Cpl. R. Schwab (L-16) stops a speeding motorist on Interstate 49 at N Stephen Carr Memorial Blvd in Fayetteville (Washington County).

Drivers who are under the age of 21 at the time of arrest can get an "underage DWI" for operating or being in actual physical control of a car or motorboat while intoxicated or having a BAC of .02% or more (but under .08%). If convicted, the driver will be subject to a 90-day license suspension and a fine of $100 to $500. The underage motorist will also have to complete an accredited alcohol education program.

The driver was in college for civil engineering but dropped out last semester to take some time off. He has intelligence for that degree and really should go back before he goes completely off track. Arkansas is one of a few states, that have a difference percentage of alcohol for drivers under the age of 21, that was established primarily, because of the days of moonshiners!

Absolutely correct. However, if you refuse a Breathalyzer (or saliva or urine) test in Arkansas, you will get a six-month driver's license suspension. Cowboy up and very nicely and politely request a blood test instead. It's the most accurate test and the refusal of the other tests will result in a blood test anyway.

@@douglas-hughes Absolutely correct. The RST is a subjective assessment based on whether the officer likes your face (or not). The chemical tests are scientifically objective. I get the feeling drivers are invited to play the clown in the cops circus as this allows the cop to play his or her silly 'compliance' games - the ritualized humiliation of suspects has become a central part of policing strategy in the US. Its absolute nonsense. Of course, my advice assumes you have zero alcohol or drugs in your system.

@@slingertennischronicles The subtlety here is that Trooper Schwab had no legal obligation to allow the passenger to drive the car from the scene, especially since the passenger did have some alcohol in his system. Perhaps Trooper Schwab didn't choose to have the car towed/impounded because under law he would need to do an inventory prior to towing and that is a bit of paperwork and time.

This state trooper Schwab is why they have such a bad name in Arkansas. No city cop or sheriff, would give a 20 year old with below normal .08 BAC a DWI out of discretion. This officer should have used better judgement for the case instead of slapping him with a DWI on such a goofy technicality. Equivalence of giving a ticket going 3mph over speed limit.
