I am guessing that Schardt had the FedEx video enhanced. He just cannot introduce that until his case in chief since the video enhancer’s credibility as an expert will have to be proven in front of the court. He already knew (based of his re-cross) that Drinks had let off the brake and reapplied it after Shannon was gone and the state is foolish enough they think he is trying to prove someone else was in the car shot drinks stopped the car and then put it in park. Schardt has clearly made sure the jury knew the car was not in park and established with first officer on scene that the officer out the car into park. He sowed the reasonable doubt, and stopped short of pointing out Drink’s car moved after Stilwell left the scene (which is why this medical examiners testimony was so helpful to him), as he wants to point that out on the enhanced video and he knows that if for some reason he cannot get the enhanced video into evidence he can still use the states video to prove it, it will just be harder for the jury to be 100% certain without watching it several times (and state can object to him playing it several times).

what is the significance of the foot not being able to be moving on and off the brake?

I saw on another channel the brake lights lit up a couple times after Shannon and the car behind him had already left. It's when the 3rd car is beside the victims car. I think that may be why they are bringing it up.

Because the medical examiner testified immobilization would be instantaneous. So, if Stillwell was the shooter, Drinks would not have been able to move. Yet, the car rolls a little when Stillwell pulls off, then a few seconds later we see brake lights go on and off while the 3rd car is now next to Drink's car. Schardt is making the point that, based on the ME's findings, it would be impossible for Stillwell to have been the shooter.
