I think it was well worth taking the time to watch and it actually cleared up something I was not sure about with the difference between OEM and Retail Software, so thank you for that!!! Not so much into the I.T. Sector my self other than armature interests, but as a businessman my self you are 100 percent right when you say just because the licensing police may not be tracking down and punishing license infractions "Yet",,,, It would be a big mistake to assume that the way things are now is the way things will always be... Always better not to try to cut corners and do things "On The Cheap", because sooner or later that will catch up to you and bite you in the ass every single time...

RE: Piracy It's not the FBI that comes knocking at your door, it's the BSA (Business Software Alliance). I have seen it twice in my life. A local business here just recently settled for $120,000, and still had to get compliant in all their licensing.

IP Law is to nurture our accesses to solutions, took quite some administrations to maintain accesses to solutions, and if we use piracy, we would be less encouraged to create and maintain such administrations. The question is, how pedentic does "connect" mean. Say only 5 seats actually need the server, but 100 devices can ping the server. Does the pinging count as connecting? is it 100 cals or 5?

Does the word "connection" apply to mapped drives to a server from a client that needs to see shares even if that server is not doing a formal File Server role? In other words if 1 CAL costs $5.00 and I have 50 users that have mapped drives to shares on that server, am I forking over $250.00 for all the licenses?

There are lots of "Open Source" software. However, the set of "Open Source" software is a superset of Copyleft or GPL/BSD licensed software. There is no *gotcha* on GPL and Copyleft software as you state with "home use only" "Open Source." A GPL/BSD licensor may charge for copies, but any one of the licensees has full rights to give you their copy for free. GPL/BSD prevents actions otherwise.

Dead serious: what open source packages require that you pay a licensing fee? I'm not arguing, I've just never seen this. For instance, what video software are you talking about - that you're using - that's open source but which required a paid license? I run both Linux and Windows servers at different locations. The MS server was just a test and only runs one website (not for profit). Who says this on KZbin - it's a bootlegged copy of Server 2003. But Unix stuff is just free - isn't it?

Actually opensource means software that kan be run for any purpose, copied og modified. If a piece of software says only for none commercial use it does not qualify as opensource.

Eli, you're wrong about Open Source. What you're describing is commonly called Shared Source. For a license to be considered Open Source, it cannot restrict use in any way (cannot differentiate between home and commercial use, cannot say 'Abortion clinics cannot use this software', etc) and must permit modifications and redistribution of the software (either modified or non-modified with the source) for no charge or at a fee. Some don't REQUIRE the source to go along with it (BSD), but the license must permit it. Some companies try to get around it by including copyrighted material or patented things that make it difficult to redistribute. But this can be avoided by stripping out the proprietary crap (RHEL -> CentOS).

If you've ever tried to use pirated MS software (did back in the day when I was young and dumb) and eventually they will discover through activation procedures that you pirated it and your software will be rendered useless. Will they fine you? Chances are slim to none, but they will do their best to make sure you can't get full use out of it!

I've worked at a couple companies and they have all been small enough we don't get audited, I think MS etc really cares about those huge companies like those with 100,000 users, so my 70 probably doesn't really register to them. However, if one of your users/admins becomes disgruntled, they can report you to the BSA or whoever (use to have rewards for turning people in!), this would result in some crazy fines and an audit etc... I have always been good on mine because as an admin, it would obviously be pretty bad for your career... (of course newer OS's make this somewhat mandatory anyway) play it safe, heck it's not my money anyway, make the company buy those licenses!

I'm going to disagree about open source licensing. You only have to watch out for GPL'ed software. GPL software usually means a commercial version or support contract buried somewhere. Other open source licenses are much more liberal in usage. MIT and LGPL are largely displacing GPL these days. Windows licensing is always a beast...you are generally better off if you can avoid it altogether but businesses generally need to massively deploy software to multiple machines (potentially rollout of changes to many thousands of PCs) and Windows does that the best because it has the best tools available for change management. But when it comes to servers, if you can get away with Linux, you are way better off using Ubuntu Server LTS editions, which generally has a much lower TCO.

I've done a small amount of IT stuff for some clients using Microsoft servers and pirated software is like kryptonite to the people with whom I've dealt. In a for-profit business you'd have to be insane to use pirated software.
