Dorkly would be well within their rights due to fair use parody, but Nintendo would, if their track record is anything to go by, bury them in lawsuits until Dorkly gives up because they can afford to pay the lawyers. That basically what any company does, "It doesn't matter if we're right or wrong, just so long as we have more money to spend to bleed the other guy into giving up. We win by attrition."
