a defense tool, the police had to release me from police custody! Imma go get my property back from their custody which requires a hearing!!

Thanks for this. We (for a few years more pending retirement pensions) live in California though not in a big Blue metro. Still, if I ever have to use a firearm or even pepper spray in self-defense, I fully expect to be arrested and charged. That is life behind the Iron Curtain: "Show me the self-defender and I'll show you the crime!".

You have the right to remain silent whether you've been read your rights or not. When you're stressed and still hyped on adrenaline, it's not only a right, it's a good idea. Ask for a lawyer and use that extra time to calm down and gather your wits.

Why isn't it applied both ways. In 2003 my father was shot to death by the police in California on the 911 call my family made to get my father help before he was shot they said if they were too come they weren't taking him alive well they showed up and did not take him alive they shot him to death right in front of my little brother ,my grandmother and myself there was a 20 million lawsuit for wrongful death we moved back to Michigan with my mother and our grandmother uncle and Aunt were taking care of the lawsuit four years went by to be told if we wanted something done we had to do it ourselves. I have discovered a newspaper clipping that said the lawsuit was decided suicide by cop March 20th 2003 when the incident took place March 8th 2003. Which is a lie because we didn't even have my father's funeral yet so someone's lying about something I reached out to attorneys and they can't help me I looked up police records court records and can't find anything.

You covered my self defense shooting in Houston humble tx im still waiting to hear from the courts for a gran jury it’s been since 2022 and not a word back it’s 2024 now almost 2025 it was labeled as justified homicide so im confused

An hour long commercial for uscca...people need to Google all of the cases the uscca denied coverage to its members. Better look around for the best coverage...and please, READ THE FINE PRINT!
