As if that were a possibility. No one who believes in government knows what right and wrong is because to one degree or another they believe that legislation can turn bad into good. They do nothing to challenge the underlying belief of statism: that there can be a rightful ruling class, which the rest of us have an obligation to obey. As a result, they do nothing to solve the problem, but actual reinforce it, by using the very terms and rituals which imply that pieces of parchment (including the Constitution), elections, and politicians scribbles, really can bestow upon mere mortals the right to rule. Until that utter lie falls, we will never see freedom.

Look you got a good point in the attorneys got a good point in the city went overboard but let's not forget this guy is a habitual offender and he has no intentions on changing his tune in fact he warned us that because he's getting older he can't cut grass anymore but he's not making provisions so that the grass would no longer be an issue as a responsible citizen and neighbor notwithstanding the health concerns with snakes and rats he's got the address the issues responsibly. With that I ask you if you were on the city council what would your solution be?

@@TruckTaxiMoveIt, First, I'd ask the council if it is enforcing against an actual, genuine public nuisance, or an ordinance seeking to maintain a certain aesthetic. You speak of rats and snakes, and I keep an open mind that your area might be unusual in that foot tall grass does not do much to attract these things in most places. If it was a truly genuine public nuisance and not just unsightly, which I still doubt, I would follow a script like the example below. But before that, I'd ask the council if the regulation is regulating aesthetics or genuine public nuisance because the difference is huge. The 4th Amendment expresses the right to keep your property untidy, but it does not withstand a charge of public nuisance. In example, HOA's bridge people's property rights by requiring each owner to subscribe to their covenants as prerequisite to purchase. So too similarly it should be for every local government that seeks to impose an aesthetic requirement. Simply mandate that all property buyers must be notified of these regulations they will be held to account for, before any sale can be recorded. I'd give one free warning with generous time to comply. (I note that infestation takes time to develop, and rats and snakes do not tend to coexist, at least not for long.) Then I'd apply one fine not more than $100 with one more lesser amount of time to comply. Then I'd hire a gardening service to do the job at a standard rate and send the bill to the owner with an additional administrative fee of say $20. Then, if the bill goes unpaid, I'd attach a lien to the property After all this, when the nuisance exists again, I'd repeat this process minus the free warning if within the same twelve months.

It used to be a public thing as an example to everyone else what will happen to them if they do what is evil, "take it from a poor sinner who's got no more cause to lie" "I don't care how you slice it, wither it's a judge in robes behind the bench or a bunch of men and a rope, those boys will be just as dead as if they'd been lynched" "Only they'll not have been lynched they'll have been judged and if you can't understand the difference then you better take off that badge and right now"

I found Dunedin just by chance while on a trip to Florida. My wife and I were considering buying a retirement home there. We loved the waterfront, small downtown, and the area. First the parking meters showed up downtown, now this. Sad ,it appears to have a lot to offer, but some of that charm is gone for us.

Do as I say not as I do. I bought a tax foreclosed property last year. It was owned by the state government for over 6 months. When I got the property the lawn was basically a field. The State never mowed the property even though they took it over and legally owned it. In this guys case, this is ridiculous. The City government should have mowed it and sent a bill or implied reasonable legal fees on him.

My first thought on this: Why does the city want this property? I grew up in Dunedin. There are a lot of older homes that may not 'fit' the cities idea of an upstanding community. Sounds to me like they have another agenda here.

John Stossel found out in 2006 the city collected $34K in fines. In the year 2016 the city collected $1.3 million in fines...the more you know.

Let me ask you couple of question...if your old man neighbor was having problems making the other neighbors happy with his yard work..would you report him or help him ? (that really defined what type of person you are) ...second question how much does a yard mowing habitual offender affect your life your ability to feed your family, pay your bills or just get in your way of life.( stops you from doing nice things with your family)...See you spend your energy trying to take elderly home..I spend my defending elderly homes homes...we're not the same.

