Lawyers exist for a reason. Kid is rich enough to drive a boat… if he refuses the field sobriety tests and gets a lawyer, he’s out of lockup by 10am and the boat is recovered by noon. After seeing these tests, even sober people should refuse the test and call their lawyer. Everyone in America does field sobriety tests which are essentially self incrimination.

I was surprised that they stopped at a porta-toilet. And further surprised that they allowed him to close the door to the porta-toilet. I thought they would hold it open a few inches while he turned around to pee. I don’t think they would do the same for an adult male. I have seen shows where female cops held doors to indoor toilet stalls open while female arrestees peed! It is just rare to see any such privileges granted to handcuffed arrestees!

I had a teacher at boarding school, who said that he wouldn't tell anyone, if I told him where my drunk underage friends were at, but that he needed to know. I was taught to respect and trust adults, especially teachers. I would never blindly snitch on my friends. As soon as I told him, he said "sorry man you're all in big trouble now". Well, the end of the story was that we had a hearing in school where my friends and I were punished for drinking. In the hearing I told everyone what the teacher had told me, i.e. that he wouldn't tell anyone, if I told him. It ruined his reputation with the other teachers for years to come. What goes around comes around.

As the captain of my friend group (22-25 years old) I completely agree. I used to drink and try and have a good time with them. Took me 1 good scare from the coast guard during a very busy weekend on the water, and I haven’t had a sip while floating since 2021. Sucks that the kid had to learn this way.

And tell them you're refusing on advice of your attorney. 3) refuse to answer questions without your attorney present 4) if you are arrested, don't blubber like a child. Florida does have implied consent for BUI, but you only get a fine for refusing. You can still be arrested for suspected BUI without ever submitting to a test. But the officer needs probable cause.

There are no penalties for refusing the field sobriety test, though the fact that you refused to be tested can be used against you in court which is why you should tell the officer you're refusing on advice of counsel.

@@notpublic8961 I know what implied consent is. On the road, you have already given the state your consent to a chemical test when you got your license. If you refuse those chemical tests, your license will automatically be suspended in most states. You can also face fines and even jail time. You do not have to consent to field sobriety tests, but the officer can still arrest you on probable cause for smell, eyes, driving, and other indicators. Once arrested, you have to submit to the chemical test. I always recommend not taking the field sobriety test. It will hurt you more than it helps you. This is different from BUI (boating under the influence)

The answer is yes, the FWC has the legal right to look in every compartment and cooler of any vessel if they have probable cause. So in this case the officer smelled alcohol, saw many underage teens, saw signs the "captain" was impaired, and saw litter (alcohol containers) in the water around/behind the boat. So at that point, the FWC officer had every right to check all compartments/coolers.

That's a CYOA measure, just like reading the Miranda Rights from a card, it so there's no room to interpret if he said everything necessary. Mess up a Miranda Warning, testimony can get thrown out, mess up the instructions to the field sobriety test and then it can be inadmissable. And when the officer goes to court he can produce the card/instructions to show what he used to recite what he spoke (memory can be called into question or given doubt).

They didn't seem that hard. The last one was kinda excessive but as long as you pass the more basic tests and then miss one or two instructions on the harder ones, you'll probably be okay. I don't know for sure, but they do multiple tests for a reason so I can't see them failing you completely for missing an instruction on one of the tests

I checked out several FLA attorney websites There is no approved SFSTs for boaters for obvious reasons.
