It's not the end of the world, and he doesn't actually seem impaired, so what is the officer going to "go off of"? Does he seem drunk to you? He got busted for possession and refusal, got taken off the boat so he wasn't driving, just in case, so it's not like he got nothing. What's the point in being polite and respectful if the cop is still going to tack on every single charge he possibly can even though you don't seem particularly intoxicated? Basically without clear signs of intoxication all they have is that he was in possession and he refused tests, charging him with intoxicated boating would basically be arresting him on an assumption, and the charge would probably be dismissed anyway, especially since the father clearly knows what's up.

Absolutely wrong. Breathalyzer devices are not foolproof. Many have as high as a 50% inaccurate rate. NEVER submit to field sobriety tests, especially if you are innocent.

The cop wants a precise inventory of what's on the boat otherwise it's RAS. I don't know if anyone would have been able to rattle off an itemized inventory of what was there. You and your friends are on the boat drinking the night before, you bring alcohol, they bring stuff, the end of the night comes everyone leaves ... Not one single person would have been able to say what was on the boat.

@@Ray56z Field sobriety tests are absolute garbage. How many videos can you find in the next 5 minutes where a field sobriety test helps them??? If LE wants to accuse someone of being under the influence of alcohol and they have probable cause, bring a breathalyzer. If they have probable cause to believe they're under the influence of other drugs, arrest them and give them a blood test... but if they're wrong, they should be held accountable.

Untie the line, you've made an implied contract with the state, FWC, and the USCG to follow the laws on the water. Not hard, I do it 50-70 hours a week on the salt, another 15-20 on the river, my backyard mown grass goes to it's water line. No buzzkills for anyone of age while the Capt. stays sober. Next time a different Capt. takes the helm, party on if that's your goal in life.

As a long time boat owner, I know how fast things go bad. I’m furious with this encounter. Especially knowing this kid has multiple prior boating offenses! But, hey maybe I care about these kids more than the dad. He didn’t even blink at the fact that his 16 year old was out on a boat that isn’t equipped properly, loaded down with alcohol, and likely had been drinking. What should we expect?

For "likely had been drinking" the kid seem pretty sober to me. So sober that the cops couldn't even find the indicators they always seem to find, slurred speech, red eyes, watery eyes, the smell of alcohol coming from him, nothing. I'm with the kid on this one. Give him a verbal warning and a bit of education and he'll be fine. (Oh, I thought it was one prior.)

@@Isaac_132 #1 he’s SIXTEEN #2 if he weren’t intoxicated or at least thought he might be, he would have given a breath sample #3 he gave conflicting info about his dad having had the boat out that day-he lied. Listen if this dad doesn’t care about his own kid, he should care about the other people on the water enough to get his kid in line. No 16 year old should be in charge of a boat while drinking. So your, just dust him off and send him on his way message… he’s had multiple prior boating offenses involving alcohol, is ludicrous.

I've been anchored, 3/4 mile from the channel, fishing, sober while 3 friends were drunk, had a near event, was preparing while the friends were mouth agape just watching the 70 knot danger coming.
