It should not be possible for lawyers to even have access of client funds. This whole "escrow" account thing needs to be Refactored. Third part escrow (not the layer, not the client) would be one simple solution. The escrow company needs dual approvals to write checks. It is a black mark on the whole legal system that things like this have been allowed to happen for so long. It happens all over the place and at smaller scales where nobody knows and people give up as it would cost more to sue the first lawyer with a second lawyer, than the funds they would get. So the system is rigged against people that are less than independently wealthy.

It seems to me that a WHOLE lot of this could have been avoided if the COURT, when settling etc or divvying up amounts, notified the client AS WELL AS the lawyer dealing with the case. Well surprise, surprise. The California Bar issued this "apology" today (3/10): "The May report found that Girardi intentionally cultivated relationships at the State Bar and it spotlights nine individuals at all levels who accepted his largesse and failed to report it, creating conflicts of interest. The report details several instances in which the involvement in Girardi cases of conflicted individuals tainted the discretionary decisions they made on behalf of the State Bar, and as a result, the Girardi cases they worked on were improperly closed. *** A failure of this magnitude does tremendous damage to public trust, not only in the State Bar, but in the legal profession as a whole." Blah blah blah. Decades of malfeasance. 🤬
