The winner are those countries that succeed to fulfill their goals and objectives in the war. For example look at the Cold war. USSR fall as well as the communism as ideology. Since this was the goals of the US they are the winner, it doesn't master that there is no bullets flying, or territories captured. The U.S. achieved its objective so the U.S. won the Vietnam war.