@@TruckTaxiMoveIt It doesn't matter if it's been an ongoing issue. The city is not entitled to excessive fines and it's not entitled to his home. They have more sensible avenues of recourse such as sending a city employee to mow the grass or hiring someone to do it and then charging him for it. Then if he refuses to pay for it the city could put a lien on the property. It's as simple as that.

I like that facetious phrasing, but let's look at this from the neighborhood and municipality's perspective. Let's be reasonable here at what point does the grass growth become overgrown to you: 5 inches, 6 inches 7 inches? After 10 inches now things like rats and snakes can roam free, and of course after 10 inches the grass would start to seed. trying to mow the lawn with a regular lawn mower at this point is foolish -- you need a commercial lawn mower. If the city didn't get on them he wouldn't do anything It would be in the best interest of the city the neighborhood and him if he just got a wife -- she would make sure that lawn is mowed long before she would get embarrassed because of it

I had something similar to this being threatened towards me by Floyd County Georgia. There was a tornado that ripped a hole in the roof of the house. Debris all over the place and my contractor called me and said the county stopped by to talk to the owner because they said the grass had gotten high. I was out of town and called the "officer" and he threatened me with fines. I reminded him that you can barely see the lawn through the tornado debris. He then threatened fines for the debris. Keep in mind, the tornado had only hit a week before. Come to find out a local contractor that I didn't hire had most likely called them to start crap. The "officer" didn't like me calling him a 'lawn cop". I guessed I bruised his ego. Once I threatened to get a lawyer and also go to the media, they stopped. Still the "officer" would lurk around reminding us to get the lawn done once the repairs were done.

When did we become a city where a resident has no one, friend or neighbor, to help out in a pinch? When we moved here years ago we did many chores for the neighbors but that is no longer the way things work here these days. Neighbors are more interested in policing one another than helping. the people responsible for the fines need to be held accountable and never work for public services again. often times those people profit with these twists of laws and fine print and stain a company or government they need removed/ identified. no accountability they simply move to another agency or company and continue their piracy acts or treason.

Some code enforcers will use common sense and work with home owners. Unfortunately, there are a surprising number of code enforcement offices and officers that lack respect for the rights of individuals. I hope the courts put the smackdown on excessive fines... again.

I mean I guess it *could* be a public safety hazzard. Especially in Florida, if the grass is left uncut for long enough it could become a breeding ground for snakes, rodents, etc. which will then become a problem for neighbors. Doesn't mean the government should be able to steal the whole damn house, but my point is there is a very good reason to have laws or ordinances regarding maintenance of landscaping in a neighborhood environment.

@@davidisaacson5993 that is a poverty. I was lucky enough that I got 50 years with my WWII 82nd Airborne Trooper Granddad. He taught me and my Brothers how to fish, shoot, and make camp. He did allot more than those things for us. He DID instill a strong work ethic in us, and he taught us pride in ownership by taking care of his property. Men like him, are sorely in short supply in todays world. Me and my Brothers try to serve in the capacity, in his memory. The Dunedin group of commies would have had his ire up, not because he didn't cut his grass, but because of the unreasonable treatment they put on this man. My Granddad was a fierce neighbor, and a good community member. I can remember him mowing for others, when they had health issues or other misfortunes and he said it was just what a good neighbor does. These people are despicable examples of alloof government bureaucrats. And they need more than tar and feathered.

Ya We here in my micro Oklahoma town are heading this way to because the big city Dallas suits are buying out homes here and getting on the TOWN not CITY council and forcing " clean ups " of "trash " like 1940s to 1990s cars and trucks that have been in some of these yards being drooled over for decades . Just because they do not run does not mean they are trash . These suits backed the blow up of the legal pot industry here on purpose . Now they are coming in and killing our way of life not adapting to us and it makes me sick . We are so small we just got our first donut shop and also a laundromat . We still have some people that do not have running water because the water company refuses to put water meteors onto there land . Yet they find cool ways to get around it and be happy. If they can do it and live happy on low income and are ok I say leave there land alone leave them alone and leave there cars alone . I hate city BS .

