I'm no defender of the fcc by any means, but honestly, if you see for years their not enforcing the laws, the last thing you want to do is provoke them into action!, just be civil on the air, transmit what you need to, when you need to, and you'll have no problems!, but a lot of these guys ruin it for everyone and then claim their the victims!

As a exmilitary, 20yr truck driver, i have great radio etiquette and i believe in this process, only because when i use the radio its for needed information that i must understand clearly. So i transmit in the same way. I have ran into so many people transmitting b.s like one guy in south philly area, he would continously with a high power radio say one watt over and over again. No one could use channel 19 in that area. For several years i would travel that area and hes still doing it. Each big city i would get close to , the b.s would start. From playing music non dtop to tv shows. With the 1000s of fcc violations i have witnessed, when i would come back 3mo to 2yrs later, still the same . So i understand why the fcc doesn't do much, how could they. Great channel new subscriber and now new gmrs, uv-5 operator.

Does the FCC have a way to collect the fines?, I remember back in the 60's and 70's they would confiscate peoples CB radio equipment for major transgressions like hundreds of watts of power and cursing and interference! 😲😲 They must have upped their budget this year!😲😲
@CliffFoxKU4GW

I served a decade as an ARRL Official Observer and each month the ARRL would send out a update of actions and activities being done by OO's all across the country. Well, one month they had a copy of a complaint from a amateur radio club in China Grove, (Rowan County) NC that operated a UHF repeater on 443.250 another ham was jamming. I gathered the guy got kicked off the repeater and so he had mounted a small UHF yagi antenna on the corner of a steel box off a box type truck he used for a storage building and he had the antenna mounted on it and pointed directly at the China Grove 70 centimeter band repeater and transmitted a very low wattage signal on the repeater's input frequency of 448.250 effectively jamming the repeater. What really surprised me was this same ham had received a FCC Warning Letter for doing the same thing 18 years prior and the FCC had never taken any action other than mailing him a Warning Letter 18 years earlier. When the ARRL done away with the Official Observer program and replaced it with the Volunteer Monitor program that was the end of Official Observers and as far as I know he still continues to jam the China Grove 70 cm (440-450 Mhz) repeater to this day so he has been jamming this repeater for over 20 years now without any further action ever taken by the FCC so the folks in China Grove have to live with the ongoing interference to their UHF repeater. I personally know the ham doing this and never thought in a million years he would ever be the type of person to do anything like this yet the last I heard it still continues to this day!

I know of one case where someone was intentionally interfering with a very popular weekly net on a local repeater. Members of the club that owned the repeater were able to locate the offender, then a club member who was an attorney prepared a law suit; they didn’t file the suit with the court but sent the offender a copy and a letter explaining they were prepared to file unless he stopped interfering. Apparently, that worked. I don’t know the details of the law suit, but it did have merit.

Unless it has recently changed, the FCC does not get any tax dollars for their operating budget -- they are funded by regulatory and licensing processing fees. I would argue these are isolated, specific examples of in-your-face violations that were reported and which piss off all radio users. That notwithstanding, there are millions of people using modified ham radios and so-called 10 meter radios that are 'modified' for 11 meters with the flip of a switch, most TXing at 50 to 100 watts out of the box. There is too, a plethora of amateurs driving kilowatts out on 11 meters. It would be interesting to see how the FCC will tackle this 'violation'.

To get in trouble with the FCC you would have to do something blatant and someone has to complain about it. This is the first time I’ve heard of an FCC enforcement for someone interfering with amateur communications, previous enforcements I’m familiar with were someone interfering with police, emergency services or aviation.

At around 8:00 when you are discussing Jayme's history of noncompliance, the letter says something about his "failure to make his station and records a available for inspection". I assume "station" just refers to his CB/antenna/accessories, but what records are they talking about? I know that back in the olden days when CB required a license and an official callsign there was some sort of basic logbook, but that all ended in 1983. Why would they have expected him to be keeping records in 1999?

I think what I’m hearing, is that even if I get a GRMS LICENSE, I’m still in violation of the FCC for operating a non FCC approved GRMS radio such as the UV 5R on a GRMS frequency? If that’s true what’s the point then of getting a GRMS license? Or would it be double trouble for 2 violations instead of one? Since I just bought 2 new UV 5R’s I’m not eager to go out and buy some GRMS radios. BTW this site rocks brother. 👍

No one has ever, not once, been cough in an enforcement while using a UV5r or the like. Knot a single fine for using one without a gmrs and not a single fine for using one on ham frequencies without a ham license. If you are going to use a uv5r while hunting, camping, a off-road group of 5 to 100 people or your family in disneyworld there is no way to get caught and no one but sad hams care. These enforcements are on static setups not uv5r

I’ve been expecting this because our government, the federal one, is sorely lacking funding. And the FCC doesn’t need to bother with the formality of a court hearing but merely assess the appropriate amount for said violation. While $24,000 sounds excessive, in the broad scheme of things it’s necessary if the deficit is to be alleviated.

I bet I can tell you what actually happened in that situation....I worked a temp job once where I walked in and saw how easy the job was. I began working hard fast and efficiently. Other workers got pissed at me for doing that because I was making them look bad, and if management knew how easy it was, they would increase the work levels.... I'm betting a rookie or two got hired on who started as an overachiever that didn't get the memo. Since an official report had been made, his or her "punishment" was to see it through to completion. Afterward, he had to do continued updates...he or she will never do that again.
