1) Section 170 RTA 1988 (and same condition right back to Motor Car Act 1903) if the PRESENCE of a motor vehicle causes harm or injury then the driver MUST give details of the keeper, which MUST either have insurance or a cash deposit on bond to cover their liability for any civil claim. 2) In any incident where significant injury has occurred there should be a STATS19 report and ideally Police attend to secure relevant evidence before it can be erased or changed (ie driver goes home and sinks a few stiff drinks, or traffic running over road wipes away traces of braking or skidding) If, as worryingly appears to be possible in this case, the driver is unfit to hold a licence there are police powers to revoke a licence on the spot
@grahvis7 жыл бұрын
This is why , in some situations, cyclists adopt the primary position so passing motorists aren't tempted to pass where there is insufficient room.
@BCCletts7 жыл бұрын
Sadly by observation too many sports cyclists are so focussed on riding that they fail to notice a driver getting dangerously close in situations like this. Many regular utility cyclists with greater awareness of their postion relative to other road users, and 'mixing it' on busy urban streets tend to fare better in this respect.
@cyclingninja96777 жыл бұрын
Fucking hell!! Glad the cyclist is OK but, what are some people here going on about? its a pinch point and drivers should not be squeezing through they should wait until its safe to do an overtake giving the responsible distance to do so safely. He does not deserve a licence if this is his view of safe driving.

This is why I'm fearful of my own grandad, he's getting on, his speech is slower, thoughts aren't nearly as quick as they used to be, he struggles walking, nearly falling down stairs, and yet will happily jump into a car and drive. This is going to be all too common with an ageing population I'm afraid to say, it must be horrible to get to that age and not be able to have as much freedom, having something like a car taken away would be devastating (that's why I try and take it easy on the bike, love riding it too much!) but there needs to be a requirement for tests to be re-done at a certain age at the very least. Good on you for stopping though, right place at the right time.
@BCCletts7 жыл бұрын
Consider first weaning him away from driving (encourage him to use bus pass/taxi as less tiring/stressful). But ultimately you should consider stronger persuasion even to the extent of discussing with local Community Police officers - sooner or later he will get pulled over for driving erratically/out of synch with other traffic, or have a minor bump that attracts attention. Better to do this in gentle stages
@CalmBiker7 жыл бұрын
Happens all too often unfortunately. I've had this happen to me. Far too many people are in too much of a rush and don't consider slowing down for cyclists and waiting for a good place to pass.

Whilst it is always difficult to think “His license is his independence” perhaps I’m a little cold hearted because I see it as fortunately there are a lot of financial allowances, and benefits entitled to people with mobility problems that help them carry out their day to day lives without hindrance. For some people it is necessary to have their own vehicle but Taxis are extremely accessible now days that perhaps for people like him would be the better option without limiting his independence.

@Cliffjumper247 жыл бұрын
Good on you LoneWolf! From the video, the driver didn't even change his road position.... he drove through that gap as if the cyclist didn't exist for him. As a cyclist myself, I always 'take the lane' through a pinch point like that.... but I do it clearly and in a controlled manner. My technique is; Shoulder check. Give a nice clear indication that I'm moving to the right (I even wear white gloves in the winter) Move out in the centre of the lane, to make it quite clear that this is not the appropriate place for a safe overtake. Do another shoulder check just before the pinch point. Once past the obstruction, I slide back towards the kerb.... and if I've held anyone up, I'll give a polite wave of thanks for their patience. As far as I'm concerned, I have the right to use the road as any other road user, and _MY safety_ is more important than the 5-10 seconds delay for a motorist to get to their destination. Being a road user is all about sharing the road... and I bought my cyclecam specifically because I felt that there was a distinct change in attitude from many motorists, where I had people leaping out of junctions, or onto a roundabout while I was going around it... ...which is probably related to the fact we have had a ride in people using the road, but without a corresponding rise in road infrastructure to go with it.... which was breeding a potentially dangerous mindset of "If I don't 'go for it' now, I'll never get out!"