Pave over it, manicure it and profit from it (tourism) has long been Florida government's goal - no matter the side of the isle. At this point I'm hard pressed to even run into a lifelong old timer that remembers Florida's true roots.

I heard about this case I didn't know he was a habitual offender nevertheless the city should have mowed the lawn for him because it's not only for him it's also for the Neighbors. The Foreclosure action is just ridiculous

This man has lost his case twice in federal court. Dunedin has since changed their fine system, but it doesn't do him any good. I just checked Google street view. There's a recent scan showing that the grass is still high and there's a cargo trailer parked in the front yard. Clearly Dunedin doesn't care as much anymore since they've taken the profit out of it, or maybe there's new ordinance officer that is more reasonable...

Short Description: Unconstitutional Ordinances and ineptitude. Detail Analysis: An easy case of City Council overstepping its boundaries. Some ordinances involving private property are necessary such as property lines to prevent future disputes. Let's be very clear, the height of the grass on private property isn't one of them. Violation of 1st Amendment, freedom of expression. The owner may choose the preferred height of the grass and choose not to cut it is an act of expression. 8th Amendment protection against excessive fines, there seems to be no cap or exceedingly high $100,000 or more for things that the city has no right to make rules on. This is not just an issue of excessive fines as the ordinance is not even legitimate, violates too many Constitutional rights. 4th Amendment protection against unreasonable seizures, shall not be violated. Foreclosure over an unconstitutional ordinance clearly counts as an unreasonable seizure (house being taken away). This HoA style action indicates the city council is pursuing personal agendas on private property, using city power, and may not qualify for immunity. This ordinance shows signs of apathy, ineptitude, personal preference over another person's well-being, political corruption, and fraudulent use of city powers. The city council members should be prosecuted for abuse of power and fraud. The ordinance could also end up contributing to homeless, which probably already happened.

