Or he really doesn't know anything. Anyways, if what his says is true and he knows all this information, I'm pretty sure client attorney privilege doesn't apply. At least to the extent that he cannot knowingly let his client perjure himself. What he can and should of done is contact the ethics board and discuss it with them. They can tell him what to do. CYA
@beautifulsurprise9424
@beautifulsurprise9424 Жыл бұрын
Attorney-client privilege most certainly applies. You can know you client is guilty but if you allow them to testify and lie then you're in trouble. Which is why most defendants don't testify. So yes you're right you can't allow your client to perjure themselves but the way around that is to not allow them to testify. Also, if you're client revealed to you that they are in fact guilty you cannot then tell the world years later and inform everyone of what he/she revealed to you. That is a breach of the privilege between attorney and client. The client forfeit the privilege and start telling people what he/she disclosed to the attorney and then the attorney can discuss it but if the client doesn't forfeit it then the attorney is bound by the privilege of attorney and client and cannot reveal that information.

A moral obligation to tell, and a legal obligation to keep his mouth shut. In such a conundrum, considering that he's over 70 years old and has lost his license to practice law, he should probably lean more towards his moral conscience than his legal ethics at this point. He won't hurt himself or anybody else with this information, but he will help Stacey's family.