Seen it too many times but drivers like that should not be driving. They often have automatic cars for health reasons and those are even more deadly when they 'press the wrong pedal' - I know a case where a toddler was killed because an elderly driver in an auto pressed the wrong pedal' while parking. Spacial awareness and sight problems like this video are two other issues. There are other ways to maintain independence if elderly or disabled (free bus pass, taxis etc). In the nicest way possible I hope he lost his licence.
@twennyfo73667 жыл бұрын
Richard Robinson please forgive me if I'm missing something here, as I can't drive manual cars! But isn't the brake next to the accelerator on a manual car too? I just can't quite understand how it's more dangerous to drive an automatic? Totally agree that this driver shouldn't be on the road anymore though, his judgement is massively impaired!
@richardrobinson15547 жыл бұрын
TwennyFo If you are trying to park for example, in an auto car if you stomp on the accelerator instead of the brake the car will launch with all its power. It can't really happen in a manual car because your left foot will be on the clutch pedal which gives your right foot it's bearings, plus stomping on the accelerator by mistake will not have the same effect in a manual unless the clutch pedal is released at the same time, even then it would just rev or ride the clutch, or stall if the clutch is released too quickly. I've seen a lot of videos, mainly in parking situations, where an auto car driver has stomped on the accelerator instead of the brake and the car has launched at speed into someone's garden/other cars/over a wall etc. It happens a lot more than people realise.
@twennyfo73667 жыл бұрын

That he is completely oblivious to the fact he hit some one takes it far beyond an accident or some mistake. If he had "just" misjudged the gap then hes just another bad driver like most others but to hit a cyclist and not be aware of it disqualifies him from driving. Its not the offence in it self it is why it happened. Aren't there court rules these days that allow the cyclist to pull out and block a pass when coming up on spots like this where a pass is unsafe? There are here, not sure about the UK.
@djtaylorutube7 жыл бұрын
Cyclists are encouraged to "take the lane" to position themselves in defence of this sort of thing. What then happens is that the motorist tries to pass regardless and makes complaints about the cyclist riding in the middle of the road and that because they don't pay road tax, shouldn't be on the road etc.
@madeinuk687 жыл бұрын
These pinch points are everywhere on my commute to work. They are an absolute danger for cyclists. I understand that they are there to help pedestrians cross safely,but at the risk of cyclist getting hit,is an utter disgrace. I have had so many close calls,because of impatient drivers at these points,that I have recently invested in a Fly6 rear camera. I hate to have to resort to a big brother tactic,but when drivers take chances with my life,I felt that this was the thing to do. The thing that really concerns me though in my area,is the lack of warning signs,so at least drivers can be aware of the risk to cyclists passing at these pinch points. But then I suppose that costs money,which seems to be far more important to my council than the safety of cyclists.
@jhferu7 жыл бұрын
Stayshtum68 if you find a lot of motorists pass you to closely, you might want to evaluate your positioning. You should never be on the receiving end of a close pass at a pinch point, because you should be in primary position. I get a few close passes, but I seem to get a lot fewer than the people I see riding in the gutter.

The UK makes the news just about everyday when it comes to cyclist or road rage. Its So bad that Police and law makers are rushing to change the laws. Remember the cyclist that hit and killed the pedestrian . He was sent to Prison because for killing a pedestrian but also illegally riding a bicycle with no breaks which is illegal. UK makes the news everyday about cyclist being hurt and road rage by other motorist that don't give cyclist respect. Yes cyclist are street legal vehicles, Yes cyclist can take the full lane. Motorist are not allowed under any circumstances to harass motorist or tell motorist to get off the road or they could be turned over to Police for harassment. Just recently a Drive was arrested and charged for assault and battery but also road rage That Drive was sent prison. So many people that visit the USA needs to remember the laws are different just because you were able to do things in your own country does not mean you can do them here. Now when a cyclist visit lets Say UK for example they will ride the same way they do at home but following traffic rules in the direction..

