Do you know if filling a petition with a lawyer boosts your application, or it is just a help for filling it and no other benefits?
@OscarsGreenCard3 ай бұрын
I don't think it boosts it just because it's being signed by a lawyer

Any ideas for making a case as an entrepreneur? I'm working on my eb-2 application using yours as reference... I think I have a solid case, I do affordable housing, which is in need. But looking at the 10 criteria it looks like it is all for academics o artists... business may be an art, but I surely don't get citations or publish papers...
@OscarsGreenCard Жыл бұрын
It is true that this category, unlike NIW, is catered more to academics just because how the regulatory criteria is written. I will look into how to frame a successful application for a business person. But i do note that this category needs proof of being one of the small percentage at the top, not just above average!

Roughly what cutoffs would you consider for papers, citations, reviews etc for eb1a
@OscarsGreenCard Жыл бұрын
Hi, i think i will cover that in a specific video because there is no "cutoff" , it's not just about numbers but also quality

Hello, i am ur new fans. I have a question. I live outside USA and I wish to rent a POBOX in USA and used to receive receipt from USCIS when apply NIW. Is it ok to use POBOX address to receive receipt ? Thank you !
@OscarsGreenCard Жыл бұрын
Typically PO boxes are not encouraged for these types of processes but I haven't seen any official statement about it. If it were me, I would avoid it

I want to see how we can easily convert EB2 niw into EB1 A. Much appreciated if you do a video on that. I'm prepared to submit Eb2 niw, but due to the retrogressive issue not wiser decision. How you can help me on that.
@OscarsGreenCard Жыл бұрын
Hi Daniel. There is not automatic way of doing that. You would need to rework you petition, including re-writing big portions of your cover letter. It is doable but may take you a few extra days. Of course, you also need to first make sure you can hit at least 3 of the 10 regulatory criteria for EB-1A explained in this video

Hi, Oscar i follow you regularly. Please tell as i received my I 140 approval in EB2 NIW petition my PD is 29 Nov 22. Now if apply for EB 1A and suppose it gets approved too , so my first approval will be devolves?
@faysalamin1148 Жыл бұрын
If I apply for EB1A and get approved, what are the chances that I will get a visa because the backlog is the same with the embassy
@OscarsGreenCard Жыл бұрын
@@faysalamin1148 Congrats on your approval. The two petitions are independent entirely. The only thing is that you can use the priority date from your first I-140 if you want to. But if you country is current then it does not matter. About chances, you know I don't speculate

Does premium processing help in retrogression? lets say for example if we file my petition in July 2023, can you tell me on average when can i expect to enter the US through this pathway if i require consular processing from Canada? Like the current priority date shows as Feb 2022 i think. If for eg the petition is approved in 4 months. What comes next and when?
@OscarsGreenCard Жыл бұрын
No, it doesn't help with retrogression

How does it work? If 140is approved, can go to US or need to wait for the green card
@OscarsGreenCard Жыл бұрын
you need to wait to get the visa approved, through consular processing
@faysalamin1148 Жыл бұрын
So getting approval and waiting for visa is the same as EB2 NIW. Backlog at embassies are the main issue

you can still apply but if you need to travel to the US I would really consult a lawyer before doing anything. Otherwise you can proceed as normal
