Gaza wasn't being occupied by Israel they had unilateraly withdrew in 2005 so what was the justification for that incursion? As for the occupied territories in the West Bank. Israel IS allowed under international law to occupy that part of the West Bank as a means of defending themselves from the Palestine Authority, who by the way are constantly bombarding Israel with rockets and committing terrorist attacks. Further more technically speaking Palestine is not a Sovereign State since they have consistently refused Statehood, which means that since Jordan relinquished all claim on the West Bank (which they occupied after the 1948 Arab/Israeli war ), that territory isn't just the Palestinians any more than it's just the Israelis. The Israelis have been living in the Levant for 4000years. Palestinians weren't even called that until after 1967. Those living in the West Bank were Jordanians and those in Gaza were Egyptians. Basicaly those areas were in habited by an amalgam of Arab tribes. Back to the matter in hand. What Hamas perpetrated on the 7th October and what they are doing using their own citizens as human shields are most definitely crimes. But to kill the leaders of your enemies in a war most certainly isn't.

It isn't a criminal offence to defend your country from that kind of attack nor to kill the leaders of those who did the attacking. What is a criminal offence is to maraud into another country and carry out a terrorist attack. What is also illegal is for those terrorists to take hostages as a means of staving off reprisals. What is a criminal offence is to also use your own citizens as a shield to protect themselves from those reprisals. Also it is not deemed a criminal offence by the UN for a country to occupy a territory to protect them selves from attack. Which is exactly been has happening to Israel for decades from those living in not only Gaza but also the West Bank. There have been daily rocket attacks and many, many terrorist attacks.
