Some corrections- In your scenario If Srini promoted to manager in US , he can’t file under EB1c. If he is already manager or executive in Bangalore before moving to US he will be eligible for EB1C.

@LAKVS77 my understanding is only the "intention" to employee in managerial or executive capacity with at least one year in the proceeding three years working in the international office was the minimum requirement.

AMAZING VIDEO. subed right away ! Can one from entrepreneur parole change to eb1c? With an assumption the person started the business outside the US for a year before the entrepreneur parole in the US.

@Kiara I'm uncertain, but I'm leaning towards no. You would have to have worked in a Managerial capacity in the international office for at least a year before coming to the US and working for the same employer in similar role. Completely separate from EB5 qualifications.

Our family filed 140 and 485 at the same time in 2017, and we just got approved for the 140 like 3 months ago. I wonder how long it takes us to be approved for 485. And what are the odds that we get reject.

@Samuel it took 4 years for USCIS to approve your I140? That's crazy! Most recent information I've seen has I485 approvals at just above 90%. So good odds you won't be rejected.

You must have worked as manager internationally for one year, prior to coming to the US on a work visa (H1B or L1 most likely) and your employer sponsors you for employment based preferences.

Has nothing to do with it. Must have been a Manager or above for your employer in their international office for at least one year prior to coming to the US.

Hi, Very useful video thank you, especially the scenarios. Just a quick one, the line on USCIS says - "You must have been employed outside the United States for at least 1 year in the 3 years preceding the petition or the most recent lawful nonimmigrant admission if you are already working for the U.S. petitioning employer.". Does the later part from "or the most recent....." mean you can work as a manager in US too to be eligible (assuming you have come on a L1A)?

@shardul thank you for checking out my video! My understanding has always been that you must have been a manager while working outside the US for at least one year in the previous three years and the intention of being employed in a managerial capacity in the US in order to qualify.

Possibly assuming this is accurate for your employer: "Your petitioning employer must be a U.S. employer and intend to employ you in a managerial or executive capacity. The petitioner must have been doing business in the U.S. for at least 1 year, as a legal entity with a qualifying relationship to the entity that employed you abroad in a managerial or executive capacity"
