By my count, Turtle McConnell stole two SCOTUS seats from the Dems. The first one by saying that Presidents in their fourth year in office shouldn't be nominating a replacement for SCOTUS. This was after Scalia died in February 2016, and Obama nominated Garland. The second one he stole was when he went back on his previous assertion, and immediately pushed through Amy Coney Barrett before Ginsburg's body was even cold, when she passed away in September 2020. Consider this too, that Turtle McConnell gets his judges from The Federalist Society, headed by Leonard Leo, the one working behind the scenes for decades to overturn Roe.

Finally, with respect to civil liability, the Court held in Nixon v. Fitzgerald that the President is absolutely immune in actions for civil damages for all acts within the outer perimeter of his official duties.15 The Court’s close decision was premised on the President’s unique position in the constitutional scheme, that is, the Court conducted a kind of ‘public policy’ analysis of the policies and principles that may be considered implicit in the nature of the President’s office in a system structured to achieve effective government under a constitutionally mandated separation of powers.16 Although the Constitution expressly afforded Members of Congress immunity in matters arising from speech or debate and was silent on presidential immunity, the Court nonetheless considered immunity to be a functionally mandated incident of the President’s unique office, rooted in the constitutional tradition of the separation of powers and supported by our history.17

As someone working in the legal system, freaking this! Judges must be accountable to the people.
@valstewart66613 ай бұрын
@@andrewgause6971as someone who works in the legal system, you should know that ALL presidents are granted presidential immunity for official acts as president BECAUSE they are held accountable through the impeachment process. This rul8ng was per the Constitution, not the opinion of the left. SCOTUS' function is to interpret the Constitution and according to precedence set by landmark cases. SCOTUS is NOT supposed to be political. Every justice is put through very rigorous questioning and voted on by BOTH PARTIES for that reason. You don't get to dispute them and throw a tantrum when their ruling doesn't go your way.
@itskarl75752 ай бұрын
@@valstewart6661 That's such a load of bull. There has only ever been immunity _so long as the president is still in office._ The immunity expires once he leaves. Except, now SCOTUS has declared that this immunity is for all time. And has erased any lines between official and unofficial. For example, in the ruling, the GOP justices stated that even an act of speaking to or on behalf of the people, could be construed as an official act - even if it had nothing to do with the president's official duties. Nixon would have loved this ruling, because it would have meant he couldn't even be _investigated_ in the first place. As it is, Nixon got an immediate pardon by Ford - which would have been completely unnecessary under today's "interpretation" of the Constitution, which renders impossible the accusation of "abuse of power" if levelled at the president. All of SCOTUS's arguments are antithetical to the Constitution, and counter to any and every reasonable expectation of the highest office. One of the arguments was that if the president lacked immunity, he might hesitate before committing to certain actions. Well, duh - that's a GOOD thing. If he is about to break the law, that is a _very good reason_ to have pause. Worse still, with this ruling, even _evidence_ is inadmissible if it derives from anything remotely approaching "official acts" whilst in office - even if the crime itself was committed before or after presidency. There is nothing good about this ruling, and you would 100% agree with that had the shoe been on the other foot. If it turns out that Biden did in fact attempt to assassinate Trump, he would be immune. Even if evidence somehow surfaced while he is still president, you need a majority in the HoR to impeach - and a super-majority in the Senate to find him guilty. Good luck with that. Especially as this explicit immunity could be viewed by Congressmen as grounds for voting no/not guilty. Even _that_ hurdle is difficult enough to pass, but what if evidence only surfaced _after_ Biden left office? How are you going to impeach him then? And remember Mitch, you know, the guy in this clip here: he stated loudly and proudly that Trump WAS guilty of instigating 1/6, but he voted "not guilty" anyway - because he argued it was a matter for the courts, _not_ Congress. So how do you like them apples? That's some handy catch-22 right there. You're right about one thing: SCOTUS is not supposed to be political. But they are. A 6:3 majority is not healthy in the best of times, but several of these judges are pure MAGA.