Yea Elderly Drivers are recommended to retake their driving test as they get older because the rules of the road changes over the years from the last time they took the test and got the licenses. Now AAA offers a program for elderly and senior citizens you don't have to be a member but its something ever elderly or senior citizens should look into. I am sure its offered in the UK
@atkin2077 жыл бұрын
The problem is that it's not a legal requirement. He will need to gather the points on his license for him to lose his license and then he can reapply for the license and do a retest after the ban. For this he will only get 3 to 5 points, not enough for a ban. At the moment he just needs to renew his license every 3 years. He doesn't need to do retests. It's usually only family members that can push the elderly to stop driving.
@slowdownmoveoversharethero97017 жыл бұрын
I am not sure where your from but here in the USA if an elderly driver hits a pedestrian or a cyclist he/she can loose his licenses. But also by a certain age you start to loose your Driving and think right from wrong and not think twice. That where AAA driving comes into play which means you don't to be a member but they offer a course for you to ask questions and all before getting behind the wheel.
@TheLoneWolfRider7 жыл бұрын
Share the Road this happened in the UK where there is no AAA, I'm almost certain the driver did not face any charges. The only way he would lose his licence is if a doctor deems him unfit or he accumulates too many penalty points.

My number one issue with drivers is that DVLA MUST be informed if you have a medical condition or take long term medication. Most people with medical conditions have failed to tell DVLA of them.

At some point people are too old to drive a car, for others.and their own safety. Sad, but a fact of life. And it is amazing how often the family has to make the decision without authorities knowing there's a too old driver on the roads. Rather him losing his license then a child gets hit crossing the road. So yes they need to check the guy. No shooting him in the back off the head or hatred here. Maybe it's just you? BTW If he would live in Holland he could stay mobile for years with a mobility scooter thanks to all the cycle paths. It could well be people keep driving in the UK for longer.

@BCCletts7 жыл бұрын
You have to renew licence very 3 years after 70*, but at present this system accepts self validation of fitness to drive, It may be (driven by insurers perhaps - a lobby option) that over 70 you must have a medical with an accredited specialist medical centre NOT your own GP, and pay a small fee for this. Refusal of risk by an insurer then makes it illegal for you to drive (ie you cannot insure a car in your name) providing a further constraint on access to a car, especially if that insurer condition extends to any other vehicle keeper, voiding their insurance if they allow a blocked driver to use their car. Car hire companies generally cut-off their standard service to over 70's. *Vocational licence holders must have a medical every 5 years until the age of 65, and thereafter annually. That said there are still 80 year olds driving coach tour parties, as they are generally less hot-headed, and drive in a manner well suited to their typical (retired) passengers.
@Cliffjumper247 жыл бұрын
I agree with Escobars original point.... I'm only 43 but age is starting to affect my eyesight and now I need reading glasses. Likewise, I'd like to see drivers over a certain age (lets say 65 or 70) having to take a driving test ever 5 years. We have two main groups that are likely to be involved in collisions, new/novice drivers (who haven't has enough 'experience' behind the wheel), and elderly drivers. Having a test for the elderly is a form of risk assessment, asking "Is this person a risk to the safety of other road users (including pedestrians), or to themselves?" After all, I don't think any reasonable or rational person would want to be responsible for a death due to their impairment, would they? A start would be the standard eyesight test, where they would be asked "Can you read that numberplate?" when 20.5 metres/67ft/5 car lengths away. If the answer is "No" (and their eyesight can't be fixed with new glasses) , do you want to be sharing the road with that person? Do you want a member of your family to be walking across a zebra crossing with this person behind the wheel approaching them? This isn't saying that 'all people over 70 should be banned from driving'... it's saying "Is this person fit to drive. And remember.... you don't have a 'right' to drive. A licence allows you to drive, and can be removed if you are unfit to do so safely.
@BCCletts7 жыл бұрын
Perhaps the route to this is through the insurers? Hire car companies set aan age limit for walk-up hire at 70 (but may offer cars to a person who takes out additional insurance or has medical certificates) Insurers probably weight policies that include a driver over 70 on the policy to drive the insured vehicle and that premium might be reduced if a medical (paid for) is obtained from an accredited specialist medicals centre (eg Nuffield) - so the option is ppay a highger premium to drive over 70 or pay for a medical to pay less for your insurance?
