It is the Supreme Court that will decide and if the Judges of the Supreme court will abide by their oats of office and follow similar precedent of when lawmakers defected on the floor of the assembly. The Supreme court will have to proof to the while country if previous judgements on defections submitted their membership card of their new political parties before Supreme court judgements.

I'm afraid you got it wrong on the point of law here. You don't need to write any letter or do anything special to signal your formal defection : once you pronounce it on the floor of the house, and national newspaper it becomes what the law referred to as notorious fact. It is a trite law in Nigerian law of Evedence that a notorious fact must be admissible in evidence. Period.
