Plaintiff in a battery action does not have to show any damages. It's a dignitary tort, and the slightest touching entitles the plaintiff to at least nominal damages.

+eswyatt Thanks for the correction! I'm not sure how that slipped in (and the act element is missing). The battery prima facie case is misstated in this episode, but described accurately in the following episodes.

my son was almost murdered twice on Maui and no attorney in the state will take his case, Det. Mark Schmidt came out a few months back and exposed the corruption from top to bottom of the justice system, how the hospitals promised a safe place to stay with a nurse and cook and room and rides to court.... then the hospital wheeled him to the bus stop with nowhere safe to go and against Physical therapists both times and both cases are being swept under the rug, my son was beaten with a 2.2 about 4 feet long Nov. 30th 2020, and a hatchet on Oct. 26th 2019, the CVCC and Freedom for the People both were so blown away this wasn't on the news and my son gave him permission to proceed then the CVCC waited a year all while my son was healing from traumatic brain injuries, every rib broken or fractured, punctured lung, loss of spleen, eyesight has suffered horribly and his hearing and he is just strart to be able to think clearly again....we have been lied to by the MPD, the deputy DA slandered my son on the phone, and the hospital has refused his medical records and the police made up 1 police report for 2 attempted murders that they tried to make assaults and then harassed him and assaulted him after they threw him out of the hospital a danger to himself and the community cause he was having horrible, terrifying hallucinations from the brain injury very shortly after they through him out although he couldn't even speak in sentences but nursery rhymes the huge Tongan cop put down the rock and my son begged him not to hurt him so he dropped the rock and kicked him in the chest and broke both collar bones, his neck/vertabrae was fractured or broken already..now they are trying to force him to give reasons why or have Drs tell them why he wasn't able to respond sooner, but we have emails, letters, ROI's....even the mayor called all the people who lived in their vans and traveled the island he called knuckleheads on TV, like apply your knuckles to their heads and finally the governor said all info during covid time was not to be let out of the states hands....he's running out of time cause they got to everyone and then stalled so an extension ran out but he never had his day in court although the police never had a hard time writing him 18 tickets during covid which he called a legal fiction and they dropped them all with prejudice.....but Maui alone made 50.2 billion in 2018 and they don't even want to replace his teeth or give him more than 10,000 and now they are trying to get out of that! Help please....any kind of direction would be greatly appreciated....he couldn't even think long enough for 2 years to try to file a suit on his own....what a gross miscarriage of justice, and they made him out to be the bad guy....he was asleep the 1st time when he got hit in the lip and mouth as his lip was hanging down 3 inches and teeth broken and knocked out....more the second time he was unarmed and not provoking anyone...he has always been a gentle, kind, giving soul, and they tried to kill him for it and pretend like he isn't a human being a doesn't get restitution or any help from the State of Hawaii, he posted on every bar on every island county in the State......they have dehumanized him and the brain injury and nightmares, he had to get on meds cause he didn't want to live in such an unjust world....we have almost lost him and he needs help so badly.....please..send a number of an attorney to him at 808-298-9207 or his mother Cindy his representative payee for $804.-SSI a month and he can barely walk without medication, he's in constant pain, and it's heartbreaking and disheartening that NO ONE has called him back after they found out Freedom for the People and CVCC were trying to help him then they told all 3 of us different things and now they are saying you have 30 days for a Dr or therapist to write why he wasn't able to respond, even though he wrote, called, emailed....over and over and over... tell Cindy this is in response to him reaching out for help with this......situation

It looks that the term you should use, I mean, type @ 10:13 would be "intentional torts" rather then "battery", right? Great series of videos, congratulations from Brazil.

Don't think strict liability cases can necessarily be classified as tort cases, considering they are statutory (and not based on common law) in nature.

The Police and DA have allowed intentional Tort. I have specific reasons that most people will HATE their family for. First. Trying to speak down to them them when I have more experiences in jobs and study skills that they have because I have the streets and the people. They have the misfits of society that I keep getting into it with. These people looking stupid. Second. Questioning my breast cancer and skin cancer studies. My facts are blooming in their faces. My skin tone is returning by applying SUNTAN lotion abd lotion that these annoying people say is not true. Third. They ALL rely on a Doctor for everything. My feet was swollen. I took care of it myself. My blood clots were an issue. I took care of it myself. Fourth. Their dysfunctions in their personal relationships. They all have an abusive type of relationship and have tried to force people I date to be in their misery by continuing to contact and speak to my male and female associates without my authority about things they are NOT welcome to speak or talk about. Fifth. They are the worse liars and users but always think that the Police is only going to come for me and whoever I date. Six. My parenting skills were very fair with mistakes like every other Parent. They pressured their kids. My Sons were being taught to respect themselves, others, and take care of themselves. Seventh. They told my me. I should not be in my Sons lives after they turn 18 but ALL of them be around their children all the time. Eighth. They are always claiming things that are not theirs like coming back to my home a year or so later causing corrupted cops to give me a record and defame my name for working and paying my bills by myself. Ninth. They are always trying to tell you what you can't do. I. E. If someone is the one bothering you. They keep lying like you cannot defend yourself. The Police knows of this repeated illiteracy and keep involving me in their ignorance. Tenth. Telling me how to live my life. Who I should date. And what I should be doing. I am a grown ass Woman who has proved all I have done was to set up my future when they do not have a future. Bye Craig and Felicia.