I have been aware of the Great work that your firm has been doing now for a couple of years after seeing a case you were doing in Washington State of ferrying people to a privately owned business I believe was a restaurant if my memory serves correct. I do not know what the outcome of that case has been but I recently learned of a gentleman who in Marin county in the state of California is having his property taken from him for code violations and was given a 90-day notice on May 21st of this year 2022 to vacate his property. He has been in a long legal battle for years and his property was put under a receivership. I don't know what legal steps have transpired,or whether there has been a jury trial in these proceedings but if there hasn't I would certainly be arguing to process violations of the 4th 5 th 14th amendment and 7th amendment if it is considered civil and all and also the 8th amendment under excessive fines. Again I do not know the answer if this has gone to a jury, but I cannot imagine a jury ruling against this man there are a couple of links on the internet which will bring light to this case but I would plead with you to help intervene for this man. Over the years this man has developed a self-sustaining environment and a septic system that is better than anything I've ever seen as producing and reusing everything with no waste he should be held as a genius he has a video where he walks through the whole process where I live two doors above him on the same road I can see his home I just recently moved here 2 years ago after marrying my wonderful wife I have yet to meet the man who will do all I can to support him. I have a case of my own that I am going to be filing in federal court in the next couple weeks. The statute of limitations is 2 years to file in federal court and that date is arriving soon. 10/14/2022 is when it must be filed by. I am 61 years old, an early discharged veteran of the United States army at the age of 57 I suffered a debilitating heart attack where I lost up to 75% of the left side of my heart muscle leaving 25% viable. I have major degenerative disc disease in the cervical spine and lumbar and when I applied for SSDI I was denied took me 3 years to get a hearing which was in my favor and during that time I have been studying and studying the Constitution and social security law. My heart attack was on December 27th 2017 and on December 27th 2018 I was here on this property visiting prior to our marriage me and my wife now were house sitting for her mother who was out of the country and the house was broken in two at 4:15 in the afternoon by 36 year old male who had no idea I was there I was the only one present as my wife was down the road I started making noise in the kitchen having no idea the man was in the house and he came into the kitchen and put a gun in my face. I immediately went on the offensive swept the gun away from my face and started pounding on his face with my fist while keeping the gun away from myself while still in his hand I drove him back about 15 ft till we finally fell back onto the floor near the front door of the home 15 or 20 seconds may have transpired and I knew that I was winded had nothing left in me and I turned and opened the front door and started yelling for that man to get out of there which he got up and ran I was unaware that he had already ran sacked the front of the house. The San Rafael Police department eventually caught the man and he took a plea and went to prison he also had ties to the Mexican Mafia and on 10/15-2020 around 3:00 a.m. when again house sitting at the same location I heard noises coming from down below the house and called the sheriff's dispatch to ask for a drive-by in case there was actually an intruder and while I had the dispatch on the line I had turned my video camera on to document in case I did get shot and determined that there was no emergency and let the dispatcher know that she asked me to go down and speak with the sheriff who was arriving at the property I went down to the driveway video cameras still in hand the sheriff approach I let him know there was no emergency and to my surprise he asked me if I was beating on my wife I said no and he asked if she was beating on me and I told him to get off of my property pointed at the property line which he refused to do I asked him for his name and badge number and his partners behind him and told him I was recording this incident and before I did another word out him and his partner attacking me handcuffed me put me in their vehicle took my recording and erased it took my telephone and erased it told me he was going to take me to the psych ward I told him he must be one stupid ass cop and that I had just passed a psych evaluation so I could get into a pain management group with the VA and that he needs to get me out of this car take these handcuffs off of me and that all of his qualified immunity was out the door. At that point he took me to jail and put me in a potential covid infection area which could cause my death had I gotten it with my heart disease and other disabilities I was held there for over 8 hours when I was released on my own recognizance my hearing aid have been knocked out of my ear when I was assaulted by the sheriffs again at the jail which I never have recovered and I learned I was booked for being drunk in public well when I was released they were going to push me out the door and I would not let that happen I told them they were to take me to the VA where I could get it an assessment haven't been brutally assaulted they refused but did take me to the nearest emergency room where I was diagnosed with suffering a concussion a shoulder sprain and had them run a full blood work which show that I was not under the influence of drugs or alcohol which I knew for I've been sober for over 35 years. I have been studying the law and believe I have a good case but I sure could use some support when it comes to filing this case and for a request freedom of information act request and other discovery. Years ago I took an oath to defend the Constitution and as I have gotten older I think I've gotten a little bit wiser but I take this oath very seriously and know that I must help bring our communities back into compliance with the Constitution. I have nothing against administrative agencies they do a good purpose in our country but what I do have conflict with is to process within these agencies and the right to a jury as the final arbiter of not only the facts but of the law as our first supreme Court Justice John Jay made clear to the only jury trial ever held by the supreme Court had the right to not only judge the facts but also the law in that case and our supreme Court would be blessed to let Jerry's decide cases individually rather than have to lay down constitutional law at every turn for some laws are good and just but in some cases they could be done without in that instant. If you read Zylstra v. corporation of Charleston 1794. you will find the perfect definition of due process and why administrative agencies should not have the power to write laws enforce laws and sometimes testify in those cases. that's why the jury is so important the last and best check and balance against the government and I'll be singing that tune until the day I die. I also understand that I am an infant when it comes to procedural processes within our system and that nobody goes to a battle by himself it takes an army to defend the country in the same way you don't walk into a courtroom by yourself you bring the heavy artillery such as the institute for justice from what I can see looks like this here's my best chance to bring Justice in my community to my neighbor Mr David Hoffman of the last resort and the lagunitas project and myself from the tyranny of our sheriff's department for your consideration Jeffrey Lee Long.
